      Contractor was hired to repair the damage from a flood in our home. The mitigation had been done by another company that was unable to provide resources to repair the torn out areas. Contractor said that he specialized in insurance claims and would assist with documentation and communication of what needed to be done to the home to bring it back to "normal". The contractor was informed from day one that Nebraska Furniture Mart would be installing the new floors. Contractor did not itemize his invoice to show cost of projects, insisted on money up front for jobs not completed, failed to explain that some requested work would not be covered by the insurance and did the work prior to the explanation. Initially called multiple times stating and sometimes yelling that the project was going to cost $5000 more because I told him to tear out all the flooring and paint more than the insurance claim estimate. Then texted my husband and I at work that he wanted us to sign to pay him $7100

      Business Response /* (1000, 5, 2021/10/07) */ First of all, any company doing insurance work does not "itemize" an invoice of work being performed. We repair what the insurance company has agreed to pay for and provided a "scope" of such work. That is the itemization you had from beginning from your insurance provider, At no time ever did we request any money up front. As a matter of fact, we can provide documentation showing the start dates, and when we finally requested money needed to pay workers and materials, we were told that Nebraska Furniture Mart would be doing your floors per your request. You had us go in and remove "all" flooring in the whole house except the master bathroom closet. As far as not explaining, what was not being covered by insurance, we were very upfront about that. Remember the "scope " provided by insurance? It did not include painting all the walls in the house and ceilings as you wanted and thought they would. I thoroughly explained that, as well as your insurance adjuster. Then you left me a layout of your home, and the rooms you wanted painted. I explained my labor and material cost alone was over $5,000.00 and the charge would be $7123.63 because obviously I don't work for free. Your home is over 4,000 sq ft of living area, and that was actually a really good deal. You agreed over the phone and we sent the invoice. My workers showed up and started to paint the next week, and we realized you never signed the amended contract for such work. I began calling and texting you with no reply from either of you. So, I sent you a text I was pulling my workers until you signed the contract for added work. We did all our work in a timely fashion, staying way ahead of our target date, and you said our work looked absolutely great. Your insurance company allowed you around $12,000.00 for flooring and your quote from Nebraska Furniture Mart was over $21,000.00 I spoke with your adjuster Justin about it on your behalf, He said there was no way to get that pushed through as the numbers were so far off from his. I told him I had a great flooring guy that would blow NFM pricing away. He said if I could get it closer he might work with us. I called my flooring guy and sent him a text right after the call and have documentation showing I had him a huge job to bid on, and who the original bid was from. He assured me he would be way cheaper. Then I get a call from you saying you were letting me go because you talked to your adjuster 30 minutes later and he told you I never mention anything about flooring and I was a liar. I agree, I did raise my voice telling you to not be calling me a liar, as I had documentation. We run a great honest business, and it's funny you're my only complaint. You believe after I've done the lions share of the work that you will put money in your pocket. You're not to profit off of an insurance settlement. You are under contract for me to do my job, and I told you, firing me because you "think" I lied to you, does not warrant you firing us. I say, you let me finish what I started, and go our separate ways. And if not, let's let our lawyers straighten this out and then you'll pay far more than your wanting to when I provide all the documentation we have in our folder. You yelled at me more than once. I felt belittled and even more confused. You started work on September 16th with tearing out all the house flooring. You did not explain that tearing out all the flooring except the master bath and the undamaged bathroom upstairs was not on the scope. We now have to fund the recarpeting of all bedrooms in addition because they were not on the scope. You stated multiple times that you do insurance claims all the time and would deal with the insurance. Before you tore out the carpets and additional flooring you should have given us a bill and been upfront. Now I have had to do your job and study the scope in detail. I now have to pay for flooring in those rooms because it has been removed and thrown out. You billed us on September 24th for what you believed to be beyond the scope as " painting". Essentially you are stating that you should get all the money in the scope and an additional $7100. Yet the scope included