I purchased a service from Trademark Engine to Trademark my book's name. I never received the service my book name was never trademarked. Trademark Engine claimed the law changed and they could no longer complete the service so according to them they offered an upgrade so I could use their lawyers to Trademark my book's name. I never received an email or call about this change. They claimed they placed the information on the portal. I asked for a refund since I did not receive the service but they refused. Their claim is they cannot refund me because they offered me an upgrade and it's not their fault I did not receive notification.Business Response

I am appalled and frustrated with the blatant negligence and misleading practices Ive experienced with Trademark Engine.I paid $99 for them to handle Office Actions on my behalf, and they failed to do so. As a direct result of their inaction, my trademark is now abandoned. When I contacted their team, I was told this service was tied to an old subscription that was never made clear when I signed up. When I asked for clarification about how long the subscription lasted, I was told it lasts until its used. Well, it was never used. That means I paid them to sit on their hands while the deadline passed and my intellectual property protections vanished. That is grossly misleading and frankly, malicious behavior. In addition to that, I paid another $99 for a Declaration of Use with the clear understanding that it was to renew my trademark. But because they didnt respond to the office actions, again, my **** is abandoned, and that filing is now useless. I was never even aware that office actions were issued. On top of all that, I paid $59 for a certified paper copy of my trademark, which I will never receive because the trademark is no longer active thanks to their failure to perform services I trusted and paid for.I paid them around $900 and the least they could've done was refund $257 for the services never rendered. Their failure to act has cost me far more than just the money I sent. Its damaged my brand, my credibility, and my trust in their service.I will never use their services again and I discourage anyone from doing so because they truly do not care. Were very sorry to hear about your experience and understand how upsetting it must be to have your trademark application abandoned. The abandonment notice was issued on June 30th, and you have two months from that date to file a response with the ***** if you wish to revive the application.
While you did purchase our ******************************** this add-on requires the customer to contact us when an office action is received in order for our team to initiate the response. Unfortunately, we did not receive any communication from you regarding the office action, which prevented us from assisting before the ***** deadline.
Regarding the $99 subscription, this covered privacy protection, and we did file your application using our privacy information. Our records indicate the last charge was refunded and the subscription has been canceled.
We attempted to process a refund of $257, covering the *********************** ($99), Declaration of Use add-on ($99), and Certified Copy add-on ($59), as referenced in your review. However, the system returned an error due to the time elapsed since the original purchase. As a result, one of our agents will be reaching out to confirm your mailing address so we can issue the refund by check.

I signed up to check to see if a trademark was available, and like all the people below me they have annual and monthly charges some up to $500. As soon as the first charge was drafted I canceled as I did not KNOWINGLY sign on for all these crazy prices for things I didnt know about. I have emailed them 2x trying to get this to end and I am STILL getting attempts to draft these fees and the audacity to send me emails like my account is overdue. I purchased a trademark registration package from Trademark Engine to ensure the proper and accurate submission of my trademark application, including appropriate language for the goods and services description.I provided all required information about my proposed ***** including a description of how I was using it in commerce. Trademark Engine prepared and submitted the application on my behalf.The ***** rejected the application due to an improper classification and description of serviceslanguage that was drafted entirely by Trademark Engine. Despite being listed as the correspondent on the application, Trademark Engine failed to notify me of the rejection or take any follow-up action. The "Order Status" page on their website reflected no updates regarding the rejection or necessary ******** assistance was offered to correct the filing, and I was forced to hire an attorney to fix the issues caused by their submission. At the time of your order, we offered a self-directed, DIY trademark filing service. This service allowed customers to submit their ********************** information for filing without legal guidance or representation. Under this model, we filed the application based strictly on the customers direction. While we may have made non-legal suggestions about classification options, the final decisionsincluding the description of goods and serviceswere ultimately up to the customer and submitted as instructed. We did not, and could not, provide legal advice or revise descriptions independently.
Additionally, your order did not include our ******************************* This is a separate offering that provides support if the ***** issues a refusal or other office action. As such, we were not authorized to respond or take follow-up action on your behalf. The ***** sent the office action directly to your email, as listed on the application. Customers who receive an office action and wish to engage our help must reach out to initiate that process.

