Last October I had wages garnished by Klima, Peters and **** law firm until February of this year where $1600 was garnished in that time frame. After court in February I called twice to be set up on automatic payments where they said I could not. I tried calling yesterday with minimum payment and was told a garnishment was filed may 7, 2025 by Norfolk courts. I have not received any attempt to contact me or ask for a payment- it jumped to garnishment. I talked to a **** whom is a supervisor about lessening the amount like they did the first time and he asked me like I was a child why didnt I call? I hadnt called on it which is a lie I did call as instructed and told me no he wasnt going to help me that 25% garnishment is in effect until October and this is not right. Ms. ****** is identified as ***** L.********** in the *** collection system and as the defendant in the litigation.*** represents **************** (****) in attempts to collect Ms. ******* delinquent Navy ******************** credit account with account number ending in 0585 (the Account). LVNV is the current owner of the Account.
The Account was referred to *** for collection on or about 08/18/23. On 08/23/23, KPD mailed an initial validation notice to Ms. ************* The initial validation notice contained information regarding the Account and included language indicating ***** ownership of the Account as well as KPDs role as a debt collector attempting to collect a debt owed to ****. On 10/19/23,*** filed a lawsuit in the General District Court for Norfolk City under Case Number GV23021809-00 (the Lawsuit) to facilitate collection of the Account.Service was perfected on 11/07/23. A hearing was held on 12/15/23 and Judgment was entered in favor of the Plaintiff LVNV.
Ms.****** contacted *** on 01/08/24 and agreed to a payment plan of $119.36 bi-weekly; the first payment was due on 02/08/24. Ms. ****** made several payments; however, five payments were returned for insufficient funds between 02/16/25 and 08/15/25. *** deleted the payment agreement.
*** filed a wage garnishment in an effort to collect the remaining balance on 09/05/24. Ms. ****** made a $180.00 payment on 09/19/24 which was credited to her balance. On 10/28/24, Ms. ****** contacted *** and *** agreed to amend the garnishment to $200.00 per bi-weekly pays. On 04/07/25, *** received $1600.00 which had been withheld from Ms. ******* pay.
In an effort to collect the remaining balance, *** filed a second wage garnishment on 05/08/25. Ms. ****** contacted *** on 06/10/25 in an attempt to amend the garnishment a second time.
*** denied this request as per their clients right as the Judgment Creditor; the garnishment will proceed. The hearing date for this garnishment is 10/10/25.

Dear Better Business Bureau,I am writing to formally file a complaint against Klima, **************************** P.A. regarding their unprofessional and unethical business practices. Based on my experience, the company's representatives, including its director, Mr. **** *******, have exhibited unprofessional and inappropriate behavior when addressing customer ***********. ******** in particular, has been extremely rude and dismissive in his interactions. His approach, along with the companys overall conduct, demonstrates a lack of professionalism, fairness, and respect toward customers. Additionally, their debt collection practices appear to be overly aggressive and improper, creating an unnecessarily hostile experience for those involved.I believe these practices are unacceptable, and I urge the Better Business Bureau to investigate this matter. Consumers deserve to be treated with professionalism and respect, and I hope that appropriate action will be taken to address these concerns. Klima, Peters & ****, P.A. (***) is in receipt of the complaint (********) filed by ******* ****** (the consumer). *** represents **************** (****) in attempts to collect the consumer's delinquent Credit One account with an account number ending in 7794 (the Account).
The Account was referred to *** for collection on or about 06/21/24. On 06/26/24, *** mailed the consumer an initial validation notice containing information about the Account as well as additional disclosures required by applicable law.
On 08/08/24, *** filed a law suit in the Montgomery County District Court with the case number D-06-CV-24-020290. The consumer called the *** office on 08/09/24 and informed the Collector that the consumer wanted the lawsuit dismissed and wanted to pay the account off in $50.00 payments. The collector denied this request. A $50.00 payment was made on 08/09/24 and the check was returned on 08/22/24 for non sufficient funds.The consumer called the office on 02/12/25 and wanted to negotiate a settlement. The offer of $544.00 was made and the consumer turned down that settlement offer. The offer was rescinded. When the consumer called back, the collector informed that the case would be dismissed only if the account was paid in full prior to the court date. The consumer made a $250.00 payment on this day. The affidavit judgment hearing date is 04/10/25.
If the consumer pays this account off before the trial date, the case will be dismissed. If the consumer would like to discuss this account further, the consumer should call the *** offices and speak with the Collection Supervisor ******* ********.

