      I moved out of Elements on Third 5/5/25 after thorough cleaning and no damage and received my security deposit of $237.07 with a check issued 6/2/25. I received it and deposited the check 6/16/25 only to find out from *** that the check was issued from a frozen or blocked account - meaning the check bounced.I have called roughly every 2 business days since asking for an update and the person on the phone was sympathetic saying they keep pleading my case to corporate for a new check to be sent and an explanation why this happened.I have still received no update and continue to call, but the business very seldom answers.I have a picture of the confirmed bounced check and am withholding it to save the business any sensitive information. How do I get my security deposit and walk away from this company?

      Elements on 3rd - Seaglass Tower 11 floors has had elevator safety issues for the last 10 years. There are 2 elevators in the building. The left elevator has been down since before the Hurricanes.The right elevators is extremely unsafe. Since August, occasionally the elevator will come down to the first floor and rise up 6 causing myself and many other tenants to trip into the elevator, while the door sensor stops working and the door shuts immediately. Your arm does not work to re-open the door. You have to let it close and let it de-set itself by going back up. The 10th floor down button doesnt work. Consistently the same issue in the building and it has never been repaired to completion. We are always told they are waiting on parts.Other complaints are the 6 privacy fence is still down around the complex after the Hurricanes. The safety gates remain open and have never been fixed, allowing non residents free range into the parking lots and buildings. Last night someones windshield was broken by a person walking through the complex. The unsafe practices and notice to the property manager is holding us to our leases or we face a $4k penalty on our record if we dont pay. Several have moved out and will face these charges on their record. Each building on site has a broken elevator atm. The Seaglass building is causing emotional distress to all of the tenants in the building. Something needs to be done and the fact they arent a BBB member points out they are slum lords, taking everyones money and not fixing any of the said issues.

      December 17, 2024 Better Business Bureau Complaint Re: ******************************************* To Whom It May Concern:I am writing to file a formal complaint against the ***************************************************** for Elements on Third Apartments regarding serious health and safety violations, inadequate repairs, and their unreasonable stance on lease termination given my documented medical disability. This complaint details multiple failures in their duty of care and their refusal to provide reasonable accommodation under fair housing laws.Key Issues:1. Health and Safety Violations 2. Medical Impact and Disability 3. Unreasonable Lease Termination Demands Legal and Regulatory Considerations:Requested Resolution:1. Immediate waiver of the $4,640.26 lease termination fee as a reasonable accommodation under fair housing laws 2. Reimbursement for excess power bills caused by their use of commercial fans 3. Review and revision of their water damage remediation protocols to prevent similar issues Impact of Non-Resolution:Failure to resolve this matter appropriately could:- Force a disabled individual to incur significant financial hardship and into bankruptcy - Delay necessary medical care and family support - Leave potentially hazardous conditions unaddressed for future tenants - Expose the company to additional regulatory scrutiny I have maintained detailed records including:- All written communications regarding water damage and health concerns - Medical documentation of my disability status - Power bills showing increased usage during fan operation - Photographs of water damage and inadequate repairs - Timeline of events and symptoms - Documentation of my immunocompromised status predating these incidents I am happy to provide any additional documentation needed to support this complaint.       Elevators on the seaglass building are broken, one doesnt work at all, and the working elevator has issues with the doors closing on people, people getting stuck inside the elevator, and elevator will go up approximately 1 foot while doors are open and people are trying to enter and exit the elevator causing a major safety concern. Management has not done anything to remedy the concern amongst multiple residents including myself

      The elevators are expired and unsafe. One is completely broken and the other is unsafe because the sensors do not work, it jumps up a foot when it hits the bottom floor, and gets stuck frequently. Ive almost tripped many times when it starts going up before the door closes.

      The elevator certificate has expired that is posted in the elevator.  However, we have had them inspected and they have passed.  We are currently waiting for the state to mail us the new certs.  Code enforcement was onsite 11/12/24 and inspected the elevator for safety.  Code enforcement left the elevator is operation because they did not find any safety issues.  Management has had a license technician inspect and repair the elevator on multiple occasions.  They have deemed the elevator safe for operation. Unfortunately, 1 elevator is down and needs a full replacement.  The elevator was damaged during the storm. Management is working to get this resolved as fast as possible and appreciate all our resident's patience. Management invites you to come speak with us in the office if you have any future concerns.       Elements lied many times to get me to sign the lease: they said the entire building was remodeled and brand new, they said there was a dog park when theres just a broken fence, they said it was secure none of the gates work. They have also failed to maintain the amenities: the pool and gym were unusable for months because they refused to pay the contractors for previous repairs, the elevators have been down for weeks and are currently expired (they were down unrelated to weather multiple times, too, and have cause a tripping hazard). The management is running the building so poorly Id move out tomorrow if my lease could be voided (and if the elevators worked because I live on the 9th floor).

