      We hired Anthony & Sylvan Pools to completely renovate our inground pool. The crew accidentally filled one of the holes for our ladder and one of the holes for our safety cover with cement. My husband has contacted them multiple times to come back and fix the error and they have continually said that they will and then failed to respond further or schedule a time to return to fix the error.

      Anthony and Sylvan contractors did not properly install silt fencing on my neighbors property. The poor work caused the inundation of my drainage system with silt and muddy water that caused backup of the system. The silt fence barrier failed and was not addressed by the contractor. Silt and debris moved to my property causing damage that needs to be addredssed.

      The unresolved issue is a complaint I raised to the general manager JR ******** originally on September 13. I raised the concern that at the end of the season I measured my pool and it was much smaller than my contract stated. I simply asked him back then to have someone come out and measure so that he can tell me if I got what I paid for. Responses were sporadic. By this I mean we would correspond regularly for a couple of days and then I wouldn't hear from him for a couple of weeks and then I would follow up and this would all happen again. My last correspondence was November 16 and I never received a response. After 3 weeks I went to Linked in and found ****** **** who is an executive assistant and explained everything to her on December 5 and did not receive a response. On December 13 I reached out to CEO ****** ***** and have not received a response. Comes down to I complained about the intial size before the pool was dug. Was assured it would be according to contract. I measured it again in late August and it was not as promised. I received some compensation toward concrete but not as promised by the addendum. All I wish is to be compensated for what was paid and not received per my contract and addendum. The sticking point is Mr. ******** was under the impression that I was compensated fairly but I was not and to this point I cannot get a response from anyone so that I can work this out. This could have been easier as well if a breakdown receipt was given. I pay 78k and all you get is a bottom line number and no breakdown of what everything costs. I have submitted the contract, addendum, and concrete receipt to them previously and will do so again if requested.

      This is the only thing that has happened since my complaint. I have shown a snip of the contract to support my claim. I he reached out to me on January 13 and I responded on the 14th and have not heard anything else.

      I apologize for not responding to this sooner. While I empathize with your wanting to make sure that you were charged fairly, I will again stress that to the best of my ability, I do not see anywhere on contract that you were over charged or not credited in a fashion that is in line with what would have been charged for the pool project that was built. As you know, I came in to this scenario late and I fear that in my efforts to assist you I might have caused more confusion by misunderstanding the addendum that you and **** agreed to at the time.

      I have no knowledge of the document you produced here. Was that for off contract deck work with **** ****? I cannot speak to that, only what work was performed contractually with A&S. If you increased the scope of work and were charged an amount beyond what you agreed to with the contractor, I would ask that you get clarity from them. As for as I can see, the work that was performed and credited by A&S is in line with the scope that you were charged and credited.

      Good morning and thank you for responding. I do not know you personally and you do not know me. I am not looking to take anything from your company that I have not paid for and I would not be so persistent about something if I did not feel wronged. I am an honest person just trying to make things right.  I started this whole thing in September because I honestly felt lied to by my salesperson. I wanted to get clarification from you to make sure that I actually got what I paid for. No more and no less. When ***** gave us the sales presentation he told us that the pool would be under the 18x40 ft but would be 17.6x42.3 feet. I felt that 6 inches would not make a big difference especially since we are gaining 2 feet in length. During the meet and greet when ***** put up the flags I thought it looked small so I measured at that time and I contacted ***** that night to let him know my concerns and he assured me that I would get what I was promised. I cannot read schematics so this whole time I thought I was getting the 17.6x42.3 that was promised. **** did contact me after the pool was dug and the **** bar was placed to let me know their findings that a small part of the pool was off and after a lot of negotiating we agreed to $2250 to be put as a credit toward extra concrete that I was going to have done. It wasn't until August when I went out and measured the whole pool again to find out that the average size was closer 13.6x40. I do understand that because of the shape it would not perfectly be the exact size the whole length but to be 4ft off and at some points more is a big discrepancy. If he would have told me this up front I would have gone with a more traditional shape to get the most out of it. I do not see why we are in such a disagreement about this. When you are promised 17.6x42.3 and you get 13.6x40 wouldn't you question this? My last couple of times talking to you I got the impression that you were told that I received more than what I did. I want to tell you up front that all I received as of right now was $2250 credit toward extra concrete. That is all I received. I know at this point it is not like we can redo it but I want you to put yourself in my shoes. I was promised one thing and I have done everything I was asked to do. I contacted you to clear it up and I professionally talk to you about my concerns. I am not trying to deceive you or get something I did not pay for. Please look at all of this with that in mind and let me know what you find.

      After identifying a variance between the excavation and rebar and pool plan, A&S offered to correct the work or provide a credit. The customer accepted a credit/additional decking/retaining wall via addendum, in lieu of rework. The customer executed the addendum, A&S provided the decking/retaining wall and the pool project is complete. We consider this matter resolved.

