    On Aug 22, 2023; I received an US post mail send to my mailbox addressed to a person named "************* *****". This letter stated this person owed $16841.91 to ******** ******* ** *** ************* **************************** ************* ** *** ******************************************** **** *** **** ************ ** ********** Reference: ******** trying to collect this debt. They did not providing proper validation of the debt at all. However, when I replied the letter stated they had sent to wrong person and tell them that my name is ***************** not ************* *****. Those are NOT my debt. But after replied back with the letter telling Kirschenbaum, **************************** P.C. they should do due diligence find the correct person, they still non-stop sending people to my mailing address, threatening with legal actions. I think they just don't want to admit they have made mistake on wrong identification to avoid violation of the ****** There must have some way to curb their bad business practice. Please help me to slove this ridiculous case and stop this company from intentionly using deceptive means to attempt to collect a debt.Sincerely yours,*****************

    To Whom It May ****************** allow the following to serve as a response to the correspondence sent to us
    through the **** Portal on January 31, ****. The account which is the basis of the
    complaint was originated between ************* ***** and ******** Realty, LP and in no
    way involves the Complainant.
    Firstly, this office makes every effort to verify the address of the persons we are dealing
    with. The letter that was addressed to 16 **************** was clearly addressed to **
    ***************, not the Complainant, identified as *****************, this is easily determined
    from the addressed letter that would have been sent in a window envelope. Yet,
    despite the letter being addressed to a totally different individual, the Complainant
    opens the letter, potentially in violation of 18 USC ****, (knowingly opening anothers
    mail).
    Secondly, the address of ******************* clearly and conspicuously appears on the
    credit report header of ************* ***** from Experian. Additionally, an address search
    of our subject through the LexisNexis Accurint product also clearly and conspicuously
    lists the 16 ***** Court as an address of ************* *****. So despite the
    Complainants allegations, our office acted reasonably in its attempt to locate the
    subject we were looking for.
    Furthermore, when the process server went to 16 ***** Court, he was told by the
    resident, (possibly the Complainant) that ************* ***** was known to them but didnt
    reside there.
    No adverse action has been taken against the Complainant that would otherwise impact
    their credit or reputation. I have taken the liberty of removing the 16 ************* address
    from our account.

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    Although, Kirschenbaum, Phillips, & **** P.C. responded that they were based a credit report from Experian.com and Address Search from the LexisNexis Accurint product for ******************** (person who actually owed debt as they claimed), they have not yet provided these crucial evidences to BBB showing their business practice is following federal debt collection guidelines and not violate the ***** laws.   

    In order to prove there is no wrongdoing and/or violating of the Fair Debt Collection Practices Act,the Kirschenbaum, Phillips, & Levy P.C. should provide the official credit reports from Experian.com on-hand and 'Address Search' results that matching to my mailing address from the LexisNexis Accurint products to BBB for final judgement of closing this complaint case ID: ********.   We want to make sure there is no identity theft (Ex. addresses), and the most importantly all persons or companies involved are treated equally that following federal guidelines by laws.

    I authorized an electronic payment of $50 and they did an electronic payment of $450 unauthorized. This company stole $400 from me and told me they mailed me a full refund which I have never received. When I called many times, I was told Mail is out of their comtrol.and that check was mailed and hung up on me.This was all done on a recorded line

    I have spoke to ****************** about this unfortunate incident.  It seems as though one of our representatives "fat fingered" a dollar amount entry neglecting to hit the shift key for "$" and rather than $50.00 being the amount entered into our system, the amount was entered as ******, and processed accordingly.  I regret the slow refund of the $400, but we first had to verify that we received the money.  Then we mailed a check, that apparently was taking forever to be delivered and finally we wired the amount of $400 to *******************  She confirmed by email that the amount was received by her.  I have spoken to the staff to aid in avoiding such errors in the future and if they are to occur, to escalate them to my attention immediately.

    Kirschenbaum has taken over my debt to a creditor by the name of KMT a group. I have tried numerous times to pay my arrangement and have been threaten with court and hung up on my an agent by the name of *************************. She was very rude although we wanted to pay the arrangement agreed. I have called numerous times with no help or told to call back for a manager. The agent yelled and me and my mother and Im not quite sure why.

    I have reviewed the account account in question.  ************ contacted our office after executing a Stipulation of Settlement on a Judgment originating from ******************* in addition to signing a Recurring Payment authorization.  *********** was concerned because we had not processed here agreed payment.  Apparently the Stipulation Agreement set forth a monthly payment of $100.00 and the recurring payment authorization set forth a monthly payment arrangement of $120.00, so no payment was processed.  The call from my prospective was not handled appropriately for which I apologize to ************ and will assign re-training and coaching for our representative, who did not respond appropriately when accused of "dropping the ball".  It is my understanding that the issue has been corrected and *************** payments are processing normally.  In the future *********** may email ** at ******************* or call me direct at ************.
