Dear *** *********** to entering into the lease of a 2025 *** i5 X40, I specifically expressed grave concerns to the Bayside *** sales staff regarding charging accessibility in light of his lack of charging capabilities at my residence. These concerns were particularly acute because I rents, and do not own, my residence and therefore I have no regular access or means either to charge an electric vehicle at or near my actual residence or to install or utilize a home charger, unlike other actual or potential customers. The sales staff, and specifically ****** ******** and *** ****** made material representations regarding the Vehicles charging capabilities, which I relied on to my detriment and this induced me to enter into the lease. Specifically, *** ******** represented to and assured me that the Vehicle had the ability to charge at Tesla Supercharging stations 1 Our client has informed us that *** ********* employment from your dealership has since been terminated based on his ineptitude. ******* A. ***** January 29, 2025 Page 2 using an adapter. *** ***** confirmed this misrepresentation by showing our client an adapter that he could purportedly order on ******. In addition, these discussions specifically addressed Tesla Supercharging stations, and not alternative charging stations (whether Tesla-run or otherwise). There is more to this narrative and is clearly upon reading the attached letter I am seeking the replacement of this electric vehicle with a gas model or the full refund for the cost, fees and tire/wheel protection for the electric model. Have a 2011 *** X3 that has had an outstanding ***** recall on it for more than 2 years now. *** finally notified me that a solution was available which involved replacing bolts and correcting any damage that might have occurred from the bolts breaking/loosening/falling out.The bolts hold in the ***** controller inside the engine and failure would/could result in rough idle/running/stalling and very serious causing disable while driving, surging, destroying the engine. It was scheduled for Thursday 2/27 at 0830. The car was dropped off with a repair completion maybe later that day or the next please call. At drop off there were no engine codes, the vehicle is regularly maintained by a qualified shop and was in great running condition. The car was picked up completed recall on Friday at 3PM. At pickup the car was running strangely and the Engine Light was illuminated. I called the service person who said that the light was on because the ***** solenoids needed replacing and they werent part of the ***** recall and I would have to pay THOUSANDS of dollars in parts and labor denying that their work had anything to do with the failure but bring it back Monday morning.Immediately I searched online and found page after page of the solenoids being damaged not working correctly after recall by improper procedures allowing debris or causing strain on the parts while doing the recall. The next morning I went to start the car and read the *** with my FixIT. Sometimes clearing a code resets the system. The car wouldnt stay running and generated first the Camshaft too ******** when cold (*****) code then multiple misfire codes. It was 20F outside. I chugged it up the block to the qualified shop who ran diagnostics then cleaned & checked operation of the solenoids. Not the problem. The car wont run while cold and runs rough when warmed up. Brought it back to *** on Monday. They still want to charge me thousands to fix whatever they broke.Customer Answer

Hello, I'm seeking assistance to recover a refund for the full amount paid on a Tire Protection Program which was cancelled within the allotted 60 days of purchase for a full refund.The program was purchased as an afterthought of the sales process and I paid $3,369.68 with tax in total using my debit card.While issuing the refund, *** has failed to return the funds in the same form of payment and sent the refund check to my ************ (lien holder) who financed the vehicle. I have since communicated with my ************ and they have transferred the funds to my account however, *** has also shorted me $220.68 for the sales tax (because it went towards the sales tax to register my vehicle). The sales tax and registration fees were all covered during the sales process and I funded the Tire Protection Program independently therefore the refund of $220.68 is owed to me.Initial Complaint

Thank you for your reply. **** the new ******* at bmw of bayside service **** was supposed to call me to let me know when my car would be ready or if there would be any action taken towards ***************. Never got no phone call . I hate to say it by like I said the whole management of that place is a joke or they do t value theyre customers, after my car is done being fixed I would never suggest or refer anyone for bmw of bayside. They dont value good customers. **** the Gm for the bmw of bayside and ******** the sales person that sold me the *** xm are the only two people that are trying to fix the problem. That is sad. I would hope somehow you would revamp your service department thank you again and I would hope some action would take place . *************** needs extensive training and the Ben ******* **** would also need some guidance in managementInitial Complaint

I traded in my leased car for a new car on April 15th 2023. The traded in car was supposed to be paid off with the payoff amount as of April 15th. The dealership paid the car off after another payment was automatically withdrawn from my account on April 21st. I have received no refund for the additional payment that was charged to me by either the dealership or *************. I called ************* and was told there was no overpayment due to the dealership paying a reduced payoff due to me making an additional automatic payment after the trade in. I tried to contact the salesman that sold me the car but no response. I am owed $1,161.62.Customer Answer

I went to this facility to resolve an issue with my car, they misdiagnosed the problem with my car and guaranteed that the issue will be solved as long as i pay for a service that they suggest. Per their diagnosis, i paid for this service, and when i got my car back, the issue was not resolved at all. So i had to bring the car back, and they misdiagnosed the issue once again, and said that once i receive a service they recommend, my issue will be resolved. However, when i got my car back the issue was still not resolved. This service center made me pay for a bunch of services that were not required for the issue that i went for, and this went on for 5 months. When i contacted the manager of the service center to file a complaint, he refused to reimburse me for the services they claimed will resolve my issue but did not.Customer Answer