      I am rejecting this response because: I agreed with them for a small portion that they said was off for $2250. They did not tell me that the majority of the width of the pool was off by almost 4ft and the length was shortened by 2 feet. In our formal addendum that is attached. I sent all of this to Mr. ******** and he would never see what I was saying. According to the addendum from them it says that they will pay 950 square feet of the extra concrete and pay for the retaining wall. I attached the **** from the cement company as well. So according to the agreed formal addendum they should have paid $9976 (950 sq ft x $10.50 sq foot) and paid for the retaining wall which was $4500. As you can see with the addendum it says "add" extra concrete which means it is not the concrete included in the original contract. So all together the **** was $10500. They paid $2250 which left a balance of $8250 which was my responsibility. I received a $500 discount for paying cash so I paid $7750 out of pocket.  According to their addendum I should have only paid $756 out of pocket (the extra 72 sq ft x $10.50 sq ft) because the **** said the entire project was 972 sq feet for the concrete.. SO if you take the $7750 and subtract the $756 that I was supposed to pay according to the addendum they owe me $6994. This is according to their own addendum that is attached that was never fulfilled as promised. If they pay this then I will be satisfied that they met their promise. Even if they are willing to negotiate I am willing to compromise but to say they met every obligation and promise and continue to push me off as if I am trying to cheat them is not appropriate.

      Your decision is unfortunate. They did not honor their addendum and lied about it. I was hoping that you would act as a mediator about this and see the facts as presented and paint them a clear picture or even tell me if I am seeing it wrong. Instead all they have to do is lie to you and that is enough. I was hoping that you could resolve this so I did not have to take legal action against them but for this amount of money I feel that is the only logical next step.

      In Nov 2023 the pool process was started. However the process was not what was expected and promised. At the start I was told to **** sprinkler heads and they could work around them on the day of construction I informed the workers and they informed me we break sprinklers didn't even attempt to avoid them. The entire process was beyond miserable drain was not correct so nothing but dirt got dumped in the pool during the construction process and it took 4 months for that to be somewhat handled by AS. Pool plaster has holes thru out the pool and I informed them yet was informed that's how it was. Have tool marks in the plaster also never was repaired. Bubblers and waterfalls have been not running correctly since all the dirt was ran off in the pool do to poor draining. And all this was reported within the construction process. Went thru 2 project managers was promised multiple correction and yet nothing but getting pushed aside. The picture attached with the dirt running off I sent it to the project manager at that time and the only response was you look mad. Therefore the money that was spent and what you are promised do not match up. Unacceptable business practices I will have to get another company to come in and repair what was not taken care of and go to the next level. Again see pictures below all the proof that's needed is attached.

      This complaint has been reviewed by A&S, at this time there are no open work order or warranty items that need to be addressed. On 9/6/2024 the drainage issue was resolved by adding additional drainage on the edge of the concrete decking. On 8/9/2024 the plaster was inspected and found to be in good condition and an explanation was given as to why the pool surface should not be judged at night under artificial light. On 8/6/2024 New filter elements were left on site to replace existing filters that may have been damaged due to drainage issue. A&S will be happy to assist in any new claims or warranty issue that may arise.

      I am rejecting this response because: There was issues with the plaster and the waterfalls and bubblers from the start. Therefore, I've informed all PMs of the situation there after your company sent and individual out to inspect and aggreged having holes in the blaster and tool marks also in the plaster was not acceptable. Also, bubbler and waterfall issues. Months later after a team came out and drained the entire pool and grinded the entire pool down and yet didn't resolve anything, and I still flipped the cost to refill the pool and add more chemicals. Overall poor workmanship on all levels nothing but issues. Everything is subcontracted out.

      As previously stated in our response, A&S has no current open work order or warranty items still pending for our customer. Our most recent work order regarding the customers plaster concerns was completed on November 11th, 2024. Customer had remaining concerns following plaster repairs made in August 2024, and an explanation was given as to why the pool surface met industry standards. Per the ************************, the standard is that a cementitious underwater product shall not be judge under artificial light, nor at night. Following these discussions, A&S considered the matter resolved, as we received no further warranty claims relating to the customers pool for the remainder of 2024.

      Additionally, A&S had addressed other concerns in 2024: On 8/6/2024, new filter elements were dropped off at the customers home to replace existing elements that may have been damaged by drainage concerns, at no additional costs to the customer, as positive customer relations. Lastly, on 9/6/2024 the drainage issue previously mentioned, was resolved through the addition of a catch basin on the edge of the concrete decking.

      A&S has, and continues, to operate in good faith, and stands behind its warranties, as stated in the contract. A&S encourages ******** to contact us, or file a new warranty claim, and we will be happy to assist. At this time, A&S considers the above matters resolved.

