An account was opened with my social security number but it is not my account and not my name. The name is similar however am not a **** The first is spelled different the middle is not the same as mine. For example the first name on the attached check is spelled **** my name is spelled ***. My middle name does start with an "H". I have never lived at the address the check was mailed to. The person Who's account this contacted me (familymember and made me aware of the issue. I reached out to the company Mariner Finance and they are not willing to fix the problem after acknowledging they made the mistake. This is fraud! The representative demanded me to come in and give them a copy of mt DL. I do not feel comfortable doing that. This company already has my information. I do not have any relationship with them, and. never have. This company needs to be made accountable for their fraudulent practices. A lack of compliance and quality control.Business Response

A pre-screened loan offer was mailed, based on information provided by the nationwide Credit ****************** (CRA), to and intended for **** ******. The offer complies with all applicable state and federal regulations, and is extended to credit qualified individuals based on information provided by the credit bureaus.
Upon receipt of Mr. ******* complaint, and after review of information obtained, Mariner has submitted a manual update request to the **** to delete the tradeline from Mr. ******* credit report. Please be advised that **** may take up to thirty (30) days to process requests of this nature.

Loan account opened on 05/21/2025 Mariner Finance committed to providing a loan with the first payment scheduled for July 5, 2026 of $340.97. Then all remaining payments would be monthly (Second payment in August) at the rate of $260.10. The nature of the dispute: Mariner Finance charged my bank account for the first monthly payment on July 5, 2026, for $340.97 and then I updated the autopay payment method to be a different account. Once the new bank account was listed as the auto payment method, Mariner Finance charged me $260.10 on July 11, 2026. At this point I was charged two payments for the month of July. I contacted the local branch to explain what happened and requested a refund of the erroneous payment of $260.10. The branch employee stated that she could see the erroneous payment and agreed that it should not have come out of my account until August. She then stated that they would provide a refund due to the error, but I would have to provide a bank statement showing that both payments have cleared my account and were not pending.The next day when the $260.10 charge was no longer pending, I provided a bank statement showing that both payments had cleared the account. At this point I was transferred to branch manager ******* who stated that he could see the error and I have provided the necessary documents. He advised he would contact ***************** and get approval then print a physical check for me to pick up. I asked if he could just send the refund back to the payment method and he advised he was unable to do that. I told him that it would be fine, and I would pick up the paper check when it was ready. The next day I spoke with *******, and he advised ***************** declined to provide the refund because it is against policy unless it was their fault. I explained to him that it was indeed their fault because their system auto drafted an extra payment from my account. He then told me I could try to dispute the charge at my bank.Initial Complaint

Mr. ***** obtained a loan with Mariner Finance, LLC ("Mariner") on March 21, 2024. As part of Mariner's account opening procedures, specific information including the applicant's name, date of birth, address and identification number are required and verified, and these documents are retained with the loan file. Additionally,the loan is secured by a perfected lien on a 2015 Jeep Grand Cherokee registered to Mr. **************** ***** made seven (7) of the required forty-two (42) loan payments, but failed to submit additional payments as contractually agreed, and the loan is currently in default.
Mariner has no record of Mr. ***** having contacted Mariner directly to initiate a fraud claim in relation to his loan, and based on our review, it does not appear the account was opened fraudulently. Additionally, no supporting documentation was attached to this complaint as stated by Mr. ************ However, if Mr. ***** would like to proceed with a fraud claim, he may complete the attached ************************ Identity Theft Victims complaint and Affidavit and return them, along with a copy of his government issued photo identification, and a police report if available, to Mariner Finance Customer Relations, ******************************************** These documents may also be provided to the local Mariner branch.

Mariner includes an initial disclosure regarding credit reporting in the **** Act Notice and in the Privacy Notice, both of which were provided to Ms. ********** at the time her loan was originated, and annually as required. To further clarify, credit reporting is clearly identified in Mariners Privacy Notice,and in 15 U.S. Code 6802, as a type of sharing that cannot be limited by a consumer.
Ms.********** s account is currently in default, and was ultimately classified as a charge-off account on May 28, 2020, which remains legally collectable.

