Took out a loan on 12/19 for 2518 someone at this location called me on 1/18 to remind me to make my $402 finance payment I specifically asked her was there any way to avoid additional finance fees as I know I would be able to payoff the loan on 1/23 she lied and said if I made the current payment the additional finance charges of $402 would not be applied to the account by 1/23. Of course that wasn't true when i went to pay yesterday costing me an additional $402 just 3 days later. Had she been honest I would have made alternate arrangements to get loan paid on the 18th. Additionally when I questioned them about the information I was given they lied again and stated there was no record of them even calling me which of course I have on my phone. So she told another lie to cover up the first lie. Contacting corporate is also a joke was on hold for almost an hour no one ever came on the line. This company is clearly still using predatory practices to get more money out of people. I can accept the truth but lies have no place in business.Business Response

Inc. d/b/a TitleMax (“TitleMax”)
Ms. ********** complaint alleges "someone at [the
TitleMax} location called [her] on 1/18 to remind [her] to make [a] $402
finance payment [.] [She] specifically asked [the employee] was there any way
to avoid additional finance fees as I know I would be able to payoff the loan
on 1/23[.] [The employee] lied and said if I made the current payment the
additional finance charges of $402 would not be applied to the account by 1/23.
Additionally [,] when I questioned them about the information [,] I was given
they lied again and stated there was no record of them even calling me which of
course I have on my phone. So [,] she told another lie to cover up the first
lie. This company is clearly still using predatory practices to get more money
out of people. "
Ms. ********** entered into a 30-day Pawn Transaction
(the “Agreement”) with TitleMax on December 19, 2022, in the original principal
amount of $2,518.00 (the “Pawn”) and pledged the 2019 Nissan Sentra (the
“Vehicle”) as collateral. Pursuant to the
Agreement, she agreed to pay the entire balance due on the Pawn on or before
the due date of, or, to the extent you chose not to repay the entire balance,
you could, at a minimum, pay the pawn shop charges and renew the Pawn for an
additional thirty (30) days.Pursuant to the Agreement bearing her signature,
“You promise to pay
Pawnbroker, or to Pawnbroker’s order, the principal sum of $2,518.00 plus a Pawnshop Charge in the
amount of $402.62 with the total amount of $2920.62 (being the amount to redeem
the Vehicle) due and payable on 01/18/2023 (the “Maturity Date”).” “The
Pawnshop Charge shall be deemed earned, due, and owing as of the Pawn Date.”
Based on TitleMax’s point of sale system, the account
was accurately assessed the Pawnshop Charge for $402.62. Further a payment of 2,290.63
was made on January 23, 2023, via the online customer portal. This payment allowed
Ms. ********** to meet her obligations according to the Agreement and pay off
the account.
Based on the above, my investigation reveals no
wrongdoing on the part of TitleMax. We show no record of the above-mentioned
conversation with the employee and Ms. **********. However, TitleMax strives to
maintain excellent customer service and appreciates all feedback from its

My husband went to the TitleMax at 71 Uvalde Rd to obtain a title loan and it was given to him. Approximately $4600. When I became aware of this I called several TitkeMax locations to determine what the process was for obtaining a loan and I looked at their website. I was told by 3 different TitleMax locations that both parties on the title had to go in person with proof of identity and I read on the website that proof of income was also required. My husband does not work so he has no proof of income and I did not go with him to obtain this loan. I tried discussing this with the manager who was not helpful and quite rude. I don’t feel like my husband would have gotten this loan if the process that is in place would have been followed. It makes me angry that I now must pay this loan or lose my vehicle.Customer Answer

