02/01/2024 I arrived at a parking lot. There was one other vehicle. I parked and went to the machine to pay. The machine had an issue and read "use another machine". I looked around and there was not another machine. I am not set up to use my phone for payment so I crossed the street to ask the store that was there. I waited on the person in front of me to complete there order and then asked the clerk. He said, they are booting you now. When I returned, the guy said I watched you and waited for the payment to go through and it never did - I was gone all of three minutes. This is clearly bating and entrapment. If the machine does not work, there should be a ***** of at least 5 minutes so it can be sorted out but beyond that, if the boot company has someone literally sitting in the lot watching, the least they could do is come out and assist.Business Response

I did not pay for parking because the machine would not accept my payment. I wasn't even able to ask the store clerk if he knew of another machine before you guy started with the boot process. I was parked in the lot for less than 5 minutes total - and that includes the Boot Employee running my credit card and me quietly freaking out in my car due to the insanity of the situation.
So, the machine doesn't take payment, I am not set up to make a virtual payment, the Boot Employee watched as I was obviously trying to pay - he told me so - and then booted me as soon as I walked across the street to ask for assistance/knowledge of the situation. He could have easily asked if there was an issue. I was literally at the machine with cash in hand trying to get it to take it with no luck. I have attached the Credit card receipt and the Boot receipt.

Signs are posted on this lot offering other payment methods available in case the machine is down. This parking lot does require payment in advance.Customer Answer

I am rejecting this response because: I had money in hand, visible, and your guy just watched as I struggled to pay, shoving it in and out of the machine, because the machine was broken - he even told me that he had watched me. That is the problem! I understand that you have signs and other methods of payment. I took a picture of the sign to use to pay but I could not use that other method until I got stable wifi - by the time that happened, your guy had already booted me. How can you watch some one with cash money in hand trying to pay and then boot them when it doesn't work fast enough. Not all of us are 20 years old and tech savvy individuals, it takes some of us a few extra minutes. I was literally in the spot less than 5 minutes from the time that I parked, tried to pay and got back to the car and paid for the boot - that is not long enough ( it takes me this long to pull up my calendar to schedule an appointment - and I do that all of the time). And since he was watching, he knew that I had not walked down the block or anything like that. So you have a guy in a lot with a broken machine that doesn't attempt to help the people trying to pay and instead boots the vehicles super STAT. Shame on you!
Sincerely,

I paid $25.24 for 1 hour time at the restaurant. Was booted due to the transaction hitting your que late. I explain once ******************* arrived. He charged an additional $108.25 to removed the boot and challenged me to dispute. Saying that, nothing will happen & the owner would not care that he over charged me. No cost or information at all was written on the sticker so he may have over charged several other customers which could create serious altercations. I am awaiting a resolve from the owner.Business Response

Our records indicate that payment was not made until 25 minutes after vehicle was booted for non payment. All of our signs are posted stating parking fees must be paid in advance. If you can show proof from your parking receipt and/or bank of the exact date and time payment was made showing your vehicle's information and tag # please provide that and we will look further into this for you. The screenshot uploaded is a text confirmation at 8:16 again which is 25 minutes after the vehicle was booted.Customer Answer

Signs are posted on the lot and parking fees must be paid in advance. The receipt shows parking fees were not made until 25 minutes after. Therefore, the additional parking fees were waived and you were only charged the removal fee.Initial Complaint

September 28, 2023. I paid for parking in a lot in ***********. When I got back to my truck there was a boot on it. Boot Man claimed I took two spots. My truck is a common vehicle, an F-250 with a crew cab and a 6 1/2 ft box, and it is longer than the marked parking spots so the truck will stick out either on the front or on the rear, I chose to keep the front out of the traffic lane. The issues: They put a boot on my truck, the documents say it is for unpaid tickets. I wasn't given a ticket. The value of the alleged ticket would have been $10. They charged $100 for the ticket and boot. 1) I believe their process of the boot before the ticket is illegal. 2) Locking up a $50,000 vehicle for a $10 dollar dispute far exceeds a reasonable action for the value of the dispute. 3) The literature says the site person can settle the dispute, the site person said he didn't have that authority. I had no recourse at the time other than pay the $100. 4) The Electronic payment device did not have an option or definition of what an oversized vehicle is so it was a judgement call by the guy who put the boot on. Boot Man Inc in Nwe Orleans was not listed so this should go to the location who can respond.Business Response

Paid parking in app according to sign I drove up to. Apparently theres 2 different companies in same parking lot but the one I parked at you only see the sign in front my vehicle. There were multiple cars booted in same area so its obviously a scam and the company isnt changing anything.Business Response

We parked and paid on the premium parking app. When we pull up that is the lot GPS tells you that you are in. I come back to a boot on my car as did several other people in our row. The signage is unclear and very deceptive. We were parked in a row that belongs to another company, premier parking that had nothing posted differentiating the lots. Premier parking had the sign posted about the boots, and they used colors matching their competitors signage (premium parking) so that it looks like one lot. Its definitely an unethical business charging exorbitant rates to get the boot off and purposely confusing consumers, most who are tourists. The guy who took my boot off was even bragging to a friend on the phone about how much he collected today.Business Response