On March 25th 2025, I made a payment through my bank in the amount of $5,879.82, to pay off my loan. The payment was delivered electronically on 3/27/25. Mariner Finance continues to say they do not receive money electronically & cannot locate this payment. My bank, SoFi, has looked into the issue but it has been posted to Mariner & cannot be recalled. I have called numerous ************ refuse to locate the money & continue to say they need the check number even though it was not submitted via a check. So that my credit is not effected I have to continue to make payments on a loan that should already be paid off. I would never recommend Mariner Finance.Business Response

Ms. ****** has had three (3) loans with Mariner Finance, LLC (Mariner), and entered into her current loan on February 13, 2023, when she refinanced her prior Mariner loan. As part of Mariner's account opening procedures, specific information including the applicant's name, date of birth, address and identification number are required and verified, and these documents are retained with the loan file. Additionally,Mariner can confirm the home address provided in this complaint is consistent with the information on file for Ms. ****************** ****** made the equivalent of three (3) of the required forty-two (42) loan payments, but failed to submit additional payments as contractually agreed despite multiple unsuccessful attempts to contact her, and as a result, the defaulted account was classified as a charge-off account on December 29, 2023, which remains legally collectable.
Although Ms. ****** continues to submit automated credit disputes claiming both fraud and inaccurate reporting, Mariner has no record of her contacting Mariner directly to initiate a fraud claim in relation to her loan, and based on our review, it does not appear the account was opened fraudulently. However,if Ms. ****** would like to pursue her claim of identity theft, she will need to complete the attached ************************ Identity Theft Victims Complaint and Affidavit and return it, along with a copy of her government issued photo identification and police report if available, to Mariner Finance Customer Relations, ***************************************

Thank you for contacting us. Mr. ***** entered into the loan in question with Mariner Finance, LLC ("Mariner") on January 31, 2019, when he refinanced his prior Mariner loan. Mr. ******* defaulted on his loan, and as a result, the defaulted account was referred to small claims court on May 20, 2019. In order to avoid additional court proceedings, Mr. ***** contacted Mariner on May 22, 2019, and agreed to resume making monthly loan payments. On July 16, 2020, Mariner received a final payment in the amount of $246.86, which paid the account in full. Paid in full documents were mailed to Mr. ***** on July 31, 2020.
Regarding Mr. ******* claims of FCRA violations, Mariner includes an initial disclosure regarding credit reporting in the **** Act Notice and in the Privacy Notice, both of which were provided to Mr. ***** at the time his loan was originated, and annually as required. To further clarify, credit reporting is clearly identified in Mariners Privacy Notice, and in 15 U.S. Code 6802, as a type of sharing that cannot be limited by a consumer. After recently reviewing my credit report from your company, I noticed several inaccuracies that need to be addressed. I filed a bankruptcy back in December 2024 relinquish the vehicle that I have with mariner finance. The car is still singing and theyveyet to come and pick it up when I have called multiple times just says that theyve been out but I have a ring camera and does also and as we go back in the history, theres been no attempt. No one has come to my door. After them, calling me multiple times and complaining about how I was behind and then when I found bankruptcy they dont wanna pick up the vehicle. Theyre horrible to deal with their interest rate is so high. It was just too much for me tocontinue on with a car thats not worth What theyre asking. *******, who says she is a manager even said this to me that the car is not worth with theyre asking. All we want now is for it to be removed. Theyre telling me they consume me, which is not true because the vehicle was included in the chapter 7 bankruptcy.Business Response

Ms. ****** entered into entered into the loan agreement with Mariner Finance, LLC (Mariner) on December *******, and the loan is secured by a perfected lien on a 2019 ******* ******. On December 18, 2024, Mariner received notice that ********* had included the debt in a Chapter 7 Bankruptcy petition, which was discharged on May 6, 2024.
As of the receipt of this complaint, Mariner can confirm that the vehicle was repossessed on June 24, 2025, and upon determination of the vehicles resale value at auction, proceeds from the sale will be applied to the account upon receipt leaving Ms. ****** responsible for the remaining deficiency balance.

Instead of closing my account when I paid it off, they waited to apply my payoff and kept the account open with a $40 balance. They then charged interest on that account for 2 years and never contacted me because they listed the account as paid ahead. When they finally did contact me, they said the balance was over 2600 because of interest accrued on that $40. The gentleman proceeded to threaten me that he would get the money when I die.Business Response

Ms. ********* entered into a loan with Mariner Finance, LLC (Mariner) on December 9, 2022. On July 6, 2023, Mariner received a payment in the amount of $5,600, which contrary to her complaint was immediately applied to her account upon receipt, leaving a remaining balance of $39.08. Because the remaining balance was not addressed, interest continued to accrue on the remaining balance as disclosed in Ms. ********** contract. However, as a courtesy to our customer, ********************** has waived the remaining balance and the accrued interest, and have updated Ms. ********** loan to reflect paid in full as of July 6, 2023. Paid in full documents have been mailed to Ms. ********** address of record.
Mariner respectfully disputes Ms. ********** allegations of threats and inappropriate communication, as a review of account records indicates no collection activity in violation of applicable law or regulation. Mariner has strict policies that outline appropriate customer communication and team members are thoroughly trained on this policy.
Ms.********* has had an account relationship with Mariner dating back to 2020, and we appreciate her business and the opportunity to address her concerns.
