On June 26, 2023, I signed a contract with Mr. Antonio ********** to perform a complete renovation on my home located at **** ***** *** *** *********** ** *****. At the time, I gave Mr. ********** the first of three installments in the amount of $25,313.32. I gave him a second check, for $25,313.32 on July 27, 2023.
In September, Mr. ********** suggested that we dissolve our contractual agreement. I told him I would only do so if he returned at least $30,000.00 to me. He refused stating he did not owe me any money. I refuse to release him from our contract.
On October 21,2023, Mr. ********** texted me asking to amend the contract for an additional $35,000.00 to complete the project.
In December 2023, I gave Mr. ********** $2,900.00 for the electrical and plumbing permits which were issued on January 3, 2024. (It was quite unethical for him to charge me that amount of money for permits only costs $463.40)
Now that all the permits have been secured, Mr. ********** now wants me to pay $7,000.00 for the electrical work to be completed. Without that , he cannot move forward as he does not have the money to pay his workers. Our signed contract states that I do not pay him any additional money until the entire project is completed. So now we are at an impasse.
I would like a refund of the money I have given to Mr. **********. The breakdown is as follows:
$35,000.00 the amount Mr. ********** states it would take to complete the project.
1,659.00 overcharged amounts on the permits (building, electrical and plumbing)
8,541.76 …. Nov, Dec, Jan, Feb mortgage that I am currently paying due to Mr. **********’s
inability to complete the project in accordance with the written contract.
3,500.00...additional money given to Mr. ********** for structural work not completed
    $48,700.76 Total

Due to the condition Mr. ********** has left my house in, I can neither rent it out nor sell it.

    Sincerely,

    ******** ******
