      Contracted 8mo lease in a "gated property" with "secure parking", "onsite patrol", and "two compliant elevators" in the ************** of Elements on Third on 7/10/2024. Since move-in the property has been uncompliant/breaching our agreement:(Lease Section 25: ******************* No secure parking (gates open, broken) - Not a secure Tower pool (Key FAB entry broken) - Not a secure Tower lobby (both back Tower doors jam, open) - No compliant Tower elevators (both expired and constantly shut down) - No patrol 8/4/2024 - A disgruntled, unkept, man was wandering the lobby halls, swearing. I told him if he did not reside here he needed to leave, he swore at me and quickly left out of the same broken, open, ***** he had entered. I called the non-emergency ***************** line and was advised "it is private property we can not step foot it is on the ******************* to maintain the security policy and safety of their residents". When we advised the Property they apologized and stated "the repair will be escalated our residents safety is #1" but no repairs have been done since. I'm requesting the property repair these safety features ASAP, and a refund of rent in a suitable amount for the breach of contract and safety distress.

      The property has had some equipment fail recently but we had had these issues addressed.  Some have been fixed already on multiple occasions, but shortly after original repair, something else broke.  We have 2 pools and only one is currently out of service.  The repair was scheduled to be completed this week but was pushed back because of the hurricane.  Inflation and supply chain issues have caused delays to these repairs. ********* have had certified technicians from Kone come and repair the elevator every time there has been an issue.  None of these complaints were promised prior to ******* moving in.  The lease contract does not guarantee the use of these amenities.  Therefore, we have not breached our contract.  ******* has not brought any of these concerns to management's attention prior to this BBB complaint.

      I appreciate that ******************* has made multiple attempts to repair the elevators, and certified technicians have been *********** is a shame it has caused ******************* additional work and residents daily safety concerns & stress.

      While I understand equipment failures can occur, the ongoing elevator issues make it extremely difficult for residents to gain access to their units. Particularly those with mobility challenges, such as myself (breach of ADA ************* An elevator is NOT an amenity.

      While the lease itself may not specify a functioning elevator, this is a violation of the FL Building Code, **** Florida ****** ***** safety code, and St. **** Municipal Code.

      Currently at the time of this writing: Elevator (#*****) is the only functioning of two:

      -Expired license with State of Florida

      -No access to Floors 4 & 7

      -No lights (main or buttons)

      Elements was advised of these issues prior to my BBB submission. I have just entered a new Maintenance Request for the lights, upon exiting, I slipped and fell. I hope this issue is addressed immediately. I am seeking a reduction in rent until both elevators are up to code, and functioning; as Im unable to access my paid residence, or when able, is not safely.
