My husband and I made settlement on our home in April 2022. Within 4 months, roughly 27 tiles cracked in half. We understand that this type of settlement in a new home may occur. We followed the warranty procedures and the tiles were fixed in a timely manner and our home was also cleaned. We were pleased with the service. By April 2023 when our Home Warranty expired, most of the tiles they fixed had cracked again, this time worse than the last. The Home Warranty office said they would not fix anymore tiles. I spoke with a realtor from one of the offices and they gave instructions for us to contact the construction supervisor as she was having the same issue with a home she purchased. My next-door neighbor who also purchased an Adams Home and also made settlement on the same day we did in April 2022 is having the same issues. The tiles in their home have cracked across the entire length of the house just as our home did. They are not small cracks, they are wide and the tile is now starting to chip larger chunks. My neighbor received word from the realtor that was trying to get her tiles fixed that they would not entertain looking at our tiles or consider fixing them. Our fear, is this could be a foundation issue and Adams Homes is not willing to even look at what is going on. Their mission statement at Adams Homes specifically states, and I quote, "Our mission is to deliver value to our customers through a straightforward approach to building quality new home." How can this be if they don't even stand behind their workmanship? Although we have not put out money yet as we are weighing our options, this will be costly and it's clearly a huge company looking out for themselves and screwing the little guy. I bought my Home February 2020 with in the First year (2020 to2021) I was experiencing problems with my HVAC Unit and was told if I can’t capture a sound that they would not send a Technician Extreme was the Company that installed the unit and I was still under warranty Adams Homes would not provide or assist with getting them out to Diagnose the problem 2021-2022 I started experiencing NO AIR OR HEAT throughout the year I contacted them again still No Help was given and my out of pocket cost exceeded $1000 Cool Ray came to my Home and Serviced my unit I called and emailed Adams Homes Warranty over 30 times they finally sent Extreme Heating and Cooling out 4 times that year Summer and winter all they did was put a bandage on to run out my warranty. 2022-2023 the same problem NO HEAT NO AIR I called Adams Homes warranty again over 20 times and got the run around Adams Homes finally sent Extreme back out and guaranteed me it was fixed Neither Adams Homes or Extreme would provide invoice or repair order as I requested several other companies has came out and stated the unit was No good defective install did not meet code costing me hundreds of dollars 9-14-2023 I had to replace the HVAC SYSTEM out of pocket $9000 Myself and my family has suffered since I bought this home with Heat advisory in the upper 90 and cold index under 30 I have had to take my family out the home and pay for hotels food and shelter to keep us safe from the elements I have had Medical issues that Needed home care and could not stay in my own home. I have missed work several times to meet appointments times and dates I have emails to management I corresponded with. Adams Homes has been in business since 1991. We have built over 50,000 homes. Our happy homeowners
have greatly contributed to our continued success. We take pride in taking care of our homeowner
concerns both during and after purchase.
Our warranty includes a 1-year builder warranty, 2-year mechanical warranty and a 10-year structural
warranty.
Ms. ***** has made some warranty calls regarding her A/C
unit not working properly. We set up service calls for our vendor to go
out and access/repair the issue.
See below a response/summary of service calls from our A/C
vendor (Extreme Residential below).
Preparing for a Service Call
We do ask for
recordings when we get a noise request but that is simply to ensure we can hear
the noise as we have been on hundreds of service calls about noises only for
the noises to not present itself when the tech is on site which makes it
impossible for us to figure out the issue. So, we ask for a recording prior to
scheduling to remove that scenario but our service shouldn’t be denied if for
some reason we can’t get a recording.
Service Calls
7/9/2022 – homeowner
called stating HVAC was not functioning this was peak season and we called back
to inform they were out of warranty I guess that’s when they reached out to you
all and you stated you would cover service fee if we went out because they
refused to cover the fee if issue was not installation related.
7/13/2022 – homeowner
stated another company fixed her problem there was a leak inside the air
handler (this is a manufacturing defect and leaks inside coils or air handlers
are not always present at installation but sometimes show itself after once the
system has been running. These leaks in coils and air handlers appear later due
to pressure of freon flowing through system and bursts weak welds inside these
components) So on arrival they basically told us they already had it fixed so
we just checked system and it was 1lb low of freon, so we added it.
10/22/2022 – you guys
sent us a service request we went out. Tech on site found the heat kit and
circuit board nonoperational as well as they found the thermostat was not
programmed properly which could have been due to power surge. Also, the filters
were dirty, and no air flow was getting to the system it was noted the
homeowner was a smoker which could contribute to the filters needing to be
replaced more frequently. We replaced the filters; we reprogrammed the
thermostat as well as replaced the heat kit and circuit board.
Replacement of the system
“I don’t believe it
was an improper installation but even if it was there would have been no need
to replace their entire system. Maybe one component but not the entire system.
As of this last service call October 2022, the repairs were
complete, and the A/C was working properly.
Based on the last service call, the repair technician did
not report or see the need to replace the A/C unit and the necessary repairs
were complete. Extreme Residential report the A/C was working when they left
the property. We have double checked our warranty log, emails and voice mails from
the October 2022 repair date to today and we do not have any record of calls,
emails from the homeowner regarding A/C concerns. It is unfortunate Ms. *****, had to replace
her A/C unit. Based on the repairs being completed and the warranty has
expired, we do not agree to a refund/reimbursement of a new unit. We appreciate Ms. ***** as homeowner and wish her well.Initial Complaint