replacing the flooring and multiple prep items to replace the flooring ie removing toilets. We terminated your service prior to painting the walls. The flooring was never your responsibility. Now it would seem that despite saying that you should be paid per the scope that you want more of the scope then the actual work done. That would not be a sign of integrity but of taking the money from the insurance to repair the parts of the home which you did not do. Please return our $6750 immediately. See attachments Business Response /* (4000, 9, 2021/10/11) */ You know we can go back and forth from now on, but we completed basically everything on our end of the contract except flooring, which we both agreed at start you wanted Nebraska to do. The facts speak for themselves, I'm going to to hire an attorney for slander of my business. You have admitted ******* you have PTSD and your own adjuster said you were not mentally stable. I have two witnesses on walk through who will testify of your husband saying "ALL" flooring goes in every room except the the master "closet". He said you were going to pay the difference, I have and provided the scan documents from 9/16/21 where he sent of what all the rooms would be floored with. Please provide any documentation as to telling me to "NOT" tear out any of other rooms. Again, you cant. Now, you want to act like we did something wrong. I'm pretty sure, you would have went bizerk if we had torn out something that we were not to have, and would have been told immediately about it. Me and My wife were told in person ******* and you went over it again on the phone that "ALL" were to be removed except for the master closet. That's why you had gotten a prior bid from Nebraska to replace "all" flooring. Also first payment received from you was on 09/28 $8055.34 and then again on 09/25 $3000.00, if there had been a problem before then why did you make payment? I stated that in one of my earlier attachments. It is not in question. However as the insurance "specialist" it would have been nice if Fossil Ridge Roofing and Construction told us prior to removing the flooring, what was not going to be covered by the insurance, and how much it was going to cost out of our pocket to remove it. They did not. I have included removal of all the floor in the expenses using the scope to come up with an amount within the scope and outside the scope. I still do not have an itemized receipt for the work that was done outside the scope so I did the best I could. It would also be beneficial to have one for what was done inside the scope. The only painting done by Fossil Ridge Roofing and construction was the damaged ceiling that is listed on the attached scope. Paint was purchased by them and again I included it in the list of things done outside of the scope. The paint was labeled by Home Depot and I was able to get online to check the price since Fossil Ridge Roofing and Construction has not provided an itemized receipt. To resolve the complaint I need an itemized invoice/receipt for the insurance. Refund of money from what was paid and not done. I have receipts for $3000 and $8066 but no itemization. It is obvious from the previous response from Fossil Ridge Roofing and Construction that they are upset about being fired. They prefer rhetoric to facts. It makes it very clear that the company does not respect me as a customer. However, I will not pay someone to yell at me on the phone and send texts during the workday about pulling out their workers and increased rates for painting($5000 to over $7000). It is time to settle for the work actually done in a financial means. The drywall of the ceiling(partial kitchen, living room and next to the stairs) and wall by the stairs was repaired. How much? The ceiling was texturized and painted. How much? Small area of Wall by the stairs texturized(none of the wall was painted). How much? The Carpet was removed. How much? The vinyl/linoleum was not effectively removed. How much? The base boards down stairs were removed. How much? Paint purchased. How much? The vanity was removed in the half bath. How much? The vanity in the damaged bathroom was removed but left in the game room upstairs. How much? One piece of base board was placed in the upstairs hallway. How much? Because Fossil Ridge Roofing and Construction stated that they do not itemize but " use the scope", I used the scope to come up with amounts done within and outside the scope. It revealed to my surprise that they owe us $6750. It took me over an hour but I attached it in the beginning of the complaint. If they are not in agreement then it would be useful for the company to submit an itemized invoice. Otherwise they were overpaid and should refund the excess money. If you study the scope only some of the work not most of the work was done. Flooring (always to have been done by Nebraska Furniture Mart) and painting(we decided to do this on our own do to the cost presented to us and finding out how little the insurance was going to cover) and many miscellaneous items were not done. However some items not on the scope were done. Some were clear that they were not on the scope, like removing the floor in the master bathroom