This will be my second complaint regarding the Newton Group Timeshare Exit.It has been 6 years and is still on going.I have been patient and reasonable however, at this point I am left to believe that this is a take your money and wait for foreclosure scam ****eted as a safe, legal and quick time share exit. As they do nothing after taking your money other than hire attorneys that also do nothing except wait for foreclosure.The first complaint was filed in April of 2020 after 2.5 years of zero progress.The initial response the BBB received from the Newton Group was with an oh well attitude, and a response of basically, you know these things take time. After informing the BBB Rep. that their response was in no way acceptable, I was finally contacted by a Newton Group Representative asking for Just a little more time.I decided, after a few phone calls with them, to be patient and give them the Just a little more time they had asked for to make good on their word.Again, this is now at 6 years with zero progress.I paid them in November of 2017 to exit me from my time share, and I am still waiting. I made it very clear in 2017 before signing up that, I did not want a foreclosure, but an actual exit as I was going through a divorce, that the property was in both our names, and that handing over $5,000 was a huge strain on my finances, this situation was explained in greater detail on the first complaint. I was assured in 2017 that it would not be a problem.This is a direct quote from one of their representatives emails from when I first started corresponding with the Newton Group with interest in retaining their services and explaining my concerns and situation in detail.We feel that the most important element in establishing a strong relationship with our customers is gaining trust through our actions. We don't make absurd promises, but we do stand beside our 100% Money Back Guarantee. Our customers trust us, the ********************** trusts us, and the state of Michigan trusts us to deliver the best possible service, while charging competitive rates.However, they and the hired attorneys keep making excuses, backpedal, and pass the buck, stating contract this and your contract that.And said Law Firm apparently, as I have been told directly by them that, they are at the complete mercy of the timeshare company. I find that that to be very strange since part of the sales pitch by Newton Group is/was we only hire experienced time share exit attorneys with a proven track record of successful and timely exits.I was unaware that waiting around for years and years (6yrs so far) for the timeshare company to finally foreclose or basically decide to do whatever the time share company wants to do, while the attorneys that Newton Group hired keep their client completely in the dark and at risk of potentially and unknowingly racking up thousands of dollars in taxes that they could be responsible for and ruining their credit, all the while giving their clients the same generic, Were working on it at every progress update call is what they consider as the bench **** for being successful.I contacted the Newton Group with my continuing and growing concerns and they set up what they called an escalation meeting on 9 June 23 with the law firm to address my concerns. This meeting consisted of, me, the firms Senior Counsel, and the attorney (at least the 4th different one since this started) handling my case.This was a colossal waste of time as nothing was accomplished, all they did was reiterate past excuses and that they are still waiting on the timeshare company to do something. I was also spoken to in a hostile tone and told by the Senior Counsel to not worry or even think about it as they were handling it. I was blown away by such a nonsensical statement considering how long this has already taken, and the negative effects it is having not just on my credit but personal life as well.Shortly after the meeting ended, I asked the Law firm to send me %100 of my case file, to include all notes, call logs, correspondence with/to the time share company/Attorneys etc., I was very specific, I wanted everything. They drug their feet sending scraps here and there, and they had a bad attitude about doing it.I had to repeatedly contact them to get it all, and when they finally confirmed that they had sent all the work they had done and everything that my case file contained there was nothing in there other than, the initial form letters (notice of representation etc.) from 6 years ago, all the bills and fees they had collected from the timeshare, and their Attorney logs that contained nothing other than the progress update calls to me.So, this means they have basically done nothing to exit me from my time share for 6 years and were/are just waiting for it to get foreclosed on all along.I also asked for a list of payments made to the firm specifically on my behalf by the Newton group over the last 6 years, they refused and instead sent me their generic contract of service with Newton Group. Through this I discovered that Newton Group only pays the Attorneys when they do something, so it looks as though Newton Group kept most of my money for themselves.Also, after the above referenced meeting ended with the attorneys, I contacted the Newton Group and informed one of their representatives as to what transpired during this meeting, and how unhappy I still am, now the previously nice and polite rep when passing the buck to the Attorneys or escalating it to management was now completely rude, and short with me. I was basically told if I wanted to terminate services that she could start a refund however, if I terminate my contract that they would basically feed me to the wolves as I would be completely on my own, even though they got me into this horrible situation, based on their so far unfulfilled promises and poor legal representation and advice by the attorneys they hired, and wasting six years of my life.The rep went on to state very rudely, according to them, (contract this and that stuff again) if the timeshare does get foreclosed on, they consider it to be an exit, to which I responded a foreclosure is a repossession, a forceful taking back of property, it is not an actual exit (a fundamental difference that a company that supposedly specializes in time share exits should know) and I made it clear that I did not want a foreclosure from the beginning, to which the rep responded by repeating even more rudely her previous statements.I then asked if I could speak to or be contacted by a manager, to which I was told very nastily that they have already been made aware! So, no you cant! and she went on to state that it was with the attorneys and therefore not really their (Newton Groups) problem. A far cry from the, We feel that the most important element in establishing a strong relationship with our customers is gaining trust through our actions. Statements.So, to put it in perspective I paid $5,000 to sit around for over 6 years now and counting, to just wait for the timeshare company to decide when they will foreclose or, realistically do whatever they want whenever they want to do it, have my credit ruined, to potently have racked up a mountain of debt, lied to, be threatened, disrespected, and treated like dirt by people/The Newton Group who swore how important I was to them when they were taking my money.Business Response

