    We purchased dinnerware from Temp-Tations, LLC in April, 2021, for our personal use. The company provides a three-year limited warranty for its dinnerware. The warranty represents and promises that "Should your product prove to be defective after the applicable return period . . . and during the warranty period, we will have the option to repair or replace your product at no charge." The warranty language does not limit Temp-Tations obligation to what they have available. In March of this year (2023), one of the dinner plates cracked while being washed in a dishwasher. This is normal use for dinnerware. We contacted Temp-Tations to request a replacement, but they could not replace the plate, despite their warranty. They claim that the color and style are no longer available. They only offered other colors and styles, including a square dinner plate (our set is round). They also refused to notify us if and when a suitable replacement would be available. The warranty promises that a defective product will be replaced. A different color or style is not a replacement. We have found a suitable replacement plate through another company at a cost of $29.99 (plus shipping). The company refused to reimburse us for that, even though doing so honor their warranty.

    Customer service is rude and condescending. One of our Temp-Tations plates broke while washing. (normal wear and tear). Since it was within the 3-year warranty, we contacted the company to replace the plate. They refused, claiming that they will only replace a plate if they have a plate to replace it with. They did not have our color and style. They offered a different color, which is not acceptable, nor does it comply with their so-called warranty, which states that Temp-Tations has "the option to repair or replace [the] product at no charge." A replacement plate is available through another company, but they will not purchase it or reimburse us for the purchase. Temp-tations also refuses to accept that we are making a warranty claim within the warranty period. They maintain that a claim is not effective until they choose to honor it. So, if the three-year period expires, they will no longer honor their warranty, even though the defect was discovered and reported within three years of purchase. This makes their so-called warranty an unconscionable contract, because they are choosing when and how it can be performed. This is a violation of state and federal consumer protection laws, and they should be penalized. Furthermore, their customer service people (including supervisors) are extremely rude and unwilling to help.