The company failed to deliver the service it advertised. I purchased their trademark application assistance based solely on their claim that they would generate "USPTO-compliant classes selected for your mark." The only reason I used their service instead of filing directly with the ***** was to ensure proper classification.
However, the Class 41 description they generated was rejected by the *****. This classification was the core output of their service and the only substantive value they offered beyond simply submitting the form yourself.
Their product failed in the only area where it was supposed to add value. As a result, I received no benefit from the service I paid for.Initial Complaint

Without my permission or authorization, Trademark Engine aka Swyft Legal, enrolled me in not one, but two subscription services, and since April 9th has billed me 3 times (April 9, 2025 for $175, April 29, 2025 for $199, and again July 9, 2025 for $175). I noticed the third charge today, and that's when I saw the other 2 (unfortunately both myself and my accountant missed this previously). They agreed to refund the charge from yesterday, July 9th, but refuse to refund the other 2 charges. They claim that they automatically enrolled me in the 2 subscriptions with a free trial when I filed for a trademark, and it was up to me to unenroll to avoid being charged. It's incredibly unethical and feels like a scam.Business Response

We initially engaged Trademark Engine to file a trademark application for trademark INSTA-TEETH. On October 1, 2024 we authorized a $49 fee to register this trademark. However, the application was never filed. Since then, the company appears to have canceled the services based on what I could see when I logged into their site to investigate charges. We were not notified of the cancellation and despite their own cancellation, we were still subsequently charged:--$175 per quarter for trademark monitoring services I did not consent to enroll in --An additional $350 for an unspecified service I never requested or authorized These charges were not clearly disclosed, nor did I approve ongoing billing. Any terms indicating otherwise were buried, misleading, or did not reflect the representations made during the checkout process. For each charge, we have neither received invoices nor receipts afterwards. Even on the credit card report, the charges are obscurely described "MONITRFEE". Online there is no way to cancel, no guidance for persons wanting to cancel and no way to delete our credit card information from their site.We have written demanding a refund, and have already taken steps to block future payments and intend to initiate a chargeback if this matter is not resolved promptly over the next 10 days.Business Response

Your original order was placed under our previous DIY trademark filing service. As part of a company-wide transition, we moved to attorney-led trademark packages and sent you an invitation to upgrade at no additional cost. This invitation remained open for a period of time, but unfortunately, we did not receive a response before the eligibility window expired. As a result, your order was canceled. We sincerely apologize if this was not clearly communicated.
Regarding the trademark monitoring charges, this service is optional and was presented during checkout, as well as during a complimentary 10-day trial period. You had the opportunity to opt out at either of those points, but since no opt-out request was received, the subscription automatically renewed in accordance with the terms of service.
That said, we acknowledge that one monitoring chargein Aprilwas billed in error after your order was canceled. We apologize for this mistake and have issued a refund for that charge. While the other charges were valid, we provided a courtesy refund for the ******* monitoring fee. We are unable to refund the October charge, as monitoring reports were delivered and the service was active during that period.
As for the $350 charge, that amount represented the ***** government filing fee. Because your application was not filed, we have issued a full refund of that fee.
In total, the following refunds have been issued to your original payment method:

Additionally, in my online account dashboard, it clearly states that Trademark Monitoring is free until 12/31/2024, which suggests that no billing would occur for monitoring services before that date.Nowhere did it state that charges would automatically begin afterwardor that I would be billed hundreds of dollars without my knowledge or explicit consent. This lack of transparency is unacceptable and misleading.Nature of the dispute:The company has repeatedly charged my account without my knowledge or approval for services I neither requested nor agreed to. This charge corresponds to the mandatory government filing fee required by the United States Patent and Trademark Office (USPTO) for your trademark application. This fee was disclosed throughout the checkout process and in our package descriptions. The application has since been successfully registered, and this fee was paid directly to the ***** on your behalf.
2. Trademark Monitoring Subscription $175 Charges
The charges on Dec 31, 2023; Dec 31, 2024; Mar 31, 2025; and Jun 30, 2025 relate to our Trademark Infringement Monitoring subscription service. This service was presented during checkout, and you were provided with an option to opt out.
A free trial period was included and extended through December 31, 2024, based on an updated subscription pricing model.
The subscription remained active without cancellation during or after the trial period.
Per our Terms of Service, we reserve the right to update pricing, and this was communicated as part of the subscription update.
Although these charges were valid, we have issued a courtesy refund for the most recent two charges of $175 each (March and June 2025), totaling $350.
3. Monitoring Fee $199 (Dec 31, 2023)
This charge reflects the original subscription rate for the trademark monitoring service prior to the updated pricing structure. This, too, was part of the subscription selected during checkout.

I purchased a copyright for a relatively high service fee which was alarming but necessary with ************* website dysfunctional. That was on June 9, 2025. Three days later I received notice of an additional $99.00 for what it calls "subscription to: copyright-privacy-annual-bt" on a statement I did not order nor was it an option to order. If "privacy subscription was part of the $184 original charge it isn't detailed in the invoice/statement - and if part of the original package should not be billed till next year. I did not order it.