We work hard to ensure transparency and provide our clients with accurate information to make informed decisions.
Our clients receive options to exit and have the benefit of reviewing these options with a lawyer that personally represents them - a lawyer paid for by Newton Group. Any lawyer that individually represents any of our clients (like Ms ** has a legal duty to help them do what is in their best interest. However, no one can force a decision on our clients. Ms * made it clear she did not want her credit damaged. She was then presented with an option that would ensure her credit would not be damaged. Ms * did not like that option and then asked for a refund claiming she was unaware of our service offering and felt it was unfair
we scheduled her after the cancellation period was up. We would like to emphasize that we followed the steps outlined in our agreement Ms * signed on 11-04-22. Our team conducted the welcome call on 11-07-22 and scheduled the panel call for Dec 12th, 2022, as per the agreed-upon timeline. Additionally, we held an advocacy call on 12-22-22 and Ms * agreed to engage with our partner law firm.
We acknowledge that Ms. * called on January 03, 2023, expressing dissatisfaction and requesting a refund. However, Ms * had already benefited from our services - engaging with personal legal representation from our partner law and benefiting from her lawyers contract review and subsequent recommendation. Asking for a refund because Ms * does not like her legal options is not something we will accommodate.
Ms * signed her agreement on 11-04-22. She expressed dissatisfaction and wanted a refund over a year later on 1-03-23.
We are happy to continue to work with Ms * to find other options she may find suitable but we will not be issuing a refund for obvious reasons.Customer Answer

I am rejecting this response because:This response is completely unacceptable and shameful.
First, it looks like they have responded to the wrong client.
As they keep using her and she and I am a man, a him or he.
Also, I signed up in November of 2017 over 6 years ago, not 2022.
More proof of their lack of respect, and attention to detail wen it comes to the care of their customers.
Furthermore, the attorneys they hired have already admitted that they are at the mercy of the time share and that next no work was done to exit me in 6 years as explained in detail, in the complaint.
They promised a safe, legal, and timely exit and after 6 years have still failed to deliver.
This uncaring, wrong, and incompetent response to what appears to be the wrong customer only serves to highlight and legitimize the things that are in my complaint.

We were contacted by the Newton group to cancel our timeshare with Holiday ****************** They told us they could cancel it without ruining our credit. We had to pay $5000 to get them to cancel it. They gave our case over to a lawyer group- DC Capital. They told us we had to pay the past due maintenance fees plus pay off the Timeshare before they could do anything for us. After paying those off, we would then have to pay another $1200 to transfer it out of our name. We were lied to by Newton Group. They had told us they could cancel our timeshare without having to pay it off or pay off the maintenance fees. And when they had the lawyer contact us they said that was not possible. If we had been told this up front we would not have signed on with them. We didn't speak to anyone with their lawyer office until past their deadline to cancel with them. Newton Group scheduled it after the deadline. I feel like we should have been given all of this information up front. Why pay an extra $5000 on top of what we already owe? It's nothing but a scam. May 25 2023 total cost ******** timeshare cancellation they gave 3 days to cancel this contract. after the three days red flags start showing, they stared the part of the application and said they will send more forms to be filled out and gave me ten days to return the forms or the contract will be cancelled. they didn't know how to send the forms. they sent the forms that looked like a virus. I tried to contact them, no response, so the ten days past and according to their policy the contract was cancelled. I called the finance company to cancel my account and they said ********************** had to cancel the account. 2 weeks later sent me more forms to be fill out and gave me 5 days to return the forms or the contract will be cancelled. Now how do cancel a cancellation? They are trying to move forward by collecting my money on an incomplete application and red flags. the finance company are trying to intimidate by sending collection notices.Business Response