I am HOA president and our development is Redhawk Landing. Our roads were damaged by the subcontractors of Adams Homes during the course of construction of 68 single family homes from January of 2021 to January of 2023.
The roads need to be top coated at a cost of over $19,000, which Adams Homes through their attorney, have denied liability because the roads were dedicated to the state dot.
I have contacted the NCDOT and they just responded on 8/30/2023, that they will attempt to hold the contractor responsible.
We are a new and small community without funds to pay for this cost.Customer Answer

Dear Mrs. ******* (In Melbourne Florida Warranty Department),
Good morning Mr. ******** came by and we chose the tile, Just wanted to know when they are going to come out to fix it so that we could be here.
2. Kitchen counter keeps separating and we cannot sell house with this condition, its looks more terrible than before.
3. Bathroom shower, that has lifetime guarantee, not only has crack come back, but now it also is coming off the wall.
4. Walls under sink and also in master bathroom still have not been painted

Faith Castleberry, representative of Adam’s homes makes suggestions, fabricates information regarding sales and contexts and excuses for her behaviors and incompetence in her position. She advised me to cancel my contract based on gross misrepresentations of a home I intended to purchase in North Port, FL. The result of cancellation of said contract was to solely retain 1000$ deposit. It is distasteful business practice and has not been addressed by anyone from Adam’s homes regardless of attempts to escalate issues to management. She grossly misrepresented details and dates of a home to me, rudely suggested via text that I cancel the contract & once I did as she recommended, Adam’s homes still retained my deposit. Unfair and unjust business practice. This unprofessional behavior coupled with incompetence of their representatives should be addressed by management of Adam’s homes. Adam’s homes is enabling unacceptable business practices by this representative of their company. Never have I encountered such blatant lack of respect or concern for customers from any entity. Adam’s homes should be ashamed of this behavior and address these issues with customers professionally. There is a serious lack of integrity with not only the representative but also the company as a whole entity. Training competent staff to represent their business and not passing blame is a standard that should be addressed to live up to ethical standard business practices.Business Response

While
it is difficult to ascertain the exact nature of Complainant’s complaint based
on the limited facts she has provided, Adams Homes provides a general denial of
all of Complainant’s allegations without waiving its right to supplement or
amend this response should additional information become available to it.
As to any dates that were allegedly misrepresented to Complainant, Adams Homes
denies such allegation and directs Complainant to paragraph 25 of the Sales
Contract executed by Complainant (“Buyer”) and Adams Homes (“Seller”) which
specifically states Seller does not guarantee the completion date of the home:
“BUYER understands that Seller does not guarantee the completion date of the
Property due to several factors regardless of whether those factors are within
or not within Seller’s control.” (Paragraph 25).
As it relates to any alleged misrepresentations made by any representatives of
Adams Homes to Complainant, Adams Homes vehemently denies such allegation and
directs Complainant to the following terms of the Sales Contract: “NO
REPRESENTATIONS, guarantees, or warranties of any nature whatsoever which are
not herein expressed have been made by any party hereto or their
representatives or any licensed real estate agents, brokers, or realty company
involved in or arising out of this transaction . . . BUYER expressly
acknowledges that (i) (s)he has not relied upon any oral representations made
by SELLER or real estate agents . . . (iii) the original design plans and
specifications for construction of the improvements may have undergone a number
of changes due to a variety of causes . . . ” (Paragraph 26). Finally, the
Sales Contract explicitly states: “NO OTHER AGREEMENTS exist between BUYER and
SELLER except as set forth in this Contract . . . This Contract shall not be
modified except by an amendment in writing executed by both BUYER and SELLER.”
(Paragraph 28).
Contrary to Ms. ******’s assertions, Adams Homes attempted to work with
Complainant to ensure she was satisfied with the home; however, Complainant
declined Adams Homes’ offers and informed Adams Homes she did not want to close
on the home and, instead, wanted to terminate the Sales Contract. Complainant’s
termination of the Sales Contract resulted in a breach of the Sales Contract,
which allows Adams Homes to, in addition to other relief, retain the Earnest
Money Deposit ($1,000). Complainant chose to terminate the Sales Contract and
voluntarily executed a Release of the Sales Contract that explicitly stated
Adams Homes would retain the Earnest Money Deposit in the amount of
$1,000. Adams Homes is contractually entitled to retain the Earnest Money
Deposit in the amount of $1,000 due to the Complainant’s decision to terminate

