I honestly dont get why FMS FINANCIAL SOLUTION is reporting this debt under my name because I dont owe them anything. I never signed anything with them, and when I asked for a copy of the original application, they didnt even bother to provide it. Its frustrating because this is hurting my credit for no reason, and its just not fair. Please be advised that this account is owed by ******** ****** - the consumer who filed this complaint. It has been validated with the consumer as well as with the e-Oscar platform several times. Please refer to the driver's license in the attached documentation received directly from the consumer along with a validation request. It matches that sent with this dispute. Also included in the validation request from the consumer is a signed social security card. The signature on that social security card matches that on the lease and application signed by the consumer at move in. Please find attached a copy of the rental application and signature pages of the lease for review. The office sent the attached validation documentation to the consumer on 7/21/2021 & again on 8/28/2024. Copy included herewith) Please note that the consumer is still using the address to which prior validation was sent prior. Given these findings, this office will be unable to comply with the consumer's request to delete this from the credit reporting agencies. I was looking at my credit report and I noticed FMS Financial Solutions is reporting to my credit. I found out that FMS Financial Solutions is NOT BBB accredited, but is owned by Financial Management Solutions, LLC which IS BBB accredited. I dont have a contract with either one of them, and *** never received a debt validation letter from them. They are falsely reporting to my credit because Ive never heard of them or even knew they existed. They never sent me a contract to even sign and I do not owe a debt to 222 Saratoga.Business Response

Please be advised that Financial Management Services (***) is a licensed third party debt collector acting on behalf of creditor; Saratoga Apartments. The debt is owed to Saratoga Apartments and not to ***. Please now refer to the attached documentation in support of the debt. The application originally submitted by the consumer listed his name as, ******* Nyakeh ******. As is customary, the lease was prepared using the first and last names as they appear on the application. In this case ******* ******. Also attached are the first and signature pages of the joint lease with co -lease holder, ******* ******. The consumer may have signed the signature page as either (first name) ******* or Nyakeh - its not completely clear. However, as the consumer has indicated both as first names in various written documentation, its clear this is the correct consumer. The ledger (not included) indicates that at move out there was a balance due in the amount of $5,295.08. There have been no payments on that balance -which remains due in its entirety. I am rejecting this response because: it fails to address the core issue: they are reporting false and inaccurate information on my credit ********* be clear: I have never entered into any agreement or contract with this company. I have never received any correspondenceno letters, no phone calls, no emailsfrom them. I have never contacted them or acknowledged any debt related to them.
Despite this, they are reporting derogatory information to the credit bureaus, which is damaging my creditworthiness and reputation. This is a clear violation of both federal and Maryland state consumer protection laws.

Furnishers of information to credit bureaus are required to report only accurate and verifiable data. Reporting unverifiable debt or failing to correct false information violates the FCRA.
2. Maryland Consumer Debt Collection Act (MCDCA), Md. Code ***., Com. Law 14-202(6)
Debt collectors may not claim, attempt, or threaten to enforce a right they know does not exist. Reporting a debt without any proof of a relationship or obligation falls into this category.
3. Maryland Consumer Protection Act (MCPA), Md. Code ***., Com. Law 13-301
This statute prohibits false or misleading representations, and deceptive practicessuch as reporting false credit information.
If Financial Management Solutions cannot provide documented proof of legal authority to collectthen they must immediately remove this information from all credit reporting agencies.
If this matter is not resolved promptly and the inaccurate reporting remains, I am prepared to pursue legal action to protect my rights and seek any remedies available under the law.

I was living at the ************************ in ********* ********. I had issues having maintenance done on several separate occasions, The ceiling gave out and holes were now allowing water to leak into the drywall. There was a damaged door that was never repaired I even placed those orders after my initial inspection. It took three months to have the first hole repaired the front door was never repaired and being I paid my rent in advanced. I thought surely things would look up and they never did. The Second hole in the Master Bedroom would leak rainwater in the room when I called to request it to be repaired maintenance came and never fixed anything. After several months of dumping the bucket, they provided me and still no progression on repairs I chose to leave the apartment after my rent was put in escrow which they knew about. They never fixed the roof because six months after moving I went by and the same 2x4's and tarp were still over the area of the roof with the leak which I have photos of. The complex then sells my debt to a company I do not hold a contract with. I was never evicted and have every plan to prove that I do not owe this debt as they broke the leasing agreement by the apartment not being habitable and my safety concerns not taken seriously.Business Response

I wish to claim that as we have never entered into a contract, I am not responsible for the debt associated with FMS FINANCIAL SOLUTION. I must stress that I have not voluntarily committed to any financial obligations with them. To further resolve this matter in a proper and open manner, I formally requested from ARDEN POINTE the production of the original contract pertaining to this specific debt. Unfortunately, even with this request, they have not responded to my question by sending the needed records. That is not my address nor does it have an apartment number for that mail to reach me. Furthermore this collection was removed from other credit bureaus years ago. Experian is the only company reporting this collection. On top of that rental collections go into affect *************************************************************************************************** 2021 on the paper they sent notice was given 12/31/19 and wouldve gone into collection January of 2020. Which goes into the question of if this collection was sold.

Per my research Financial Management Solutions, LLC is a debt collector falsely attempting to collect a debt that isn't there's. I have requested that Financial Management Solutions, LLC provide proof of alleged items. I request to be provided with specifically the original application, contract, note, or another instrument bearing my signature with Financial Management Solutions, LLC. March 5, 2023 ****************** ********************************* Laurel, MD ********** Name of Creditor collection agency: FMS Financial Solution *****************************************Greenbelt, MD ******** RE: Acct # ****** To Whom It MAY Concern: On January 10th 2023, I wrote to you requesting validation and an investigation into items that I believed were inaccurate. To date, I have not received any such validation. In my previous request directly to you, I listed my reasons for disputing the information and requested validation. Since this is my second request, I will also be sending a copy of this letter to the Federal Trade Commission notifying them that I have signed receipts for letters sent to you and you have not complied with my request. I regret that I am being forced to take such action. Please note that on 3/20/2019 the CFPB released its Fair Debt Collection Practices Act Annual Report and it stated the following: "The Bureau notes that one or more debt collectors continued collection activity despite not properly obtaining and mailing debt verification after a consumer exercised his or her *1692g rights. Specifically the Bureau calls out the practice where “debt collectors forwarded consumer debt validation requests to the relevant clients, who mailed responses directly to the consumers. Section 809(b) of the FDCPA requires a debt collector, upon receipt of a written debt validation request from a consumer, to cease collection of the debt until IT (meaning the collection agency) obtains verification of the debt and mails it to the consumer. Examinations found that one or more debt collectors routinely failed to mail debt verifications before engaging in further collections activities. Instead, one or more debt collectors forwarded consumer debt validation requests to the relevant clients, who mailed responses directly to consumers and the debt collectors then continued collection activities on accounts in violation of section 809(b) of the FDCPA.” Failure on your behalf to provide a copy of any alleged contract or other instrument bearing my signature may result in small claims action against your company.