Hello,I'm requesting the help from the BBB in getting a refund from an unfair charge I had to pay to get a boot removed from my car, even when I paid the parking spot through the app -ParkWhiz-.On Nov.02/2023 I parked my car in an small open parking lot, when I was leaving I found my car with two boots impeding my car to move, I called the # left on a sticker and asked the guy the reason my car has been booted, he responded, "because you didn't pay", I showed him immediately the two payment transactions I have done earlier for what he didn't pay too much attention and said something like "your car is now booted and you need to pay to get the boots removed, if you want to dispute on the receipt is the information to do so".Certainly I was very upset, it was already around 1 or 2am on Nov.03, everything was closed, I wanted to go home and I had an option to get my money refunded.I emailed this company, provided the receipts and I haven't received an answer after more that a month, I claimed with the bank and they can't help me either, I'm relying on the help of the BBB.Thanks for your help and attention.Business Response

Parking fees were not paid until 30 minutes after their Tesla SDZ4052 was booted for non payment. The license plate is also incorrect as they paid for license plate # *******. The attachment they provided does not show the time or the license plate # that was paid. We have the receipt the cardmember provided showing the time and license plate. ******************** fees must be paid in advance. There are parking rules posted on the lot and the parking rules are in accordance with city ordinances. No refund is due.Initial Complaint

Dec 1, 2023 Amount paid: $75.00 I was parked in a parking space available to customer and workers of the building belonging to address, ***************************************************************. I was a customer at the building located above. My car was incorrectly booted and this company booted my car and would not remove the boot and demanded I pay the money to remove their boot. The booting agent ***********************, rudely told me to email his manager and he also told a lie of his manager was the one who booted and saw me leave the lot. The rules for what is a parking violation are not plastered on a sign on the lot nor were they told to me before or after getting a boot on my car. These parking violations seem to be at the companys discretion which leaves openings, perhaps unbeknownst to the company, for customer exploitation. I have contacted the owner/manager of this company, who also rudely laughed at me and accused me of doing something which I did not do (leaving the lot to go do something else) when he wasnt even at the lot at all! I was made fun of, lied to, and accused and wrongly charged and would like my money returned to me and issued an apology for being wrongly treated.Business Response

Paid a man outside who was directing traffic. He led me into the parking spot and told me it was $25. I took a picture of my license plate and the scan to pay. He told me it wasnt working so i paid him. I come back out and see theres a boot on my car. Explained the situation to ***** but he said i was scammed by a homeless man. I asked why they dont have security if things like this happen all the time. He wouldnt help me out at all.Business Response

I would like to inquire about investigating Premier Parking Enforcement. My friends and I went to lunch November 2, 2023 at **************** located at **************************************************. When we left the restaurant we found that our vehicle had been booted. We called Premier Parking Enforcement to have the boot removed and showed the guy that we had paid for the parking. He asked for a receipt. There was no receipt but it was clear that we had paid as we had the confirmation. After much back and forth we were told that the only thing we could do was pay the ticket which was $134.23 and we would have 2 weeks to contest the ticket. Clearly these practices are unethical and this is a scam to get money. Obviously there was some type of glitch with their system (intentionally or unintentional?) and they are preying on people because what else can you do except pay or you are without a vehicle. I would really appreciate you investigating this matter. Please see photos that verify my complaint.Business Response

10/18/2023 Reason: Ticket #***** ************************** ******************************************************************** C. ************ To whom it may concern,This letter is regarding the boot placed on my vehicle 10/18/23 at *******************************************************************************, work at the ************* and I have been parking at this lot since being an employee at the *************. I have/do follow the same steps, which is park, pull up app and input my payment information, and start walking to work, which is across the street from the lot.A boot was placed on my car today, and the reason given by the attendant is because I walked away from my car before payment was posted. Never heard of such a reason, nor are there any signs posted anywhere where it clearly states do not walk away from your car until payment has gone through. I showed him proof of payment via my receipt and **** card transaction. Time on payment receipt say 10:19am, but the transaction posted on my card 9:19am because thats when I swiped card for payment. Why there was a delay between payment through app and card, not sure. Boot ticket has a time stamp of 9:15am. How is a boot placed on my car @ 9:15am, when card was processing payment @ 9:19am? I asked the attendant to show me where it states I have to remain by vehicle until payment has posted. The pictures Ive provided doesnt state anything like that and again this isnt my 1st time parking here or paying as instructed.I am requesting a refund of $108.25 and applicable fees and/or further clarification as to why a boot was placed on my vehicle even with my proof of payment and receipt.Person who authorized the booting: ************************************************************************************************** ********************* ************ ************ Boot Man, Inc. d/b/a Premier Parking Enforcement ************************************************************Business Response
