On February 22, 2023, the Pennsylvania Attorney General’s Bureau of Consumer Protection (BCP) announced it had entered into a settlement agreement with Eagle Disposal of PA, Inc., for alleged violations of Pennsylvania’s Unfair Trade Practice and Consumer Protection Law. Specifically, the Assurance of Voluntary Compliance (AVC) settled allegations that alleged the company failed to collect trash and recycling from over 1,800 residential subscription customers for multiple weeks at a time in 2021.
As part of the settlement, the company has agreed to refund payments for any missed collections for Pennsylvania consumers who subscribed to residential trash and recycling services as of January 1, 2021, and have yet to receive a refund. The company has also agreed to provide its customers with the option of receiving an email, text message, or phone call when trash or recycling collection times are delayed and clearly disclose to all consumers that its recycling services are either included in the quarterly price or available at an additional cost. The settlement also requires the company to pay a total of $45,000.00 in civil penalties, restitution, and costs of the investigation.
