    Commonwealth financial systems is reporting a debt to credit bureaus which is incorrect and is no fault of my own and instead a result of original creditor (** ********* ********** ****) This hinders me as a consumer and causes me undo hardship as a resident of Pennsylvania.     What must be on file prior to billing a ******** patient for non covered services?
    This notice is called an Advance Beneficiary Notice of Non-coverage, or ABN

    ******** requires an ABN be signed by the patient prior to beginning the procedure before you can bill the patient for a service ******** denies as investigational or not medically necessary. Otherwise, ******** assumes the patient did not know and prohibits the patient from being liable for the service

Please be advised, the FCRA compliance date for credit reporting is 7 years from the date of service or date of first delinquency. The service date, used for FCRA purposes, is 08/21/2018, making the account eligible within the credit reporting time limit. In regard to the statute of limitations, the statute applies to the maximum time legal proceedings can be initiated to collect on a debt. Commonwealth Financial Systems, Inc.  does not bring legal action against consumers.

    The insurance information submitted as an attachment with said complaint was forwarded to the current creditor for review, and the account was put on hold as we waited for instruction in regard to the account. We have since been advised by the current creditor to close the account in question. A deletion request, to remove the tradelines from credit reporting, has been submitted to the three major credit bureaus. We hope this addresses all concerns on the part of the consumer.     This complaint regards charged off accounts from medical centers that were purchased by CWFS. Not only are these accounts being sold thru multiple collection agencies, but each time balances are changing on accounts I have no known knowledge of! Not only does this violates my rights, but it’s illegal to continuously sell a debt and then try to retrieve it. Also, the media is being transferred electronically without my consent that contains my social, address, and birthday which violates major rights under the FCRA. I demanded a ceast and desist verbally which has been declined because I am still receiving multiple calls a day about multiple debts that’s I’ve disputed and CWFS seems to have found accuracy of the debt. Furthermore, under the Pa.RE 803(6), 902(11), and 902 (12) are being violated! They have failed to provide me with an authenticated contract regarding direct business that I supposedly had with this medical debt collection office! Also relevant to this matter the “ Uniform Business Records as Evidence Act has been totally overlooked! This is a recurring issue with CWFS and I have forward this same complaint to a debt collector attorney! I am demanding all 4 accounts to be returned back to the original company, closing all future business and all 4 derogatory marks to be removed off of my credit immediately! I am prepared to take further action.

Please be advised, Commonwealth Financial Systems, Inc. is third-party collection agency that services accounts on behalf of our clients. We do not originate the accounts we service, nor do we engage in debt buying. The referenced accounts are the result of emergency physicians services provided by *** ********* ********* ****** ****. The physicians group, who bills separately from the hospital, sold/charged off the original debts to our client after they became seriously past due and were placed with our office as unresolved debts.
    In compliance with Regulation F, prior to credit reporting, Electronic notification of the debts were sent to consumer. This letter provided the original creditor, name of the current creditor to whom the debt is owed, the amount of debt, and all other disclosures as required by the Fair Debt Collections Practices Act (FDCPA) and applicable State law. 

    I personally conducted a full file review which included all records, notes, and documents associated with the files and found no evidence to support consumer's claim that our office made frequent calls after being told to stop contacting. Our records found no direct contact with consumer. Also we have rules in place that limit the frequency of calls that can be made to an account as well as limits on manual outbound calls. A review of the files found Commonwealth Financial Systems Inc. acted in compliance with the credit reporting requirements imposed by Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA).

    As per consumer's request, we will cease and desist collection activity in relation to the debts and return them to our client, informing them Commonwealth Financial Systems will no longer be servicing the accounts. A deletion request will be sent to the 3 major credit reporting agencies for the tradeline(s) to be removed from credit reporting.     The referenced account is a medical debt that originated with *** ** *********,LTD for services provided on 01/06/2017. Our records indicate, in compliance with Regulation F, prior to credit reporting we sent consumer notification of the debt on 09/05/23 via electronic communication. We then monitored the account for a minimum of 14 days to allow for notice of deliverability issues with that address. After 14 days, when no undeliverability notice was received, the account was sent to be credit reported.

    Per call recording review on 10/13/2023 **************** spoke with our agent to inquire about the referenced collection account. He was provided account details as well as informed an itemized bill would be mailed out to his address. Please be advised, a billing statement was provided by the current creditor and has been forwarded to consumer on 10/24/2023.     I received a notice that I have a collection from COMMONWEALTH FINANCIAL on my credit report. It says it was opened on 8/1/2023 for $645 with account number starting in ************ that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the FCRA and FDCPA.I would like for this collection to be removed ASAP or I will file a CFPB and FTC report.

    Dear Sir/Madam...it is my understanding that the following applies, according to the FDCPA; "§ 809. Validation of debts (a) Notice of debt; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing— (1) the amount of the debt; (2) the name of the creditor to whom the debt is owed; (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector; (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such 15 USC 1692g 12 § 809 15 USC 1692g verification or judgment will be mailed to the consumer by the debt collector; and (5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

    We received NO SUCH notification from either party.  We were in the process of applying for a mortgage re-fi, when we noticed that our credit had been flagged.  As I stated in my complaint, I have no agreement, whether verbal or contractual, with the debt collection agency mentioned.  I have sent CERTIFIED MAIL request, based on this same complaint, that they immediately VERIFY the origin or the alleged debt and PROOF that my signed contract with the debt collector be verified.  I can certainly provide that information to the BBB.  As to whether the debt collector or the originator of the alleged debt is in violation of the FDCPA, in NOT notifying us, I will have to leave that to your findings.  I am happy to drop this complaint should the debt collector either 1. provide me with a copy of my signed contract with them OR 2. a verifiable notification that we did, in fact, receive the required notification as stated above.  ***********************

    the dates show a recent charge, I do not owe rhis debt I have asked for proof of charges and credit. I have been involved in identity theft by my ex husband and have tried to resolve this. dates and charges are all inaccurate. I would like for them to show the dates of charges and any documents signed. furthermore if the dates are inaccurate I would like them deleted as I have been requesting documents for over 7 years

We service accounts on behalf of our clients with whom we share a contract and who has purchased the account from the original creditor. The original creditor has a right to sell/charge-off accounts after they become seriously past due. While the consumer did not create the debts with the collection agency, the original creditor has sold/charged off the original debts to our client who then assigned them to our office for collection. This is what gives the collection agency the ability to collect for an outstanding debts.
