Damns Auto sold us a piece of crap car with no airbags (did not disclose ) which is illegal according to OIC 4549.20. Hid issues like a bad engine(someone put Bars leak and repair shop had to flush it 3 times to get it out, and discovered the black is cracked which explain why so much bars leak, bad heater core, no wiring harness., etc. They reset light prior to us buying and sold it saying it only needed a new fog light. This car has been in the shops for 4 months out of the 6 months owned. Car is not drivable.

Mr ***** did not buy a warranty with the vehicle. It was sold as is. As far as the airbags. The light was never on when we inspected it. We offered Mr. ***** to bring it back up here for our mechanic to look at it. So whenever hed like hes more than welcome for our mechanic to inspect the vehicle.

    Thanks,

    Adam

May 7th I purchased a 2013 bmw 328i from DAMS auto. It was purchased in cash for a little over $8700. I was told the vehicle was new, in great condition, been maintained. Within the 2 weeks of having the car I reached out to the dealer to ask about when I would receive the title. While I was purchasing the car I was told it would arrive within a week. 2 weeks after having the car the engine went into emergency mode. I had it towed to bmw of Willoughby hills who told me that the vehicle has not been maintained, and resulted in needing over $10,000 worth of work due to pieces in the engine that had been missing, faulty solenoids, and a poor conditioned oil pan. I have been told by the legal aid society that if I do not receive the title after 40 days I have the legal right to return the vehicle and be reimbursed. 42 days after purchasing the vehicle and not receiving the title I had the vehicle towed back to DAMS auto. The sales representative was extremely confrontational and threatened to impound the vehicle at my expense and I was not allowed to bring it back. I have spoken to my insurance agent ***** ******* who notified be as of day 41 of not having a title to the bmw, that according to the dmv I do not have a registered title in my name to the bmw I purchased from dams auto. I would like to be reimbursed for the vehicle. It is unethical and concerning that there are men who sell faulty cars.

Attached is a copy of the title issued to Mrs. & ******. AS-IS Forms.  As far as the condition of the vehicle. Nobody would promise a customer that a 15 year old BMW with 130,000 miles on it runs and drives like a new car,. Vehicle was sold AS-IS without a warranty. Extended warranty to mrs. ****** was offered, which she declined. Unfortunately we will not be able to return the vehicle or issue a refund. We can assist mrs. ****** by taking the vehicle to one of our mechanics and see if we can save $$$ by fixing it through us, instead of going to a BMW dealer (they tend to be wayyyyy more expensive)

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Dams auto stated that the vehicle they sold me is a 2008. I was under the impression that it is a 2013. I have not received the title to the car after 40 days I have the right to return the vehicle to the dealer and get a refund.

    Regards,

DAMS auto failed to send me the title after 40 days allowing me my legal right to return the vehicle and be reimbursed. When speaking to Attorney General they notified me that after 45 days the title was put in my name which is 5 days late.

Purchased a 2004 ****** ****** from DAMS Auto on 10/6/22 for $10,900 + service contract of $1220. Car was advertised on ** ****** ***** & description said "zero issues". Before buying, texted salesperson, Marin ***** about condition of car. Mr. ***** stated in writing "this vehicle is still available runs & drives great zero issues." Test drove car with sales mgr, Shelley ****, who reinforced condition of the car was great, considering its age. Noticed noise coming from car so Mr. **** said he would have mechanic look into it & stated in writing that all cars are sent out for safety test. Mr. **** said the car was re-checked & was ok, so bought car in good faith. Took the car to *** ***** ** ****** Service Ctr to check over & learned the rear differential was rotted, RF strut was blown & leaking, LF brake hose was leaking, LF lower ball joint was bad, front brakes needed replaced, belts were worn, radio did not work, frame & differential had been painted to hide rust. Owner of the service shop said the issues should never have passed a basic safety inspection and is not safe to drive as is. Mr. **** said warranty should cover the repairs. Spoke to Nicholas ******** from warranty co. Mr. ******** said the repairs would not be covered as they would be considered pre-existing. Mr. ******** suggested cancelling service contract since nothing would be covered & contacted DAMS on our behalf & was told the cancellation was approved. Mr. **** said car was sold as is and serv. contract hasn't been refunded. I am aware that car was purchased AS IS, but there is good faith when purchasing as is & I also trusted the car had been safety checked. I was never expecting a perfectly running car but the issues were beyond normal wear & tear & beyond "zero issues." Disputing this charge with credit card co as well since this is consumer misadvertising. I would like to believe DAMS would do the right thing to help resolve. Would love to unwind the deal or have DAMS do all repairs.

Mrs G*****. As we told you 50 times over the phone and through many other complaints, you filed already. The sale is finalized. The truck was sold as is. You already disputed your credit card transaction 3 different times and it didn’t work. You canceled your service contact already. Once the dispute is finalized, we will refund you the money for the service contract. As far as the truck is concerned you have 2 options. 1. Keep it. 2. Sell it.

nothing we can do. Sorry you’re not happy with the truck. We gave you opportunity to look it over, test, drive it, you made a decision to buy it. End of story.

    thanks

    Dan