      The building was remodeled prior to ****** moving in.  We apologize for any inconveniences caused by normal wear and tear. We strive the have all issues fixed in a timely manner.  The dog park fence has been repaired. The pool pump was damaged and needed to be completely replaced.  We apologize for the delay with finding a reputable company that is competent enough to make these repairs.  The pool pump has been replaced and is working perfectly.  The gym was never unusable for any period of time.  We apologize that some machines in the gym broke down due to normal wear and tear.  We are looking to purchase new gym equipment in the near future. The elevators have recently inspected and have passed.  We are waiting for the new certificate to be mailed to us from the state. License technicians and code enforcement have inspected elevator and have deemed it safe for operation.  We apologize for any inconvenience and invite you to come speak with management if the office for any future issues you may experience.       I am rejecting this response because:

      Only one elevator has been working for the past few months. The working elevator also has safety issues, and occasionally jolts up after opening causing a tripping hazard (Ive personally been tripped twice by it happening while walking in, and I have seen it happen to another resident who got stuck for a few minutes afterward). 

      The gates securing the property are also broken, and have been since move-in. Some are always open and others dont open to let you leave the property.

      The elevator situation in the elements on 3rds sea glass tower has changed from annoying to downright vexatious. 1 elevator has been closed for over 2 months. This is a massive 11 story building and 1 elevator makes getting in and out of home *annoying*Where the dangers come in is the fact that the one working elevator has an expired inspection, and it constantly jolts up when the doors are open, people almost always nearly trip. Elevators should not be jolting when people are trying to load in. But wait - it gets worse! After hurricane ****** BOTH elevators were not operational in an -11- story apartment building. This would be understandable for a day or 2, but I have observed 0 effort to try to get elevators working so some people dont have to climb 11 flights of stairs to get home. Disabled and elderly have to wait in our clubhouse for help. Community trying to help as best we can, but theyre treating this like a lightbulb blew out somewhere. Not treating it as it is, a 11 story apartment building with no elevators.

      We apologize that one elevator is down.  It will need to be fully replaced.  We are working to get this completed as soon as possible.  We have had the elevators inspected and they have passed.  We are waiting to receive the new certificates from the state.  Code enforcement has inspected the elevator and deemed it safe for operation.  Every time the elevators have been down, we contacted our license elevator technicians to come and repair.  Unfortunately, they have other buildings they maintain, and we must wait for them to come repair.  The last 3 major storms (******, ****** & ******) have increased the response times for repairs.  We strive to repair everything in a timely manner.  We have service records for all repairs and can prove we have done everything we possibly can to expedite repairs.  We apologize for this expirence and invite you to speak with management in the office for any future issues you may have.       We have two elevators in the building. Since I moved in July of this year one of the elevators hasnt been operational for more than a few hours at a time. The other is faulty and will close or rise before everyone is off the landing. They have been expired since August 1, 2024. Our building has 11 floors and I live on floor 8. It should not be reasonable for both elevators to consistently be not working.

      The elevators are never working and break multiple times a week. There is only one functioning elevators out of the two and its extremely dangerous and closes on people and moves up randomly without notice. The sensor on the door doesnt work and the lights and buttons go out.

      We understand how inconvenient it is to have equipment failures from time to time.  Our resident's safety is our number one priority.  It is unfortunate we have had these elevator issues.  Most of the repairs needed are due to vandalism.  We take these issues very seriously and have contact our elevator repair company immediately after we are made aware of any problems.  Our area has been hit with 3 major storms this year and we experienced damages due to ******, ****** & ******.  Due to the high volume of repairs needed for ***** and ************* resulted in longer than usually repair times.  Unfortunately, 1 elevator was damaged beyond repair, and we are working diligently to have it replaced as soon as possible.       Our elevators in the ****************** have an expired inspection license. It is dated 8/1/24. It is now October.
