I recently applied On TrueCar and this Dealership came up with the ******* I was interested in. I was contacted by a guy named *******. ******* mentioned that according to true car with all my information with my credit score being at 625 on Equifax, that my down payment would only be $2140 out of the $2500 that I was willing to put down. He mentioned that they were ok with that amount. He then asked me if I wanted to proceed and I told him yes. He transferred me to a different guy named *****, who was the one to work with me on filling out the application. I explained many times that I cannot have my Experian or *********** pulled because I have a few disputes on there and they need to be removed because the lender would not like to see those. I had mentioned prior to all of this that ******* was the only bureau that I was willing to have them pull. They said it was OK, so it was pulled. He came back to me and said everything was looking good. He mentioned that my other bureaus were locked, and I explained to him that I could not have those pulled once again. Its like I was repeating myself. He then said he was waiting for the lender that only pulls Equifax to get back so I had to wait over the weekend because it was a holiday. I reached out on an update to find out that I was denied from the lender that uses Equifax, which I find extremely odd because my credit is fine with Equifax. He mentioned that because I didnt unlock the other two, and again I repeat myself once again I told him the lenders were not gonna like what was on there so what would be the difference? What I am upset about was that I was dragged all this way, and I was told something different, so I was pretty much lied to and given hopes to and this companies website says Minimal requirements, 99% approval rate, nationwide approvals, regardless of your current situation Which was just a bunch of bull. I shouldve seen reviews before even applying with them because they have bad reviews.Business Response

Benji Auto Sales does not guarantee financing, we try our best to get all of our customers approved but ultimately the lenders have the final decision. The customer agreed to have his credit pulled.Customer Answer

I reached out to this dealer over 2 months ago as I am due a refund for unused portion of my extended warranty. I was originally told that the rep was working to cancel with their third party vendor and it would take 4-6 weeks.i have since been unable to reach the rep by phone or email. *** called the office multiple times and no call back. When I do by chance reach someone- Im told that they are unable to help me and I should just drive up there in person to get help. I live too far away to drive up there. The lack of communication leads me to feel as though they are attempting to keep my money that is due to me! which is criminal.Business Response

I purchased a used car from Benji Auto Sales on April 1, 2024. Scheduling delivery was a nightmare, but I don't have enough characters to describe that experience. On April 16, I asked the finance ******* when the dealer would issue a payoff for my trade-in. He told me it had been received by lender on April 15. From April *****, I contacted my lender daily to see if they had received it. On April 19, I texted Benjis finance ******* and asked him if he was sure they sent it to the proper address, which I included in my text. He did not respond. On April 22, when my lender still had not received the payoff, I spoke with a woman in the ************************ She told me the check had NOT gone out, but that it had been cut the previous Friday, April 19, and that it awaited signature. She assured me she would send it out that day and send me a tracking number. Later in the day, when I did not hear from her, I called and got her voicemail, which was not accepting messages. On April 23, I spoke with the general *******. Later in the day, I received a text from the finance ******* stating that the payoff had been sent to the wrong lender. He asked for an updated payoff and the payment address. On April 24, I contacted the gen. ******* to ask when the payoff check would go out. He said it would happen that day, that a check had been cut, and he was waiting on a tracking number. By late afternoon, when I had not heard from him, I contacted him again. He said he would have the tracking number by 5:30pm. At 5:50pm, I texted him asking him asking for it. He texted back, 1 minute. I called and got his voicemail.23 days after I signed a contract with Benji, a car that I owe nearly $20,000 on sits on the dealers lot and on its website for sale. The staff at Benji have told so many conflicting stories, and have left me hanging so often, I cant know who if anyone is telling the truth. I want Benji Auto Sales to issue a payoff check immediately and send it to my lender.Customer Answer