Adams Homes offers a Non-Transferable One Year Builder Warranty
to all customers who purchase a home from Adams Homes. The complainant purchased the home as a resale
and not directly from Adams Homes therefore we are unable to perform any warranty
services on the property. However, the 10 Year Structural Warranty that Adams Homes provides upon closing to the original purchaser is transferable and valid for the remainder of this10-Year Period. I have attached
the Warranty Guidelines which outlines this valuable coverage and contains Maverick’s contact

I am rejecting this response because:Per law, the builder would have assumed responsibility for anything done to the land by the developer, Ponds, LLC.
My primary concern is with the water runoff swale in my back yard. The Water Management District of Manatee County FL agrees with me and has sent a formal letter to Adams Homes to fix it, as well as other property swales in the neighborhood. The land is not graded properly to permitting/code. Therefore, even a regular rain storm leaves deep standing water in my back yard, and neighborhood back yards for days!
Adams Homes has refused for almost a year now to address this primary concern. When I started this process last fall, I was within the one year. They, Adams Homes, just refused to help.
I will reference now, Kim Stanley, as a person who refused to even listen or come look at my very real situation for herself. She's part of the Sales Management Team with Adams Homes. She could have referred me to someone who could help. She refused.

Hurricane Idalia will fill my back yard with three plus feet of water, guaranteed! Pray no further land erosion and/or disease, critters, etc. because of this situation ongoing!!!

2019 Manatee County records show that my back yard and neighbor's back yards have no easements. The water was supposed to go into the Track B public flowage easement area. Adams Homes appears to have violated the approved water flow management from 2019.

Adams Homes has carefully reviewed the additional details provided by Mr. ********. The letter referenced from the Southwest Florida Water Management District was addressed to the Grand Oak Preserve Homeowner’s Association and not Adams Homes as the Builder. Adams Homes finishes all properties in accordance with applicable drainage plans & municipality requirements. Adams Homes can only ensure the initial establishment of proper grades and swales with subsequent maintenance becoming the homeowner’s responsibility. The final survey for the subject property does indicate that there is a drainage easement at the rear of the property. Mr. ******** purchased the home from a 3rd party therefore we are unable to provide him with a copy of the sealed and certified survey or conduct any builder warranty work on the home and/or homesite. It is customary to receive a certified survey when closing on a residential property in Florida so it is possible that Mr. ******** may have one in with his closing documents which will show the drainage and utility easements. And, as a reminder, Maverick's 10 Year Structural Warranty that Adams Homes provided to the original purchaser is transferable and valid for the remainder of the 10-Year Period so we would have to refer him that company for any questions in connection with his structural warranty.Customer Answer

I am rejecting this response because:Adams Homes claims are based on the assertion that they are the 'Builder' and NOT the land 'Developer.'
Perhaps this is a legal loophole that they are exploiting.
Furthermore, they are not in compliance. The swale at the back of my property at the farthest corner is 25 feet. My plat states 5 feet easement MAX.
In addition, the property owner with the caged in pool behind me is not in compliance because they should too have a 5 feet easement in back. Their pool and landscaping goes right to the very back of their property line.
At this point, i request that this matter be referred to the AG of the State of Florida for further investigation.
I await any follow-up.