to TitleMax of *****, Inc. d/b/a TitleMax (“TitleMax”)Within the complaint to the Better Business Bureau,
Mr. **** alleges asked his son to “take a $400.00 payment in on [his] loan with
[TitleMax].” Mr. **** also claims “because [he] didn’t go online and sign for
the payment made [his] account is now delinquent $157.00, and that $400.00
payment went to nothing and is just gone.”TitleMax has investigated the allegations in the letter
and the investigation reveals no wrongdoing on TitleMax’s part. According to TitleMax records, all Mr. ******
payments have been applied correctly to his account. Regarding Mr. ****** allegation of his
account being “delinquent $157.00”, there is nothing to support this. Mr. **** originally entered into a 30-day
transaction with TitleMax acting as a ****** ******** ************ (“***”). At the end of the thirty (30) day term, the entire amount of
the Loan becomes due and owing, as outlined in the Loan Documents. To the
extent he did not wish to repay the entire balance he could, at a minimum, pay
the *** Fee and interest and refinance the Loan for another thirty (30) days
and enter into a new *** Contract with TitleMax and a new Agreement. Mr. **** elected to refinance his loan. As indicated in the *** Contract, in order to
complete the refinance, Mr. **** was to “meet all of the conditions for
obtaining a renewal on or before the Payment Due Date”. These conditions were not met as Mr. **** did
not complete and sign the loan refinance documents ultimately causing a late
fee. On December 13, 2022, Mr. **** was
instructed by store personnel to visit the TitleMax where the loan originated
to complete the process of the refinance. To date this has not been completed
giving TitleMax the right to execute any remediation per the Loan Documents and
Agreement.Based on the above, TitleMax has acted
appropriately in the handling of Mr. ****** account and no wrongdoing on the
part of TitleMax is found. Nevertheless, we remain committed to provide him
with excellent customer service and highly encourage him to reach out to the
store location where he originated the loan and store personnel would be more
than happy to discuss payment options and answer any question she may have

I took out a loan with ******** against my car. I have been making payments on that loan. My tags expired in August and I went to *** to renew those tags. *** stated to me that there was a repo on my car and that they could not renew my tags. I was not aware of that so I contacted my local ******** in ***** *******. ****** is the one who assisted me and she has always been extremely rude and condescending to me, I asked her about it, and she stated to me that it was their mistake, and she had sent the paperwork to ***********, *** to get it fixed. A few days later, I contacted ****** again and asked her if it had been taken care of, she stated to me that it had been . I went back to *** ** ***** ******* and waited three hours in line only to be told that the repo is still there. I contacted ******** again, and ****** laughed at me and then proceeded to ask me. “well, I sure hope you haven’t been driving the car since August. How have you been getting a round coat “. I kindly explain to her that it was none of her business and that it was an inconvenience to me and my livelihood that I could not get my tax and that I have done everything I am supposed to do and I expected the same from them. She insisted it was fixed so I called the corporate office. I talk to ******** And she listened to my complaint and I asked to speak to a manager. She refused to send me to a manager and instead put me back in the rotation to customer service. I called back again and spoke to ******** and this time she transferred me to the local ****** ******** . I called corporate a third time and spoke to ******** and she told me there was nothing she could do for me. I explain to her that I had a form the *** gave me and I wanted to have them fill it out so I could take it to *** and get my tags. She stated they don’t do that kind of thing. I have no resolution and I believe they have been overcharging me on my loan. When I ask them for copies of my loan documents, they told me they don’t give paper copies and you would have to get it online. I think they are ripping people off, and I think that they will take the car even if I’ve paid on it. I cannot drive to work, I cannot drive to the store, I cannot drive to my doctors appointments, I cannot take my dog to the vet, this has affected my livelihood, and I cannot get anybody to help me. I am rejecting this response because:
they did not address any of my complaints. And insist that they have done nothing wrong. That is incorrect. And I am not satisfied with their lack of response both times. It’s just an example of the way they treat their consumers. They are at fault for what they did and they are at fault for the way I have been treated. And upon investigation I am sure they are at fault for incorrect billing as well as charging fees every month for coverages that are not needed. I will not let this rest until some thing is done about the employees that miss treated me, the mistake that was made on their end, and their lack of wanting to correct it, and billing issues are corrected. Not just for me that for any consumer.

I was never told repo at this time was considered. ***** went in to say he is not sure when I can get my car though it will be at least four more days. My 27 yr old daughter is handicap with several life threatening medical issues. She is disabled from a car accident. She cannot walk. Every week we have multiple doctor appts and often hospital emergency room admittance. My car has her wheelchair and walker inside. I asked ***** to help me as she is in critical need. ***** stated he will try though the towing place states they are too busy for me to get my car before Monday. Could you please call the towing place or ***** to get my car today please? I have receipt acct was paid and the information of holder of car. I'm in urgent need. Towing is **** 44 min from my home. I have had a Title Loan with Title Max since October 2021 They claims that is is a 36 months loans which means they WANTS YOU TO GIVE 3 TIMES THE LOAN…. pay off is still all the same 2,000 dollar and when I miss a Payment I pay more… The loan was 270.00 a month in which I have been paying 1 year, and more!!! *** has already given out information that they are NOT BBB CREDITED … They are ripping consumers off… The ******** ******* NEEDS TO KNOW… Or ********* ***** , They care less if you are I’ll or what and I do understand that it is a bill … but no other Title company does this When you pay your payment it goes to your bill and not for 36 months when you pay them MORE… I am sick, and having procedures done frequently to better my health and I am only on DISABILITY AT THIS TIME less than a Thousand a month… I am also Epileptic and tired of them stating that My account is still the same amount….