On January 7, 2025 I entered into a payment arrangement on three accounts I was behind on to avoid a court hearing on January 23, 2025. During my call on January 7, 2025 the only benefit to paying in full on said call would be a discounted settlement rate. I opted to go with a payment plan and make a large down payment on each to avoid the pending court hearing. After the call I received paperwork for the agreement. In their summary it mentioned should I fail to make my payments they would execute on judgement and mentioned a 10% interest rate for the judgement. It has now been brought to my attention I am being charged the 10% even though I am in a payment arrangement. This is a bit of swindling to close a deal on their part. At no point when making the down payment or setting up the payment arrangement was the possibility of interest mentioned and after reading the paperwork the understanding was interest would be charged should payments fail to be made. I have also received bills to make the payments even though they are set up for automatic payments. Went around and around on a phone call on January 30, 2025 in regard to the interest to no avail but was fortunately able to confirm autopay is setup. At this point I'm not sure I trust that to be true but I will see what happens on February 20, ************************************ they attempt to garnish wages for failure to pay.Business Response

The Accounts ending in 3039 and ********************************************** about 08/15/24. On 08/20/24, KPD mailed Mr. ***** an initial validation notice for each account containing information about the Accounts as well as additional disclosures required by applicable law.
The Account ending in 3393 was referred to *** for collection on or about 09/20/24. On 09/25/24, KPD mailed Mr. ***** an initial validation notice for this account containing information about the Account as well as additional disclosures required by applicable law.
On 10/07/24, *** filed a lawsuit on behalf of **** against Mr. ***** in the ****************, MD District Court under Case Number D-08-CV-24-035865 (the Lawsuit) to facilitate collection of the Account ending in 3039. On this lawsuit, Mr. ***** was served on 10/21/24.

On 01/07/25, Mr. ***** contacted *** and agreed to payment arrangements on all three accounts. A down payment of $300.00 and $61.00 monthly payments were agreed upon on the accounts ending in 3039 and 7766. A down payment of $600.00 and $61.00 monthly payments were agreed upon on the account ending in 3393.
A Consent Judgment was mailed to Mr. ***** for each lawsuit on 01/08/25 with the specifications of the payment agreement and indicating that post judgment interest would accrue at the legal rate.
On the account ending in 3039, judgment was entered on behalf of **** on 01/23/25.
On the account ending in 7766, judgment was entered on behalf of **** on 01/22/25.
On the account ending in 3393, judgment was entered on behalf of **** on 01/22/25.

