All Elements Public Adjusters LLC were hired to work with ******************** to review and settle my homeowner's insurance claim resulting from Hurricane ***. All Elements took 100% of the ********* settlement ($64,000) leaving me with nothing to make the necessary repairs to my home. Here is what they did and how they did it: *********/************************* submitted repair estimates to Citizen's without my approval. Without my knowledge or approval, *********/************************* directed 3 ********* payment checks (issued 11/19/22, 04/20/23, 07/26/23) to their own address and cashed these checks. - Since the beginning of 2023, ********* and ************************* have informed me that they were 'waiting for the ****************** or 'working with the ********* Company lawyer'. In May, 2024 it became evident that something was wrong. Citizen's ********* Company confirmed that all checks had been issued and cashed by **** and ***********************************- the last check in July 2023. **** continued to say that the lawyers were still reviewing the claim . - I made several attempts in May to collect the stolen funds. On one attempt, ************************* wrote a personal check, which ended up bouncing. All Elements continues to hold all of the $64,000 issued to me by Citizen's.Initial Complaint

I entered into a contract with All Elements Public Adjusters just after Hurricane *** in late September of 2022. On 12/13/2022 I was notified by ************************* that I was owed $64,364 in claims. I called Tera and asked if we should settle for that amount? I was told to wait as they will continue to try and get a better settlement. On March 23, 2023 I was notified of another $56,145 payment from Assurant. Again I contacted **** and was informed that we werent settling for that amount. I asked about the checks and was informed that none of the checks had been cashed. I went through the same process ****************** Monarch carried the wind damage side of my insurance. Checks were issued 5/07/2023 for $66,586 and the final check issued 12/14/2023 for $50000. All of these checks were issued to All Elements Public Adjusters in *******, **. I was again informed by **** that the claims remained open and the checks were not cashed. In the fall of 2023 I was issued 2 wire transfers from All Elements. One wire was for $25000 and the other was $5000. On April 12, 2024 I decided that I could no longer trust what **** was telling me and I called both Assurant and Monarch claims. I spoke with ********************* of Assurant and was informed that all the checks were cashed and the claims were closed. I then spoke with Monarch (*********************) and was informed that the claims were closed and all checks were cashed. I confronted **** about this and was told again that the checks were not cashed but they were on hold. Part of the contract with All Elements reads, All Elements Public Adjusters agrees that it shall not accept any settlement or adjustment without my prior consent. I had no knowledge that claims were settled. The checks were issued to All Elements and they signed my name as well as my leinholder name to the checks and cashed them. Over $237,000 in checks were issued and I have only received $30000 to date.Customer Answer

"After our home was damaged by Hurricane ***, my family recommended this company to help with our insurance claim. We thought they would handle everything smoothly and fairly, but it turned out to be a frustrating experience. We tried reaching out for updates on our claim, but they kept giving us vague answers and never followed up when they promised to. Then, we found out that our claim was settled directly with the insurance company without them telling us. We also discovered that this company isn't listed properly, which made us worry about whether they're even legitimate. They said they were working with a lawyer, but when we tried to contact them, we got no response. This lack of communication and transparency feels like they're trying to cheat us. We're demanding that they give us the money owed to us and explain everything they've done. If they don't, we'll take legal action against them."Initial Complaint

On/about Jul 5, 2021, our home sustained damage from Tropical *******************. We hired All Elements Public Adjusters to assist with our insurance claim; All Elements hired attorney *********************** to assist. In Nov 2023, ****************** agreed to settle our claim for $40,000. On Jan 4th, 2024 we requested an update on the settlement status. The attorney informed us that two settlement checks were released to All Elements Public Adjusters (Tera). **** explained she would work on getting the checks endorsed by our **************** because there is a lot of paperwork involved and it can be a lengthy process to handle on our own. Since ***, we followed up every few weeks to ask when we will receive the funds. Each time, Tera would provide false or misleading information on why the payments were delayed; she repeatedly stated that our mortgage company had the checks and endorsing them, however, when we spoke with our **************** (M&T Bank), the rep stated M&T had no record of contact with anyone regarding our claim settlement. We asked **** again who she spoke with at the mortgage company, and asked her to provide mail tracking information for the checks to/from the mortgage company, but we did not receive a name or any additional response. On Apr 22, we requested a copy of the checks; they were sent to us by ***********************. The copies showed two checks in amount of $20k each, issue date of Sep 2023, payees were my wife and I and our FORMER mortgage company United Wholesale, and not our current company M&T Bank. All Elements PA (Tera) has made repeated false claims as to the status of our checks and with regards to actions with the mortgage company. She promised to bring a good faith payment to us on two occasions, while the settlement checks were being processed, but she failed to do this. She has not provided any tracking numbers, or proof that she is actively working on getting the checks endorsed. All Elements is NOT listed as a payee on either check.Business Response