Due To being SICK ??, and NOT ABLE to Work, Title N my ax, will not understand my situation, going back and forth to A Specialist with Problems are far Away, They Have me on a 36 month Loan Agreement that is costing 3 times the amount of the loan, and this is not fair, yet that want repossessed people Vehicle… I have paid on this Account over a Year.. and it is not going down… when I miss a payment I put more on it , now that I am out of work it is very HARD to get it paid, then They suggested you sale your Vehicle ??… Companies like this is REALLY breaking consumers down, not able to pay rent, Light bill or any bill … They needs to be reported to THE ******** ******* AND *********… because they know it will cost a lot for consumers to pay off … And their loan terms are really getting a lot of money out of consumers Thank You ???? ***** *******Business Response

to TitleMax of ***** ********, Inc. d/b/a TitleMax (“TitleMax”).
Ms. ******* complaint alleges “the loan was $270.00 a
month in which [she has] been paying a year and more.” Ms. ******* originally
entered into a thirty-six (36) month transaction with TitleMax, as evidenced by
a Supervised Loan Agreement, Promissory Note and Security Agreement dated October
08, 2021 (the “Agreement”) in the amount of $1,765.00 (the “Loan”) and pledged
her **** ****** *** as collateral. Pursuant to the terms of the Agreement, Ms. *******
was required to make thirty-five (35) monthly
payments of $269.31 beginning on November 12, 2022, and one (1) final payment
of $269.30 on October 12, 2024, to satisfy and discharge her obligations under
the Agreement. TitleMax records show that Ms. ******* elected to refinance the
Loan on August 11, 2022. Pursuant to the terms of the Supervised Loan
Agreement, Promissory Note and Security Agreement (“Refinanced Agreement”), Ms.
******* was required to make thirty-five (35) monthly payments of $264.79
beginning on September 16, 2022, and one (1) final payment of $259.02 on August
16, 2025, to satisfy and discharge her obligations under the Refinanced
Agreement.
The transaction history reflects Ms. ******* made
payments to the loan. However, some payments were late or for less than the
minimum amount due. The Loan is a simple interest installment loan that is
amortized, which means that the loan is designed to be paid off over a thirty-
six (36) month period. A portion of each
payment, if paid on the due date, applies to both interest and principal. At the beginning of the loan, interest takes
up the majority of the payments. As time
progresses, more of each payment is applied toward principal.
Interest accrues daily on the unpaid principal balance
of the loan. When interest accrues
daily on the unpaid principal balance of the loan, if a customer pays late,
additional interest accrues, and if a customer pays early, more of the payment
applies toward the principal balance. Accordingly, Ms. ******* will achieve principal reduction if her payment
is timely and/or large enough to satisfy the accrued interest on the
account.
Based on the above, my investigation reveals no
wrongdoing on the part of TitleMax and do not support this allegation. TitleMax is understanding of its customers’
financial hardships and is willing to work with Ms. ******* towards a mutually
satisfactory resolution. Accordingly, TitleMax
encourages Ms. ******* to contact the TitleMax location with which she is
affiliated, and an employee will be happy to discuss his payment options, or,
if requested, put her in contact with the District Director of Operations.