and the undamaged bathroom upstairs. However, it was not brought to our attention until after the floors were removed that none of the bedrooms were on the scope except for the upstairs guest room referred to as blue. This has placed a further financial burden on us as we now have to pay to have the flooring replaced in all 5 of those rooms. The Contractor refuses to give me a receipt for what was actually done and states that the insurance sheet is his receipt. The insurance sheet shows that he did less than $5000 worth of work and the receipts show that he was paid $11,066. He is actually claiming we owe him $6000 more but refuses to give an itemized receipt. The $5000 includes more than the insurance. The Contractor claims he did most of the insurance claim but he did not. I can get signatures from my friends that painted the walls. 4 different families that came to our rescue. I have receipts from Nebraska Furniture that repaired all the floors. I may never see my $6000 but I do not want others to think that this company is good to work with. They did not follow the insurance recovery . They removed flooring without stating that it would not be covered by the claim. They offered to pain for $5000 but then texted that it would be $7100. We asked them to stop as we could not afford that or extra flooring that we had to get because it had already been removed. What did they show documentation of? I still don't have an itemized receipt. It is very deceptive to not put a price to the labor. It is deceptive to increase prices by $2100 without giving a bid. It is deceptive to do an insurance claim , do the work and not state what is being done is not part of the claim and will cost more money ie the flooring. What did he give you? I still have not heard from your office about what the arbitration is? Will it be helpful. How can you close this without answering my questions? Thank you, ******* ***** Sent from Mail for Windows Business Response /* (4000, 28, 2021/12/07) */ Again, we have provided all documentation to prove we did exactly what was asked of Fossil Ridge Roofing and construction, I have attached the receipt that was signed by Mr ***** and I have attached a contingency form that Mr ***** singed stating any extra money from insurance would come to Fossil Ridge Roofing and Construction, they also knew the insurance was NOT paying for every room to be re-floored unless approved by insurance, we have 4 witness's that heard Mr ***** say what was to be removed. We where working with the adjuster to help them get all flooring covered and then they decided they no longer wanted our services. All work was completed except for the extra painting they wanted. We verbally told them our guys are charging $5000.00 for the extra paint but of course that is for labor and materials only this did not include our charge for overseeing the job. This will be our last response, as we have contacted our attorney in regards to this matter. I have attached copy of invoice from Nebraska Furniture Mart that shows they where looking at replacing all flooring before hired.. He Specifically said "Remove all flooring except Master Bedroom Closet" and that's exactly what was done. See Attached bid on 09/14/2021 for 5621 sq ft of flooring,your home is 3770 sq ft. This bid was gotten before you hired Fossil Ridge Roofing and Construction. The flooring was always to be done by Nebraska Furniture and this was communicated. We did not know that the bedroom flooring was not going to be covered until the flooring was removed by Fossil roofing. Fossil roofing did not notify us that it was not part of the coverage. They did however notify us about the painting and that they would not repair all of the ceiling that was buckled. They felt it was not damaged. Why they communicated these things but not that the bedroom flooring would not be covered I don't know. The only invoice is a blanket invoice that does not show detail. The only thing done by Fossil roofing was to repair the ceiling and small amount of dry wall by the stairs and pull all the flooring around $5000 worth of work. They had requested and were paid $11066. When they requested more I started investigating and found out myself that they had already overcharged for what had been done and were trying to claim our money for the flooring that we needed to pay Nebraska furniture. We never asked them to replace the flooring only to remove it. After I found out about the over charging and they were asking for more money I no longer trusted the contractor. The company owes us $6000. The bottom line is they should reimburse us the $6000 and except that they only did the $5000 worth of work. It is more than fair payment. However they want to get paid for work that they did not do. Our friends helped us paint the house and Nebraska Furniture installed the flooring as planned. My husband is still putting all the bathrooms and other miscellaneous items back together. I am still unpacking boxes. I have receipts for the mover, storage, flooring and I can get signatures from our friends that painted our house. Also the claims adjuster is aware of everything that happened. Pay us the $6000 and the complaint will go away.
