      Joined this fitness center in January of 2025, based on an add that stated no contract membership. In July of 2025 when I requested to cancel my membership, I was told that my membership was under a twelve month contract. I was told that because I chose to select the senior citizen membership, I did not have a no contract membership. The only two options I was given was to continue my membership through January 2026 or pay over $300.00 to get out of a contract that they did not make clear that I was signing.
      My wife and I made it clear, that because of her multiple medical conditions, that we were not sure if she would be able to effectively use their facilities and that the no contract membership advertisement was the only way we could consider a membership. Because of my wife’s age we qualified for a senior rate. At no point was it made clear to us that to get the senior rate we would have to relinquish the no contract advertised promotion.
      As we had feared, health issues have kept my wife from routinely using the facilities, and now we would like to cancel our membership.
      I have attached a copy of the advertisement that clearly states “NO Contract & $0 Registration fee available on all new memberships during the month of January”
      I started a new membership in January and they should stand behind their word.

      To the Better Business Bureau,
      Thank you for providing us the opportunity to respond to this complaint regarding a recent membership with North Cypress Fitness Center.
      The member in question participated in a promotion that advertised a $0 enrollment fee and a no contract membership. When the prospective member met with our staff to review available options, two choices were presented:
      A no contract option at a rate of $129 per month.
      A 12-month contract option at a discounted senior rate of $79 per month.

      Both options did indeed include a $0 Enrollment Fee
      The member chose the standard 12-month contract option for $79 per month after this information was fully discussed. Attached to this response is a copy of the member's signed membership agreement, which outlines the selected term and rate. At all times, our staff provided full details regarding the terms, rates, and differences between the contract and no contract options.
      We believe our process was transparent and that the member was given the information necessary to make an informed decision. Should further details or clarification be needed, we are happy to provide additional documentation or communicate directly with the member to resolve any outstanding concerns.

      I am rejecting this response because:
      Their add clearly states “all new memberships”. Please see attached copy of their add. If “all” doesn’t mean all, what does it mean? 
      In addition, my wife and I selected to pay extra to have access to both of their facilities. The member of their well trained staff was sure to inform us that, in the event that we decided to drop the option to use both facilities, that would constitute a change in our membership and, as a result void our participation in the promotion. 
      The only promotion we thought we were participating in was the no fee and no contract for all new memberships. 
      The bottom line is, their add clearly states no contract and $0 registration fee on all new memberships. Our membership was a new membership, and as Mr. Avery admitted in his response North Cypress had no problem honoring the $0 registration fee and they should also honor the rest of their advertisement. Nowhere in the add, as you can see does it list any limitations other than a new membership started before the end of January 2025. I expect this business to act in good faith and stand behind their word.

      Prior to the member signing the membership agreement for our standard 12-month membership, they were presented with two different options. These options are presented on the previously attached "closing sheet". When presenting these options, our membership team works off of a script in order to avoid any confusion on the prospective members part and our membership teams' part (if the prospective member does not join that day):

      "Currently we have two memberships to choose from. We have our No Contract Membership and our Standard Membership. With the No Contract your initial fee is $0, and dues are $129 per month. We also have our Standard membership; this is the option most members choose. Let me explain why. When you join today and we are completely waiving our normal $200 Enrollment Fee making it $0! Couple membership is normally $109 with our senior discount you pay only $79 per month! Earlier, I mentioned that club enhancement fee which is a fee of $69 or $49 that all members pay when you join and reoccurs every September 1st for as long as you are a member. Both of these options include everything we talked about. The difference between the two is with the standard we do ask you to stay around 12 months. After the 12 months you go month to month at that point but stay at the $79 rate for as long as you are happy with us. Out of these two options, which do you want to go with today?"

      Furthermore, while the member is signing the attached membership agreement (which does state that it is a 12-month membership) a script is read explaining the membership: "The next thing I will ask you to do is look over this, it is touchscreen, you can use your finger to scroll up and down. You can hit sign whenever you are ready. The top portion is all your personal information, if you would verify and make sure that it looks correct. The bottom has to do with the membership, it's basically going to say what we just talked about, where it is 12 months, we will set you up on automatic draft system on the 1st of every month, again the Enhancement Fee will be due today and every September for as long as you stay with us. After the 12 months are up it does not automatically cancel you just roll month to month, and you will stay locked in at the $79 rate for as long as you are happy with us. When you are ready to cancel after the 12 months come in on or before the 25th of the month, basically give us a weeks' notice before the payment is scheduled to come out. Once you sign our resignation form, we will take your payment method off the books that is when the last month dues we ask for up front today will kick in and apply. 

      The entire process is scripted out and said more than once to avoid situations like this.

      I am rejecting this response because:

      While I totally understand what you described as your normal approach to signing new members, my decision to join was based on my belief, as stated in your add, that I was not being governed by a time specific contract. Your entire rationale is trying to make the fact that your add states “all new memberships”. It specifically does not in any way shape or form even suggest that a new membership started in the month of January, 2025 would not qualify for no contract. 
      Both of your statements describe a sales pitch that gives a potential new member a choice of contract or no contract. Your add, which I again have attached, on its own merits takes away the need for a choice. Do you deny that your add clearly states “You read that right! NO Contract & $0 Registration fee available on all new memberships during the month of January.” The fact that we are having this conversation is undeniable proof that you are not acting in good faith and are following less than ethical and honest advertising and overall business practices. Is your organization in such dire straits that you have to resort to deception?  
      Please explain to me why you had no problem standing by the $0 Registration fee, but let someone try to hold you to the no contract promise and it’s a full stop no. Then comes the fast as lightning print of a signature capture on an electronic device that the member does not know how to navigate. I signed the screen of an electronic device agreeing to the terms outlined by your advertisement and discussed with your agent, which again are No Contract & $0 Registration fee, agreeing to abide by your rules of conduct, and authorizing your access to draw monthly dues from my bank account. Again, if you’re agent did not represent this transaction as being in accordance with your entire advertisement, why did he counsel me about losing the promotional terms if I decided to drop the ability to use both of your facilities because that change would constitute a termination of the original agreement and start of a new agreement? 
      What makes this worse is that my wife and I explained to your agent that the no contact add was the catalyst for us to inquire about membership. We explained that my wife was beginning to recover from years of health issues and had doubts about if she would, from a medical health standpoint be able to benefit from a membership. As it turns out our reservations proved true and she has not been healthy enough to go to the gym and benefit. 
      So no you’re agent did not make it clear multiple times that I was agreeing to a year long contract, to the contrary I made it clear that I was opposed to a time based contract

      Thank you for the opportunity to provide additional clarification regarding Mr. *********’s complaint about his membership at North Cypress Fitness.
      We understand and appreciate the concerns raised regarding our January 2025 promotion referencing “NO Contract & $0 Registration fee available on all new memberships during the month of January.” For accuracy and transparency, allow us to detail the membership options and sales process in place at that time, as well as what was communicated to Mr. ********* during enrollment.
      Membership Options and the January 2025 Promotion
      During January 2025, our promotional advertisement made both a No Contract Membership option and a Standard 12-Month Membership option available to all new members:
      No Contract Membership: $129/month (no enrollment fee, cancel anytime).
      Standard 12-Month Membership: Discounted senior rate at $79/month (no enrollment fee, but requires a 12-month commitment).
      As attached documentation and the “closing sheet” provided in this case confirm, prospective members—including Mr. *********—were presented both membership options. Our staff is specifically trained and follows a script to explain both choices clearly, confirm understanding, and answer any questions. Choosing the discounted senior rate necessarily involves agreeing to a 12-month contract; in return, the monthly dues are significantly reduced compared to the no contract option. This was presented as a choice without pressure, and any member electing the no contract option would have paid higher dues but had full cancellation flexibility.
      Clarity and Documentation
      Mr. ********* and his wife met with our staff prior to joining, at which time both options—including the specific terms, rates, and distinctions between no contract and standard memberships—were explained. This is standard practice to avoid confusion and is reflected in the attached membership agreement, which both Mr. ********* and our staff signed electronically on January 9, 2025. The signed agreement clearly states that a 12-month contract accompanies the discounted senior rate, and our process involves reviewing this information both verbally and as part of the digital signature process.
      Addressing the Advertisement Language
      The intended meaning of the January 2025 advertisement was that all potential new members were eligible to select either a no contract or contract option with the $0 enrollment fee—depending on their preference and needs. The standard membership with the discounted senior rate always requires a 12-month commitment, a condition that was clarified during the sales discussion and documented on the agreement Mr. ********* signed. At no time were contract-based limitations obscured or withheld; the membership type, term, monthly rate, and cancellation terms were discussed and documented as part of the sales process.
      Resolution Efforts
      When Mr. ********* requested cancellation in July 2025, we reiterated his options:
      He could pay the difference between what he would have paid under the no contract option since January, allowing him to convert to a month-to-month basis without additional penalties.
      He could continue with the original 12-month membership through January 2026 at the discounted rate, as per the agreed contract.
      We believe these options were fair and consistent with our stated policies and efforts to accommodate the member’s situation.
      Closing Statement
      We strive to uphold full transparency in our membership sales process, providing every member with clear choices and access to all relevant information prior to enrollment. Our staff followed policy and confirmed the chosen option and its terms. Should the Bureau or Mr. ********* require further clarification or additional documentation, we are prepared to assist.

      I am rejecting this response because:

      First let me ask a few simple questions. 
      1. Are the copies of your adds that I have submitted been complete and unaltered?

      2. Did the membership in question begin during the month of January, 2025?
      3. Have my wife or myself ever had a membership with North Cypress prior to January, 2025?
      4. Does my membership give me access to both your Hammond and Ponchatoula locations?

      5. If everything went as you have speculated, you were not part of the conversation, why did your staff member warn my wife and I that dropping the access to your Ponchatoula location would represent a change in membership and therefore end our eligibility to the promotion?
      6. Is there any definition of all that means part of, only some, only this one or that one; but not both, or as you have asserted applies to Registration fees but not memberships?

       The answers are quite simple.
      1. Absolutely authentic and complete. Taken directly from your Facebook add  

      2. Yes  I think it was 1/9/2025.

      3. No. This was definitely a new membership.

      4. Yes, your membership does include both locations.

      Now they get a little tricky for you. Because either your staff member was not as thorough as you would hope. Or, you have to admit that your advertisement was inaccurate or deceptive.

      5. I will have to let you decide this one. But, based on conversations that I have had with many of your current and former members and staff members. My opinion is that your add worked exactly as you intended. Classic bait and switch.

      6. Of course not. But you don’t care.

      If the intended meaning of your January 2025 advertisement was that potential new members would have the option to choose contract or no contract then you should not have used the word “all”.

       You also mention that the choice between a contract and no contract membership is standard practice. The conversation that I had took place because of your add and therefore predicted on the existence of your add. You ran the add I read the add and acted. Now you are refusing to stand behind what you advertised.
