We purchased our new home on July 28, 2023. As shown in the text message records, we first reported HVAC issues about a month later. RP Homes repeatedly delayed sending someone to check on it, blaming the providers and postponing a proper resolution.

During Summer 2024, the issues continued. Once again, service was delayed, and a provider did not come until late October, by then, the weather was already cooler, so we could not confirm whether the AC was truly working.

Now, in our third summer in this home, the AC still will not cool below 76 degrees. RP Homes is claiming the system is out of warranty, yet this issue was reported multiple times over the past two years and was never properly fixed.

I am sending just some sample of text messages and emails exchanged, but I have many more records from all. my attempts to hold them accountable for the issue without sucess.

    We
sincerely apologize for the frustration this situation has caused and
appreciate the opportunity to address your concerns. We understand how
important it is that your home is comfortable, and we regret that you have
continued to experience challenges with your HVAC system.

    Since your
initial report, our team and trade partners have completed multiple inspections
and repairs, including ductwork repairs, unit leveling, vent adjustments,
damper replacements, and rebalancing work. Based on those efforts, the system
was determined to be functioning according to manufacturer standards, and your
warranty ticket was formally closed in February 2025. As we communicated at
that time, the one-year labor warranty on your home expired in July 2024.
However, your HVAC equipment remains covered under the manufacturer’s parts
warranty, which is administered through the installing contractor, ** ******* * ***. We encourage you to contact ** directly so that any parts concerns
can be addressed under that coverage.
    That said,
we want to continue supporting you in good faith. To further evaluate your
concerns, one of our managing partners personally visited your home on August
21, 2025. During that visit, the thermostat and temperature readings were
aligned; however, you shared that you experience a temperature discrepancy in
the afternoons and evenings. We understand how disruptive this can feel and
want to ensure that every possible factor is reviewed.

    As part of
our continued commitment, we are arranging for a licensed HVAC company to
return to your home to determine if there are any additional issues that need
    to be addressed.

    We
appreciate your patience throughout this process and want to assure you that RP
Communities has acted diligently and remains committed to working with you
toward a resolution within the framework of your available warranties.

    Complaint: ********

I am rejecting this response because: the HVAC techinician came this week and said that everything is ok with the HVAC system. Meanwhile, the same floorplan in the neighborhood can reach 70 degrees during hot days, while we can't get any lower than 76.

    Sincerely,

Thank you for your follow-up and for sharing your concerns. While recent testing indicated that your HVAC system was functioning as designed (see attached report), we want to make sure nothing is overlooked. To that end, RP Communities has scheduled an additional independent HVAC company to evaluate your system. Our team is working directly with you to coordinate this visit, and we will carefully review the results once they are available. We truly appreciate your patience and want to assure you that RP Communities remains committed to working with you in good faith toward a resolution.
