    Complaint Against: Merrimack Engineering Services, Inc.Surveyor: ******************* Phone number: ************** / ************** email: *************** Date of Contract: July 2024 In July 2024, I hired Merrimack Engineering Services, Inc. to provide a certified land survey required by my town for a home extension. The agreement, provided by *******************, stated that the work would be completed within three weeks meaning by August 2024.Unfortunately, the survey was significantly delayed. As a result, I lost my original contractor, who became frustrated and took other jobs. My building permit also expired during this time, requiring a new application and over $4,000 in additional fees.After several months, I found a new contractor. By then, the survey work had been completed, but it had not been certified or stamped. Since then, Ive made numerous attempts by phone and email to contact Mr. ******* for the final stamped survey and invoice. My new contractor also contacted him. Each time, I was told, Ill get to it, or Ill finish it next week. Still, no progress has been ********, more than a year after signing the contract, I am still waiting for what should be a simple final step. I fear this delay may cause me to lose another contractor and be forced to renew my permit again at additional ******* my knowledge, the technical work is done only certification is pending. I cant understand why the stamp hasnt been issued. Theres been no clear explanation or justification for this *********** seeking help resolving this matter.     Mr ******* was not aware until I contacted him after he filed this complaint, that in November of 2024 we interacted with  the town Staff and was able to develop a plan that would address their concerns.  We emailed his wife and contractor (our project contacts) to have the designer of the building revise the plans to meet the requirements of the Town, and resubmit those back to us and the Town.  Once those plans were revised we would revise our plans and submit the final plans to the Town for permitting.  The designer did not revise the plans and did not send them to us.  We also advised that before final stamped drawings were provided that our invoices for work must be paid in full.  One invoice was outstanding since June of 2024 and the other since September of 2024 and as of the date of the complaint were unpaid.  We do not submit or provide stamped plans until invoices are paid in full. It appears to be clear that the complaint was filed to force us to transmit those plans without  being paid.

    Subsequent to the complaint and my contact with him, he provided us updated designer drawings, which still did not address the Town issue of drainage, so it is doubtful his wife or contractor ever advised the designer of the required changes, but we revised our plans to reflect other changes that had been made to the drawings, not related to the Town issue.  We provided copies of those to him and his contractor, and he paid the outstanding invoices.  We than provided him the signed and stamped plans.

    My understanding was that Mr ******* was to remove or revise the complaint, which apparently has not been done since he has the plans requested and has paid his invice.

    I hired this business to draft and submit a notice of intent to the *******, MA conservation commision so that we can do work in our backyard. I paid them $1600 and the check was cashed in mid April 2024. The persons name whom was going to do this work is ******* *********. He routinely does not answer calls, return calls, answer texts, or return emails. In September I emailed him stating that if I didn't get a reponse I would have to start the process of sueing him. This seemed to spook him and he immediately respnded saying my emails were going to his spam folder (yea right!). He said he was traveling but he would finish it when he returned the next week. That timeframe passed and he said on several other occasions that it was almost done. It is now November and he will not return any messages. I spoke to a lawyer that said the evidence I have would be a shut case against him but I want to avoid that process. All I want is for him to submit the paperwork. It shouldn't take more than a days work considering he cashed my check in April.

    The Notice of Intent was submitted to the Town. Mr ****** had advised us he was going to withdraw his complaint. The delay related to revisions required to the site plan to meet Town Requirements and obtaining a certified abutters list from the Town who was having issues with their system. His hearing is scheduled for his project.