      Anthony Sylvan Pools, with a local office at ************************************************ sent subcontractors to build an inground swimming pool in my backyard. I advised the company representatives on multiple occasions to not drive trucks over the west side of along the old fence line due to underground septic lines, and to please access the new pool area from the south side of the property. My requests were not honored, and then my system did fail and was leaking sewage. A professional soil test was first required ($828.00) and ************* was involved. Subsequently had to have 1 septic line dug up and capped in addition to having also another new line installed ($4848.98). Their contractors' tractors also ran over the roots of a huge, mature gum tree also located on the west side and within 1-2 months the tree died. The dead tree was a huge safety hazard and I had to have this tree removed ($2,425.00). When I contacted their Marietta pool office, I was told that my septic lines must have been originally improperly buried because the trucks should not have caused any damage. The septic company that did the repairs documented the cause of the damage as did the tree removal company. I sent the *********************************************** corporate office in ************************************** a certified letter of concern on August 27, 2024 with copies of all supporting documentation and requested reimbursement for my unexpected out-of-pocket expenses for the harm done to my property. The amount I had to pay to fix the damage by the pool company is $8,101.98. To date I have not received any reply whatsoever.

      I ordered an exact replacement pool cover for my pool. The one prior lasted over 20+ years and this was exact replacement from the same manufacturer. The company came and installed the cover and the cover was not removed after they installed. Less than 3 months later the material started to tear. Company was contacted but refused to address the issue.

      On August 14th 2024, I filed a warranty repair for my swimming pool with Anthony & Sylvan Pools located in *************************. To date Anthony & Sylvan Pools has been evasive in repairing my pool and responding to my text messages. They did send repair people my home but it is unclear what repair were done and the repair people showed up to my home unannounced while I was out of state. Anthony & Sylvan Pools has a history in selling pools and not completing warranty work. I would like to the repairs made to my pool as soon as possible.

      I decided not to further my process in having a pool install by Anthony and Sylvan. I was told to receive my deposit refund it has to be reviewed and I would receive payment. Approximately a month has passed and still no word as to a refund.

      It took 8 months and an attorney! My dig date was November 2023 and after 8 months, still not complete. The project management was beyond poor and workmanship even worse. Waterline tile was installed with no grout. Coping had to be redone twice due to wrong size, uneven cutting, incorrect grout color and the wrong stone finish. When given the opportunity to **** and reselect, it took nearly 8 weeks to resume the work even though the supplies were in stock with the ********* lower deck was not installed according to the contracted plans. The surrounding deck is uneven with trip hazards. Several coping pieces were severely chipped at installation and when replaced, the colors did not match. Project managers are never here to direct the trades.Trades did not show up when scheduled and no one from A&S would even call. They work unsupervised and project managers do not come out to inspect their work. Instead, it was left up to me to report problems. No one ever calls to ask how things are going. They simply do not care.A pre-plaster punch list was compiled but never completed but they rushed to get the pool filled because they knew 7 months was completely unacceptable for this project. My pool is only 10x10, tiny.The manager tried to silence me from going public but it is important to me that their shady practices and shoddy work be exposed. No one should have to experience this. I missed the entire summer and swim season on a project that began before Thanksgiving the prior year. Now almost a year later and I still do not have a completed project.I escalated to corporate and never even received the courtesy or a call or email in return. Their in-house attorney is clueless and will cause this to go to litigation.

      Anthony & Sylvan is aware of the Customers complaint and has been engaged in communication with both them, and their legal counsel. In August 2023, A&S and Customer entered into a New Pool Construction Agreement.  On March 13, 2024, and May 6, 2024, two addenda were agreed to between Customer and A&S, changing the scope of work under the Construction Agreement. Construction of the inground swimming pool was subsequently completed on June 13, 2024.  On August 13, 2024, A&S received a letter from Customers attorney regarding alleged issues with the Project. On September 18, 2024, A&S responded to the Demand Letter and provided an offer to resolve the Customers complaint.  To date, A&S has not received a response from Customers attorney regarding the offer presented.

      We paid Anthony Sylvan a $5,000 deposit on July 9, 2024. First, we had our meeting after paying the deposit, they finally met with us about 17 days later to look over the back yard. The experience was not good, it was all about what they were not doing, not responsible for, they threw the pool accessories on the ground and we had to pick out with no additional view of how it would look - just say presentation was horrible. After they left, we attempted to get status for weeks with no response, not even a quick no update. No work at all has been performed. If we were not getting responses on just a simple status update and we only paid a deposit, met once and had no other interaction how the next few months or more were going to go. My husband was still feeling some kind of way from the initial meeting. We finally decided based on the experience to date that we were not very comfortable with the lack of communication and sent an email that we would like to cancel late August. 5 mins later we get an email back that permits were just approved and the office should have notified us. We never received anything. From there crickets. I went to the permits building to inquire and they said the permits were still in review and not approved. So here Anthony Sylvan says they are approved but the county is saying they are not so now we felt we were being lied to. We are not happy, not comfortable, and feel the experience has been not good to date. We have been attempting to get a hold of Anthony Sylvan since end of August to get our deposit back minus any administrative fees with absolutely no response. We have even sent a certified letter back on Aug 30.

      A&S General Manager, ** ********* first contacted Ms. ****** on November 1st regarding her concerns with the sales cancellation process. ** answered those questions and remained a point of contact and resource for Ms. ****** in the following weeks. A&S confirms that they have received and finalized the cancellation notice from our customer and is in the process of cutting a refund check for the deposit amount of $5000. We expect this to be delivered to the customer within the next 2 weeks.