I am attaching a copy of the signed *****'s order, which shows that I purchased a 2023 Kia *** from Benji Auto Sales, and they valued my trade-in, a 2023 ****** BZ4X at $28,000. The documents show the payoff due to the lender at $21,400 for VIN *****************.
I am also attaching the text correspondence I had with *********************, the finance manager, and then *****, the general manager, Phone calls took place between some of these texts, including a call with ***** yesterday when he assured me he would have a payoff check and tracking number by 5:30pm, the hour when the Accounting and ****************** closes.
The third attachment shows my trade-in on the Benji Auto Sales website for sale.
Of note, after I spoke with ****** in the Accounting and Titling Department--the woman who told me the check had not gone out to the lender, and that a hard copy awaited signature--I could never reach her by phone. I called multiple times. Once a staff person said the department doesn't open until 10am--when I had spoken with ****** before 9:30 the previous day. Every time I got transferred, the phone rang and rang. When voicemail picked up, it said the mailbox was full.
I called and left at least two messages with ****** at the front desk this week. I never heard back from her. I cannot know if her title or position is real, or whether the conversation with me was merely a diversion to mollify me.
---------------
The ***** character form limited my ability to share full details about my experience with Benji. The pattern of Benji staff members not keeping promises began the moment I signed the paperwork. I provide this information for context and to explain why I had grown weary and suspicious well before I inquired about the payoff. Here is the full version of my complaint that I had hoped to post, minus many of the the dates:
I purchased a used car from Benji Auto Sales on April 1, 2024. Apart from the standard dealership attempt to sell me tire and interior protection and GAP insurance that I didnt need, Benji gave me a pretty good deal on the car and my trade-in. The sales person was helpful, efficient, and attentive. Once I signed the paperwork and they had my money, however, the attentiveness ended.
Benji promises nationwide delivery. For two days after I had signed the paperwork, no onenot the sales person nor anyone in managementcommunicated with me about scheduling a delivery. I then started inquiring. I got assurances it would be scheduled soon.
Four days after signing the contract, and after multiple contacts on my part, Benji still provided no delivery confirmation. I requested to cancel the deal. It was only then that the dispatch department suddenly found a delivery serviceand provided a range of dates when it would be picked up. I requested proof of the delivery order and the name of the carrier. Nine days after I purchased the car, it arrived at my home in the northeast.
When the car arrived, it was filthy. It may have received an exterior wash (hard to tell after shipment from *******), but the body had embedded tar, gunk, and surface scratches, which indicated that no one had prepped the exterior. The cabin had been vacuumed, but the surfaces were grimy and gummy. The cup holder had sticky residue from spilled soda. The hatch floor had sand in it, and the floor beneath the cover was coated in caked-on dirt. I spent hours washing, cleaning, and vacuuming it. I took it to get detailed because the body was so dirty. The car had received no mechanical service whatsoevernot even tire balancing. I have purchased many cars in my life and have never seen a dealer deliver a car having done nothing to prepare it for sale.
Fifteen (actually, 11--April 12) days after I signed the paperwork, I inquired with the finance manager when the dealer would issue a payoff for my trade-in. The finance manager told me Benji had delivered the payoff and that the lender had received it the day before. Over each of the next five business days, I contacted my lender to see if they had received it. After four days of continuing to hear that the check had not arrived at the lender, I contacted the finance manager by text and asked him if he was sure they sent it to the proper address, which I included in my text. The finance manager did not respond.
The following week, I contacted the dealer and was directed to the Accounting and ******************. I spoke with a woman who told me the check had not gone out, but that it had been cut the previous Friday and that it awaited signature. She assured me she would send it out that day and send me a tracking number. I will take care of this so you wont be left hanging, she said to me. Later in the day, when I did not hear from her, I called and got her voicemail, which was not accepting messages.
The next day, I tried again multiple times and could not get through to her. I then asked to speak to the general manager and told him what had happened. Later in the day, I received a text from the finance manager stating that the payoff had been sent to the wrong lender. He asked for an updated payoff and the payment address, which I sent to him immediately. He assured me it would be handled, and that I would receive a tracking number confirming that the payoff check had been sent out for delivery.
The next day I contacted the general manager to inquire when I could expect the payoff check would go out. He assured me it would happen that day. He said a check had been cut, and he was waiting on the delivery service tracking number. By late afternoon, when I had not heard from him I asked if it would go out that day. He assured me he would have the check and tracking number by 5:30pmwhen the Accounting and ****************** closed. At 5:50pm, I texted him asking him for the tracking number. He texted back, 1 minute. I called, and my call got directed to voicemail. I contacted the front desk, and they told me they could not reach the general manager, as they did not have his phone number.
Twenty-three days after I signed a contract with Benji, a car that I owe nearly $20,000 on sits on the dealers lot and on its website for sale. The staff at Benji have told so many conflicting stories, and have left me hanging so often, I cant know who if anyone is telling the truth. At this point, I cannot be assured that this dealership will actually pay off my trade-in without threat of legal action.Business Response

