    Consumer is a Senior. Company stopped at the consumers home on August 11, 2023. Consumer paid $4800 by bank check. A man came up to consumers porch. Told the consumer they had extra asphalt from a job. The man told her she had loose patches of asphalt on her driveway. They could repair at a reasonable price. The company would not give the consumer a specific price. The consumer did not agree to the work. Told the company she had to leave. Advised them to return and they would talk about pricing. When she returned that day about four hours later they did the entire driveway without her permission. No written contract. Initially the consumer was quoted $11,000. Consumer told the company she could not afford that price. Consumer told they could discount the price for $9000. Told the company again she could not afford that price. The mans supervisor spoke with the consumer. She was told we can do it for $6000. She was told not to tell any of her neighbors about that price. Consumer declined. Consumer agreed to a price of $4800. They wanted the consumer to go to the bank and pay cash. They followed the consumer to her bank. ******* near her home. The men waited in a car for the consumer outside the bank. Wanted the consumer to make the check out to a persons name. She does not recall the specific name. Consumer obtained an official bank check for $4800. Made out to the company. Paid in full was put on the memo. Consumer gave the company the check in the bank parking lot. She was not given a receipt. Consumer is dissatisfied with the work. The asphalt is coming up in certain areas. A company that came to her to repair her steps noticed her driveway was not sealed. Consumer is concerned about the driveway in winter conditions when being plowed. Her neighbor also noticed they did not seal the driveway.

    On August 15th we were solicited by this company to lay asphalt on our driveway for $7/ft. Once the job was started the price jumped to $7/sq. ft. I told them to stop what they were doing and paid them $2500.00 by check. On further consideration of the bait and switch I stopped payment of the check on 8/17. This company has called once to harass my wife about the stop payment and sent a demand letter from ********** for payment. The reason I stopped payment was exercising my right for 72 hour recission in Ohio.

    Responding to the press article, my child saw on the news
    we had black top available we just did their neighbors driveway no one beg them for the job we told them every 100 sq ft is 700 we didn’t have enough to cover the whole job we laid out 350 sq ft at $7 a sq ft total of $2500 they wrote the business a check for 2500$ 2 days later I took it to the check cashier  and the writer of the check OK and verified the check cashier was ok to cash the check the write of the check THEN put a stop payment on the check which is theft of services considering black top is 100$ a ton diesel is 5$ a gallon and the 8 men that physical laid the job in the heat that had be paid at $250,000 truck and $1 million worth of equipment you guys are slandering my name all over the news and I want this talking down because this is not right what they did or you guys are doing attacking a young small business, owned by a woman with three children to feed her family.

    I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed.

    We were solicited by this company. There was no agreed upon price before the work was started. We were told it would be $7/ foot not per square ft. When the job was was started we were then told it would be $7/square ft. There was no written estimate. We were not told about our right of recision (72 hours). We exercised that right under Ohio Law. We were misled. If this is fledging business as claimed then they need to understand ethical business practice and follow applicable laws and rules.

    I was approached at home by a gentleman who had extra tar and needed to use it up. He was fast talking like he was in a hurry to get back to the company. I couldn't understand everything he was saying but in the end I found out he told me about charging $10.00/sqft @764sqft to cover my drive and partial front lawn. I told him I could not afford seven thousand dollars. He asked what "CAN I AFFORD", I was scared and upset because the work was already started. I told him I could give him around two thousand. He agreed so I approved $1700.00 from my bank account, $200.00 from my credit card, and my granddaughter approved $600.00 from her bank account and she also gave $260.00 of her tip money. We found out later that he took $780.00 from my granddaughters account and I've been trying to get this amount returnd without any luck. I've made several phone calls to the office which no one was there to answer, and then I called the cell number and he didn't have voice mail set up. I've texted both numbers and I'm getting the run around and excuses. I was told that if companies have left over they have the option to return with what is left or use it up along the way back to company AT N/C because who ever ordered work done paid for whole amount. I was only asking for the return of the over charge of $180.00 but now if this is a scam I would appreciate the whole amount back. I'm on a limited income and struggling to keep my house and utilities from being shut off. I am unable to send you the text at this time. On working on transferring them .

    A Team Asphalt called me and asked for my granddaughters venmo information and wanted me to write a letter to BBB and let you know everything was taken care of.  I was at work so I didn't respond to the message. I filed a report with the local police department ** ** ******** ** *** ***** ****** **********) my boss took charge and contacted them. He told me to give him my granddaughters information and and my boss will contact you regarding settlement. My boss called a day later and asked if my granddaughter received her money back, I confirmed and that's the end. I deleted al the texts and learned an expensive lesson. Now I'm trying to catch up onamy utilities and medical bills.

    I hope the ******** ******* Shop got their money back. They were scammed and screwed just like me.
