I contacted Credence Resource Management, LLC, about a debt they claimed I owed from ************. The debt did not line up with my address, the timeline or anything that I had ever seen. They put the debt and collection on my credit report. The amount in question was $318.85 to Dish Network. I have exceptional credit and having this show on my credit report was not acceptable. I asked Credence Resource Management, LLC to show a copy of the debt, Credence Resource Management, LLC showed me something that looked like an invoice but was extremely vague. I decided it was better to pay it in full and be done with these people so I did that on Nov 16, 2024. I am going to upload the proof of payment. The issue is this debt continues to show on my credit report and the company will not file correctly to the major credit bureaus and show that the debt has been paid. I continue to email them to ask why they are not reporting correctly and I am getting stone walled. I keep getting boiler plate emails telling me they are looking into things. I did my part and paid this debt in full. They should be held to report correctly to the credit bureaus and thy are not doing this.

    Dear BBB Dispute Resolution Department,

I am writing to address the response from Credence Resource Management LLC (CRM) regarding my complaint submitted on December 25, 2024. I appreciate the opportunity to provide additional details and seek a fair resolution.

Upon reviewing CRM's response, I still contend that there are significant issues with the handling of my account, specifically concerning the Fair Debt Collection Practices Act (FDCPA) and the Fair Credit Reporting Act (FCRA).

    1. Violation of the ****** I did not receive any validation notice from CRM within the required 30-day period. According to 15 U.S.C. 1692g, a debt collector must provide a written notice containing the amount of the debt and the name of the creditor within five days of initial communication. *** has failed to provide adequate proof that such a notice was sent or received.

    2. Improper Reporting under ****: The account was reported to credit bureaus without proper validation and while under dispute. Under 15 U.S.C. 1681s-2(a)(8), furnishers of information to consumer reporting agencies must conduct an investigation upon receiving notice of a dispute. ***'s actions to report this account without resolving the dispute infringe on my rights under the *****

    3. Lack of Proper Documentation: Despite requests, CRM has not provided sufficient documentation from AT&T Mobility to verify the legitimacy of this debt. Without this documentation, I am unable to confirm the accuracy of the reported balance or even confirm that this debt is mine.

Based on these violations, I request that *** immediately cease collection efforts and remove any negative reporting related to this account from my credit reports. The failure to adhere to legal obligations has caused undue stress and damage to my creditworthiness.

I trust that BBB will assist in ensuring that CRM rectifies these issues promptly. I am also prepared to escalate this matter further, including filing complaints with the ************************************ and other relevant authorities if necessary.

Thank you for your attention to this matter.

I am rejecting this response because:
In response to the latest communication from Credence Resource Management (CRM), concerning the disputed debt reported on my credit report. I would like to address several critical points and formally provide a final warning.

Violation of the Fair Debt Collection Practices Act (FDCPA): As per 15 U.S.C. 1692g, a debt collector must send a written notice containing the amount of the debt and the name of the creditor within five days of initial communication. Despite ***'s claims, I have not received such notice, nor have you provided verifiable evidence that this was sent or received.

Inaccurate Reporting under the Fair Credit Reporting Act (FCRA): According to 15 U.S.C. 1681s-2(a)(8), furnishers of information to consumer reporting agencies are required to conduct a thorough investigation upon receiving notice of a dispute. The reporting of this account without resolving my dispute constitutes an infringement on my rights under the *****

Failure to Provide Adequate Documentation: The documents purportedly sent to me, have not been received. Without valid documentation from AT&T Mobility verifying the legitimacy of this debt, CRM's actions remain unsupported and unsubstantiated.

    Final Demand:
Given the violations outlined above, I am requesting that CRM immediately cease all collection activities and remove any negative reporting from my credit reports with ********** and Experian and all. Failure to comply with this request will result in further legal action.

If this matter is not resolved satisfactorily within 15 days of receipt of this communication, I intend to pursue all available legal remedies. This includes filing complaints with the ************************************ (****) and potential litigation for non-compliance with both FDCPA and FCRA standards.

This letter serves as a final notice of my intention to escalate this matter if corrective action is not taken immediately.

I trust that this issue will be resolved promptly to avoid further legal complications.

I am not liable for this debt with CREDENCE RESOURCE MANAGEMENT. I do not have a contract with this company and they did not provide me with a contract as requested. They do not have any proof that I owe them any money. I was told by CREDENCE RESOURCE MANAGEMENT that the original debt was owed to ************* but I have contacted **** both in person as well as over the phone and they have assured me that I am not in debt with them. This collection agency has been trying to scam me by telling me if I settle this with them they can take it off my credit report and I can pay them less than what is owed.

I am not liable for this debt with AT&T. I do not have a contract with Credence Resource Management and they did not provide me with the original contract as requested. They do not even have my name spelled correctly on their report and when I talked to AT&T over the phone and in person they assured me that I am not in debt with them. I called Credence and they tried to persuade me to pay less money with them to get this taken off of my credit report. I have called them three different times to ask for proof of contract or debt and they tell me to go look at the one email they sent me last year that when I click it spams my computer.