I had a debt from an unresolved credit card that went into collections. I understand its my responsibility. Once it went into collections, I had my fianc call them and make payment arrangements of $500 down and $50 biweekly on a $1200 bill. I have a screenshot not sure if the system is gonna allow me to show it, but they took out three payments in the last 24 hours. I called them to let them know that and on the very three phone calls three different women answer the phone all three with attitudes because I did not want to pay my payment via ach anymore due to their error. I know this that is mine and I promise to pay it back at $50 biweekly. I do not have a lot of money. This is why this account went into collections and when they took $150 out of my bank account and 24 hours it caused the account to overdraft by $70. I did tell them I was recording the call Because of how rude the first **** was. The second **** hung up after I said that the third **** refused to acknowledge the fact that their company took out three payments. The manager would not even let Me or my fianc talk I took the phone from my fianc because I could see that it was upsetting her the way he was talking to her and he would not even let me talk. He tried to bully me. The way the manager spoke to me and her is Uncalled for. I understand theyre not BBB accredited but their name needs to be put somewhere the way they try to strong handle people. I was really didnt understand because the very first conversation we had was all good because I guess we were given the money but when they were being accused of overdrafting my bank account three times in one week they didnt wanna hear it. They did not want to hear it they interrupted every single conversation. I received a fraudulent court document in the mail with marker signature from Klima *************************** 06/2024. We hen I called the first rep was rude and dismissive!!! I called back got another agent and she assisted me with setting up a payment arrangement for the end of July; July 31 to be exact payment of $115 or $125 or settlement of 1700. I agreed to the monthly payments. July 25 I received my paystub with GARNISHMENT AMOUNT OF $200 after the 2nd rep assured me that there was not garnishment under record for me. LVNV purchased the Account on 10/18/22 and is the current owner of the Account.
LVNV referred the Account to KPD for collection on or about 05/19/23. On 05/24/23, KPD mailed Ms. **** an initial validation notice containing information about the Account as well as additional disclosures required by applicable law.
On 08/18/23, *** filed a lawsuit against Ms. **** on behalf of **** in the Maryland District Court in ********************* under Case Number D-05-CV-23-027153 (the Lawsuit) to facilitate collection of the Account. Ms. **** was served on 08/31/23 ********************* ********). A judgment was entered on 01/29/24 (See Attached Judgment ********).
To further facilitate the collection of the account, *** filed a Writ of Garnishment in the *********************** in ********************* on 06/12/24. On 06/21/24, the Garnishee answered the Writ and informed *** that the defendant was not employed at Transit Employees Health and ************* On 06/24/24, Ms. **** contacted this office and informed the collector that she would like to make payments on $1000.00 and not what the court had awarded in the judgment ($1895.38). Ms. **** called again on 06/25/24 and informed the collector that she was in the midst of a hardship and asked if she could settle the account or make payments on the balance. A settlement of $1743.50 was offered, or, Ms. **** could pay $115.00 monthly payments on the full balance.The consumer agreed to the monthly arrangement.
******* contacted *** on 07/26/24 and informed the collector that her employer withheld $200.00 from her wages. It was agreed that *** would accept the $200.00 garnishment payment, dismiss the wage garnishment, and Ms. **** could begin the $115.00 monthly payments starting on 08/30/24.

Working with Kilma Peters and ****, well they were unwilling to work with me initially with something I could afford, now I'm being garnished 25% a week. All agents are extremely rude, unwilling to work something out that is affordable. The debt in question is in another credit rebuilding program, but the firm is unwilling to work with them as well. LVNV purchased the Account on 04/14/23 and is the current owner of the Account.
LVNV referred the Account to KPD for collection on or about 10/20/2023. On 10/25/2023, KPD mailed Mr. ******* an initial validation notice containing information about the Account as well as additional disclosures required by applicable law.
On 12/20/23, *** filed a lawsuit against Mr. ******* on behalf of **** in the General District Court of ******** for ************ under Case Number GV23007622-00 (the Lawsuit) to facilitate collection of the Account.
A judgment was entered on 01/23/24 (see attached ********** (1)). Mr. ******* contacted *** on 01/24/24 and informed a collector that he would be calling back with information regarding a bankruptcy filing. As of the date of this response, Mr. ******* has not provided that information.
To further facilitate the collection of the account, *** filed a Writ of Garnishment in the General District Court of ******** for ************ on 05/07/24. On 06/04/24, Mr. ******* contacted this office and informed the collector that he had retained ******************** (***) in an effort to pay off this account; he further stated that he had a settlement in place and that *** was paying **** directly. The consumer reported that he has been garnished $200.00 per week on this account. *** has not received any funds. The hearing date for the garnishment is 10/16/24.