DEFENSES AND CLAIMS IN RECOUPMENT The right to enforce the obligation of a party to pay an instrument is subject to the following: a defense of the obligor based on duress, lack of legal capacity or illegality of the transaction which, under other law, nullifies the obligation of the obligor. Fraud that induced the obligor to sign the instrument with neither knowledge nor reasonable opportunity to learn of its character or its essential terms. I am attaching here a valid proof of you being a debt collector under the provisions of FDPCA. Title max misrepresented the nature of the transaction and committed fraud. You failed to clearly and conspicuously disclose the finance charge violating The Truth In Lending Act. 10/10/2022 I tried to pay my title loan that I have with TitleMax. Ever since they updated the app I am no longer able to pay the payment through the app. I tried several times to pay the payment with my laptop but it kept saying that the card number I entered was already on file but when I went to see what payment methods are saved to my account there isn't one listed it just says add payment method. I know that I owe them and I am not disputing that fact but I work 3rd shift so when I get home from work I take a shower and go to bed. Sometimes I
will wake up before 7 o'clock at night but sometimes I don't. The only way I can pay the payment is through the app but if the app isn't working correctly and I don't wake up before 7 p m I can't pay the payment. If they expect me to pay the payment on time then they need to fix the app that they changed to because it makes it hard to pay when I don't get up before they close.Initial Complaint

This complaint is in regards to a title loan that I obtained from TitleMax on July 29, 2022. There was a scheduled payment for 30 days after the initial loan was given. The entirety of the loan was $1800. The total value of the car is $28,685.00. The total amount of debt is less than 10% of the total value of my vehicle. I was contacted on 09/26. In this dialogue, I informed the contact from TitleMax that I gained new employment and would make a monthly payment on the following Friday. Although I do understand that the payment was late, the circumstances did not allow me to make it by the due date. I was told that the collection process would begin anyway, regardless of the hardship. The interest on the loan is more than 30% of the principal balance. They were unwilling to negotiate repayment options. My vehicle was allowed to be confiscated while with my two children late in the evening (8pm), leaving us stranded. We spent hours in the parking lot, jeopardizing the safety of me and my children on a Saturday. There was absolutely no one to contact from this place of business to resolve the issue. There is no 24hr customer service contact. The process for handling this debt was very unprofessional, aggressive and hazardous to our safety. Even after a payment was scheduled I was harassed for payment. There were two calls made per day, text and voicemails while at work without any respect for my job. I was not given enough time to settle the debt. This jeopardizes my ability to maintain employment. There were no consumer advocation, by-laws or guidelines in place to protect my safety or rights as a borrower.Customer Answer

This is the requested document attached to this message. In addition to this complaint, there are other details that are vital. This includes not knowing where my vehicle is located. I am on medication that I am required to take for ten days. I have missed my medication twice. Also all of my belongings are in the car, including toiletries, clothing, and vital documents belonging to me and my children. I was told my a tire truck company that my car would be stashed in a remote area until further notice by the TitleMax company. They do not open until Monday morning @ 10am.Business Response

to TitleMax of ******** ***. (“TitleMax”). Ms. *****’s complaint states that
her vehicle was
Ms. ***** entered into a 30-day pawn transaction with
TitleMax. Under a pawn transaction, the entire balance on the pawn becomes due
and owing in thirty (30) days, which is clearly laid out in the pawn agreement
bearing her signature. In addition, before entering into the pawn transaction
or paying any fee or other consideration, a TitleMax employee fully explained
the terms and conditions contained in the agreement to her, including but not
limited to the payment structure, terms, and overall cost of the pawn, and her
signature on the agreement indicates that she expressly acknowledged,
understood, and agreed to abide by the terms and conditions set forth therein.
Rather than paying the balance in full, however, a customer can elect to make
the minimum pawnshop charge payment to extend or refinance the pawn for an
additional thirty (30) days. TitleMax records show that after Ms. *****
received the pawn on July 29, 2022 and did not make any payments on the
account. On October 1, 2022, TitleMax exercised its recovery rights per the
agreement and recovered the Vehicle.
TitleMax records show that representatives were in
regular communication with Ms. ***** regarding the status of her account and
her financial situation. TitleMax has worked with Ms. ***** to attempt to keep
her pawn current including accepting promise to pays and sending payment
reminders. Please note, TitleMax is understanding of its customers’ need and
always views recover of a vehicle as a last resort and will therefore work with
its customers to remain in possession of the vehicle.
On October 3, 2022, Ms. ***** redeemed her vehicle and
chose to refinance the pawn. The current status is up to date and not late.
Based on the above, TitleMax has acted appropriately in regard to your account.
Accordingly, TitleMax encourages her to reach out to the location where she
originated the pawn and its employees will be happy to put her in contact with
the District Director of Operations to discuss the matter further.