After multiple issues that delayed closing on behalf of Adams Homes I was able to close on my New built home on 4/28/2023 after purchasing the home we started to do projects in the home(i.e. All tile instead of carpet, utility sink in the garage, epoxy the garage floor, gutters, solar panels, cabinets in the laundry room, ect.) While preforming these upgrades to the home we started to notice very odd and disturbing things. We couldn't find studs in the wall, HUGE Cracks in the foundation .5 or larger, studs were visibly seen at 29-30" on center. chunks of the ceiling in the corners of the garage have fallen out, Cracks up the inside and down the outside of exterior walls. electrical panel is mislabeled and wiring to the house is wrong and hazardous. Ive had two general contractors and a home inspector that did the home inspection on my home document and tell me that this is very bad and that my new home is a death trap waiting to happen. I sent everything to Adams homes the pictures and the home inspectors report and was told that everything is normal... after pulling the residential builders code for Florida non of this is normal or with in code! Signed may 1st 2023 to have adams homes build a new "custom home". Was told by the realtor on site to stay off site and that the house should be started with in 60 days. Day 60 hit and nothing started, called realtor Terri on-site to find out they were waiting on plumbing. Day 90 hit and 4 other house have pad and framing started so the realtor I used to purchase "custom home" calls and was told by Terri adams homes realtor that they were waiting on documents from alabaster. We were also told from your preferred le der that we were wasting her time. Enough is enough and decided to back out because of getting the run around and disrespect to the buyer.Business Response

You were told a week before you decide to put wood on the property that we were giving up on your company building a house we are purchasing. Every step of your 40-50%process so far was lies while you started on other properties we could have placed our house on. We wasted our time going with your builders and could have been in a home that would fit our new edition.

We moved into our house 1/10/22 and our warranty request journey started 7 days later when we had a leak in the master bedroom ceiling. Since then, we have had many warranty requests from doors, floors, steps, yard drainage, cabinet, faucet leaks, HVAC issues and more. Most have been completed and we are down to our last few requests which have been really challenging with the new Warranty Coordinator Keo ******* During multiple conversations with Keo ******, she has been condescending & dismissive. She told us she couldn’t help us until we send her an email about warranty request that were put in before she started working there and should have been in our file. She told us she couldn’t help us because she was doing permits. She relayed wrong information to her managers and they thought we had mold when we were referring to the shoe molding that should have been dealt with last year when the replaced all of the LVP flooring downstairs. She never passed us through to the management when we asked. At the end of May, she finally put a work order in to the painters, all to tell us later that we had to wait because Adams Home was looking for a new vendor and she didn't know how long it would take. We never heard from anyone and called 7/6/23 for her to tell us our file was closed & the work was complete. We informed her the work was not complete. After calling corporate and they told us to call the office back to speak to a Brent or Shirley the GM, Keo called us back and said she put another work order in for the painters to complete the painting of our shoe molding and Rec Room cracked ceiling. We also mentioned that we need the French Basin Adams Home installed in our back yard fixed because it’s not in the ground right. She did not put in a work order for the French Basin which was installed by Adams Home because of an ongoing drainage problem warranty request. As of yet, the warranty request is not done and we are still waiting for a call from upper management.Business Response

On June 3, 2023, I entered into a contract with Adams Homes in the ******** ***** ********* in Dunnellon, Florida. Looking to engage with an irrigation company for a pool project, I received a phone call from them on June 13, 2023 stating that I should investigate further the excessive water bills that exist within the community. A neighbor directly next door to the property I was purchasing spent over $600 a month for their water/sewer bill. She mentioned that she discussed this issue with RJ Albritton of Adams Homes in April. I immediately asked RJ to cancel my contract due to non-disclosure of an costly issue that existed within the community. After waiting weeks without response from Adams Homes, on June 29th I received a letter from Adams that they are holding me to the binding contract or I could send them $10,000 to cancel the contract. I promptly solicited the assistance from an attorney and they recommended to cancel the contract and pay the fee, which I did. All along my realtor Leigh *** ****** of Berkshire Hathaway Realty in Ocala, Florida assured me that RJ Albritton would never do this to me. Adams Homes is a reputable business. I'm filing this complaint as this excessive water/sewer bill should have been disclosed to me at the onset of the deal and I could have then made an informed decision over the purchase of the home to assess if these additional costs of drilling a well or acquiring a second meter would be worth the home I was intending to purchase.Business Response