Customer stated that the Lienholder for the vehicle he was trading in was LendingClub, we sent a check to lending club on 4/12. When the customer called stating that the lender had not receive the check we starting investigating to find out the lineholder was Santander and a new check was immediately issued on 4/25.Customer Answer

I notice that the dealership has posted an image of a payoff check in the amount of $20,984.92, along with a ***** label showing it going to *********, the lender.
The Trade-In Payoff Balance per the Buyer's Order was $21,400. I made a car payment in ***** to keep my account current, and thus the payoff the lender gave later in ***** was lower.
I spoke with the Finance Manager about this difference on Tuesday, ***** 23. He said the payoff amount sent to the lender would be for the same amount as the original--$21,400--and that the lender would issue me a refund for the balance. That clearly did not happen,
Benji Auto Sales owes me $415.08. I expect that the dealership will issue a refund, post an image of the check, and include a tracking label here to indicate proof of delivery to my home address.

I am rejecting this response because:I made it clear to the finance manager that ************ originated my car loan, and that Santander serviced it. To blame the customer for this error is typical of the customer service approach ********************** takes. Further, Benji's response takes no responsibility for the conflicting messages, stall tactics, lies, and evasions it uses--which forced me to file this complaint.
I also reject this response because Benji still owes me money, and it makes no mention of it in its response.
While the dealership has posted an image of the payoff check in the amount of $20,984.92 here, it falls short of the $21,400 amount specified in the Trade-Off Balance on the Buyer's Order. I made a car payment in ***** to keep my account current. The payoff amount the lender gave later in ***** was thus lower than the original payoff.
I spoke with the Finance Manager about this difference on Tuesday, ***** 23. He told me Benji Auto Sales would cut a payoff check in the same amount as the original--$21,400--and that the lender would issue me a refund for the balance. That clearly did not happen.
Benji Auto Sales owes me $415.08. I expect that the dealership will immediately issue a refund, post an image of the check, and include a ***** tracking label here to indicate proof of delivery to my home address.

Authorization of payoff signed by the customer clearly shows ************ as lien holder.
A check in the amount of $20,984.92 was sent because that was the 10 days payoff given to the dealership by Santander. Sending an overage causes delays in closing the account.
A check in the amount of $415.80 was mailed via **** to the customer on 04/26/24.

So about a year ago, I bought a car from Benji auto sales. I purchased gap insurance through a third-party company with them and on top of that when reading my purchase agreement, my down payment was not applied to the total amount of the car. The amount finance came out to $24,000. I put $4000 down on the car originally the car was $19,000, so I shouldve been financing $15,000 plus but then they tacked on all these extra things which I never personally got used out of but the main problem at hand. The main problem is that I canceled my gap insurance. I have a prorated refund the company inform me that they sent my prorated refund back to the dealership. Ive been contacting the dealership trying to figure out. How do I get the money the check that the company said for my refund Every time I send an email I send a call. Nobody has the answer for me, but the company said that they have sent out my money and I bet Ive made it very clear that I am leaving ***** soon and I would like to have my money in hand, almost $800 , I sent emails almost every day. Ive called almost every day so I would just like to receive my money as I feel I should.Business Response

We did put your $4000 down payment in your deal its very clearly on the buyer's order if you like we can send you a copy which you received when you purchased the vehicle. As far as cancelling the Gap you must provide a cancelation letter to us in writing in order for us to cancel it with the *********** and also if you cancel and your still making payments on the vehicle the prorated portions Goe's to the bank that did your loan unless you show us proof that you paid off the vehicle. That person that handles this has been in a medical leave and will be back May 10 if you have done all this reach out to us after that day thank you.Business Response

I was working with the dealership to purchase a vehicle on 2/20/24. Salesman and I had come to a price point that was acceptable and wished to move forward, putting down ****** that the salesman said was fully refundable. Upon receiving the financing documents the following day, the price was significantly different than previously discussed. Purchased a car signed the papers on 02/28/24 car was supposed to be delivered and it never was. I have consistently tried to contact the seller to get information about this situation and haven't been helped. I paid $5000 dollars and haven't received the vehicle when I suggested that since I haven't received the vehicle can I just get my money back and they refuse. All I want is the vehicleBusiness Response

The car was in an accident, they told me it wasnt. The car has so many issues with creaking and the passenger window not being sealed. I am not warranty eligible due to it being hit which I was lied to. The undercarriage coverage was pieced together. I lost my savings to buy this dumpster fire. Oh, and the unsealed window, water can permeate!!Business Response