NOT SURE OF THE DATE We hired Newton Group to escape a timeshare from ***** in ******. This was a company that didn't stand behind its word. They hired an attorney group, Capital. The attorney was rude and pushy. I left Contact with the ***** resort and had to fight myself. I asked if she could help us escape the credit card debt. That was a NO, so everything I was helping with, I was given. I requested a full refund and was told it had to be the owners would let me know. I am still waiting. For the answer, either they will help me fight Wyndham Resort or get me a full refund, of what Newton group told me.This is the reason for my complaint.Business Response

We employed The Newton Group about four years ago to help us exit to timeshare properties. They instructed us to quit paying maintenance fees on these timeshares. They now offer an exit program in which we must bring all maintenance fees up-to-date. We originally agreed to the exit program but are finding that the maintenance fees are much more than expected. We paid to exit one of the two timeshares. We now reject their offer to, turn the timeshare over to them for an exorbitant fee. We want The Newton Group to continue with the earlier agreement (that was bought and paid for) to get us out of the other timeshare. Its now been four years without progress.Business Response

After another timeshare exit company closed and left in the middle of the night,I contacted Newton Group,who told me they could help me and to be assured the fradulant timeshare would be ended. On/about January 26,23 we signed for a Newton Group webinar. We were contacted by a gentleman to discuss and answer questions. January 28, he called back to get information & set up payments. If we paid all we got a discount vs full amount if we did payments. So, a payment of ******** was made. (From 12/22/22-02/07/23 we had made numerous contacts trying to get out of the timeshare-contract even timeshare) We were advised to request a charge back to our credit card due to Newton not able to get us out of the timeshare. Still seeking to get out of the timeshare. We were trying to gather the information Newton group requested. With work hours this was not easy. Had to meet with the notary at 8pm to even get that signed. I faxed all the information then got a message that we needed to get records back, I called Newton and they had not gotten it, she said it had to be sent certified, yes Im human and totally forgot it had to be the originals. I mailed those 2/28. Still waiting for appt with attorney on 3/10. On 3/9 we were given the offer to be released from our timeshare from the timeshare co themselves. So, immediately we sent a cancellation of the *** to Newton( certified letter mailed 3/11/23) We did not offer explanation due to holding our breath until we actually received the final cancellation. Due to the Newton group not doing any of the work to get us out we feel the money should have been refunded to us. We got a call from ***** and she offered back ****** of the ******** because we breached our contract.I asked what she was talking about, she said they never received the proper ownership papers, WE DO NOT HAVE THEM!! Im sorry were human and I honestly struggled to get the letter notarized & totally forgot it had to be the originals. We have full time jobs & lives. We could not put on hold.We did expect to have to give up some of our money but not be completely robbed. I guess we were told correctly the company is a fraud. Hello, back on November 14th 2022, I sent the Newton Group a check for $4,000.00 to help get me out of a timeshare with Club ******. Only after taking my money did they tell me ********* ****** was on their no takebacks list. When I inquired as to the use of these funds, one of their attorneys told me that they were unwilling to give me a refund. She claimed that because they had given me a whopping 2 choices as to how they could get me out of my timeshare that I was inelligible for a refund. What they did tell me after the fact was that i could spend an additional $2,500 in fees to then get out of the timeshare after they had previously said they were unable to get me out of the timeshare. After all of this headache, I would just like to get a refund and be done with them but they have been unwilling to negotiate.Business Response

Entered agreement with Newton Group (NG) March 24, 2022, under a strict and communicated agreement/understanding that we would not default on the existing mortgage/jeopardize credit in good standing to achieve results offered by **. Were told defaulting/stopping payments would not be necessary to negotiate/settle our existing loan due at lower cost. Were told we should save in excess of the costs paid to upfront to NG. Were told a 30-50% reduction of the note due was typically achieved while being able to end future obligations with the Timeshare. Paid fees in full = $8700.00. Now, been asked multiple times to stop payments of the mortgage and/or annual services fees to better facilitate negotiations. Each time we said no - due to work requirements that require remaining in good credit standing at all times. NG could not negotiate a settlement of any kind. NG attorneys told us they could negotiate a settlement other than a full price unless we defaulted and ruined credit. We reached out to NG to end our relationship, instead we were scheduled with attorney and a second attorney who did not identify himself as NG's council. Their only suggestion - take on more debt and/additional debt to pay off debt to timeshare *** with no expectation of an ability to negotiate a lower payoff/settlement. We said no. We asked them to let NG know we wanted to speak to someone and end our relationship - that was around April 28, 2023. No one has contacted us from NG. We sent an email March 21, 2023 to end our relationship and request a refund. There has been no reply as of March 28, 2023.Business Response
