On December 31th, I went online to check if a refund that was due to my account ************ was credited, even though the credit was there, another transaction, caught me by surprise. A Pending Debit/ Hold of *********. I called BofA), no one could inform me what was going on. I went to a branch and after over an hour I managed to understand that ** ******, for whatever reason is claiming those funds. the VICTIM OF IDENTITY theft as a criminal. I can only assume that ** ****** is their custodian, acting now as co-conspirator aiding and abetting Tradestation criminal endeavours. (on my **** STATEMENT NO FUNDS RECEIVED FROM ** ****** appear), but nevertheless no funds on my account bellong to someone else or are fraudlent. They belong to me. Since the situation (identity theft) is not related to BofA only and ********* Where taken from another account of mine as well, and even a senior VP at **** said in writing that that I should return $37,117.88. Not *********. Nothing is adding up. But in reality the company owns me approximately 13k. I will be filling a lawsuit against TradeStation and ** ****** for Defamation, emotional distress and financial loses. They owe me money and not the other way. Absurdly, given that I don't live in the **, this account is not my day-to-day account, and I was informed that no Information regarding this Claim was going to be sent to me. *************** wants me to proof that funds sent by ** ****** that doesn't appear on my account actually belong to me? I am taking a guess when I mention TradeStation, because according to **** those are transactions made from ** ******. I checked ALL MY BANK STATEMENTS FROM **** AND THERE ARE NO ** ****** TRANSFERS. Please further elaborate so that I can provide the correct documents to end this matter at once. And I would also like to ********************** that I WAS A VICTIM OF IDENTITY THEFT, NOT A FRAUDSTER. AND THIS COMPANY ACTING WITH *************** ASSISTANCE IS TREATING ME AS A CRIMINAL.Business Response

Complaint: 22694113
I am rejecting this response because:TradeStation is claiming that the firm policy to restrict ANY buy order, (day trade or not) was disclosed to me.
However, this disclosure was only disclosed to me after filing this complaint. The action to restrict my account if the balance dips below $25,000 is illegal and not inline with FINRA regulations.
If the balance falls below $25,000 at the close of trading day, only day trading transaction are prohibited on THE FOLLOW DAY.
Saying that if my account has a balance of $24,500 I will not be allowed to send any orders at all, is contrary to the *** and FINRA regulations, and causing irreparable damage to the account holder. New Positions that are not closed on the same day, are never considered Day Trade and the account owner should be able to continue trading, as long as the positions are not closed on same day. If a position was open and closed after the account closed below $25,000 on the previous day, thats the only legal reason why the could be restricted from day trading.
ades at all. I explained that I was not engaging in a day trade and noted that the *** rule focuses on ensuring the account does not close the trading day below $25,000. However, TradeStation maintained its refusal to allow my trade. I was advised to wire additional funds to restore my balance above $25,000. I complied and wired the necessary funds from my **************** account. Despite my wire transfer being confirmed as "sent" and "received at the recipient bank" by ************ TradeStation claimed they had not received the funds even after four hours had passed. ****** *** rule requires that an account maintain a balance of $25,000 at the close of the trading day to engage in day trading activities. There is no rule that prohibits trading if the balance temporarily dips below $25,000 during the trading day, provided the balance is restored before market close. Despite this, TradeStation enforced an intraday trading freeze on my account, prevented executing trades that would restored my balance
Sincerely,
*** *********Business Response

Mr. *** ********,
The information you believe to be accurate, is incorrect. Please refer to this explanation which is directly from the ***** website.
"First, pattern day traders must maintain minimum equity of $25,000 in their margin account on any day that the customer day trades. This required minimum equity, which can be a combination of cash and eligible securities, must be in your account prior to engaging in any day-trading activities. If the account falls below the $25,000 requirement, the pattern day trader wont be permitted to day trade until the account is restored to the $25,000 minimum equity level."