A communication error on **** funding not declaring the account sold to the law firm to **** I was told I didn't need to contact anyone that *** would be my contact point. The firm continued with garnishment instead of the debt program.

We would encourage the Consumer to provide proof for payments made to **** so that we can reduce the outstanding balance in our system.
We would encourage the Consumer to ask a representative from ******************** (***) to contact our office. We have not been provided a Power of Attorney from *** and that precludes this firm from corresponding with them. If the *** is received and an offer of repayment is made, this does not guarantee that this firm or our client will accept their offer; however, this will provide a point of contact going forward. There was no response to the *** and *** filed suit in the District Court of Frederick County (case number D-111-CV-23-00831) on 04/24/23. The summons was issued to *********************************************** but the process server was informed by an unknown male at the residence that the consumer does not reside there. A postal letter was received that indicated that the consumer resided at **************************************************************************.

April 29, 2024 I received a warrant in debt today, from the business Klima, Peters, and **** in ********, **. They are getting judgment against me and forcing me to go to court. I am a 73 year old woman on an income of $963 a month. I barely make it by each month but I have everything budgeted. There is no way I can afford to take on another payment. The only thing I can figure is that they're not looking at the people behind the bills. When covid-19 struck in 2020, I was in dire straits! I barely made it through then and now they want me to add something else on top of my money that I already have to pay out! More than the seven years ago, I settled a credit card balance of $3000 with synchrony bank for a ****** credit card. The settlement amount was approximately $2800 for the $3000. After I made this payment, Bank proceeded to take the $3000 that was settled and placed it back on top of the ****** line of credit also run by **************, which had a similar balance of $3000. ***************************, then a collections agency and now Klima, *************************** are claiming that I owe them $6000 when in fact, I had already settled half of it. Klima *************************** admitted to me that in their paperwork which they later redacted it showed a balance of $3000 that was past due suddenly jumping to $6000 and the representative I spoke to said that she saw a note stating change of terms and on the paperwork it states that suddenly the balance went up by $3000. This was the paperwork submitted to the court initially when they filed suit. It was misleading to the judge and frankly disrespectful. I am willing to pay $3000 to Cover the ****** Line of Credit and have offered this each time they called last year. They refused to call back. The balance I already paid for as is proven beneath the black marks/redactions that render their paperwork unusable. I am prepared to counter sue for harassment and lying to defame me.Business Response

This account, owned by ***************** (****), was referred to Klima, Peters & ****, P.A. (***) for collection on 04/21/23. The account was a credit card that originated with ************** with the last four digits 5195. The file number at *** is **********.
KPD sent an Initial Demand Letter (IDL) to the consumer on 04/28/23. There was no response to the *** and *** filed suit in the District Court of ***************** (case number D-06-CV-23-014677) on 06/15/23. The consumer was served a summons on 11/15/23 and subsequently called *** on 11/23/23.
With this communication, the consumer entered into a Consent Judgment by which the consumer would pay $205.00 per month starting 11/24/23 and every 30 days thereafter until the account was paid in full. The consumer defaulted on the payment agreement. The consumer called *** on 12/11/23 and again agreed to a Consent Judgment payable at $205.00 per month and starting 12/22/23 and every 30 days thereafter until the account was paid in full. Again, the consumer defaulted on the payment agreement. In both cases, the consumer agreed to a judgment balance of $6051.19 plus court costs.
The District Court of Montgomery County entered the judgment in favor of **** on 03/15/24 for $6051.19 plus court costs (see attached).
On or about 04/17/24, *** filed a Bank Garnishment in an attempt to enforce the judgment awarded in the District Court. The consumer did not call our office with information regarding an incorrect balance on the account.
If the consumer would like to discuss how to proceed with respect to a dispute regarding the balance, we would ask that the consumer call *** at ************** and speak with the Collection Manager **** ********.
