    I hired DSV Contracting (Derek ******) to build a detached garage. The contract was signed 9-Oct-2020. On 14-April-2021 the contractor notified us that he was completed. Before completion of the garage on 18-Mar-2021 I notified the contractor of cracking in the foundation wall. Contractor told us these were surface cracks in the parging and he covered them up.
    On 7-Dec-2021, I notified the contractor that there was significant settling in the slab in the same corner as the external cracks. The contractor came and looked at the settling and agreed to make repairs per the warranty. Contractor said he could not make repairs until the Spring. In the meantime, I had two different contractors come out and assess the slab for repair and they identified that the same crack we notified DSV Contracting of on 18-Mar-2021 had re-appeared. The exterior wall had also begun to bow at the top. The 3rd party contractors gave two different quotes and two different suggestions for fixing the problem. I provided the quotes to DSV contracting and he had his own contractor come out on 13-Jun-2022. DSV contracting never provided the assessment from his contractor. Because of the structural concern, the difference in opinion of the two 3rd party contractors and the lack of response from DSV contracting I hired Norton Engineering to do an assessment of the structure. I paid the structural engineer to perform two assessments and reports. The conclusions of the reports were that the slab backfill had been improperly compacted per DSV contracting's own admission which was causing the settling of the slab. Additionally, the report identified moisture under the slab and around the structure that was exacerbating the issue. The contractor is claiming all issues are due to drainage and moisture and is refusing to provide any fixes for the improperly backfilled slab even though the vertical wall crack and the slab settling were identified in the warranty period.