Mortgage on the check has been united wholesale. Never said it was MT **** and I never spoke to anyone at that mortgage. Due to the fact I never was handling it with them. Check has been sent out as of today. They will be recovering their funds shortly and processed to be able to be deposited on May 14th. Thank you!Customer Answer

All Elements was told multiple times that the incorrect bank was listed on the checks. This was expressed verbally to Tera and also documented in two emails to All Elements (11/27/2023 and 4/30). On 4/12 All Elements wrote: [attached: The mortgage company is sending it out as we spoke it had the other previous mortgage on there. I know this has been a lengthy process because of citizens but this is coming to end very shortly, again as we discussed. I will call you as soon as I receive it on the mail as they said is being processed to be sent out.] This statement was verified as false. Neither United Wholesale or M&T Mortgage has a record of speaking with the All Elements or anyone other than me, nor has the adjuster demonstrated any proof of contacting mortgage company. On 1/31/2024 All Elements wrote: [attached: "Also I just wanted to verify that the check was delayed due to holidays and wasnt picked up until the second week of January."] This was also a false statement. Attorney *********************** later informed us that the checks were picked up by **** on January 4, 2024. There have been multiple other false and misleading statements that can be verified through further email communications. Unfortunately, some of the false statements were made by phone.

Since I filed the BBB complaint, we learned that All Elements charged us 20%, which is 10% higher than the allowable rate according to the Public Adjusters guidelines for the state of Florida. We still have not received our settlement payment and our mortgage company verified (again) that they have not received settlement checks to endorse, nor has the bank been contacted by All Elements Public Adjusters.Business Response

This is correct standard law percentage is 20% due to the fact this claim was not under state of emergency. 10% is allotted if the governor states in a state wide message that its a state of emergency, where we legally can not charge more than 10% on a claim for the first year of the catastrophe.Customer Answer

I am rejecting this response because:We contacted our insurance company and the Citizens Adjuster informed us that All Elements cashed the settlement checks on January 5, 2024 (copy of canceled checks attached). For the past four months, All Elements fraudulently claimed that the checks were with the mortgage company and that the checks were not cashed (email attached). They purposely deceived us and were not upholding the practices of an A, B, C or D rated business. We again request the following:
All Elements be held fully responsible and accountable for providing their customer with false information over the past four months to illegally and selfishly hold our funds to benefit their business. We request a return of all or part of our service fee paid to them ($8,000) based on the additional steps we have been forced to take to try to recoup the settlement money. We should not have to pay full 20% fee since they failed to conduct business in an honest manner, and they've taken over 4 months longer than necessary to pay out our settlement. We also request that a daily interest rate is calculated and added to the $32,000, from January 5, 2024 through the date of payment (currently ************************* which All Elements cashed our checks and when we should have received the full settlement payment.

With regards to 20% charge, Governor *********************** issued Executive Order 21-150 declaring a state of emergency for Tropical *******************, therefore, All Elements legally cannot charge more than 10% on our claim, which they charged 20%.
To further support our primary complaint, as shown in proof of canceled checks (attached), All Elements deceitfully cashed the settlement checks issued by Citizens bank. It was explained to us by Citizens, by our Attorney, and by All Elements that the settlement checks REQUIRED endorsements from me and my wife, as well as the mortgage company. All Elements explained the proper procedure to us, yet deceitfully rushed to illegally cash the checks without our knowledge. They NEVER attempted to contact the mortgage company or get an endorsement from them. All Elements picked up the checks from Attorney ****** on Jan 4, 2024, cashed the checks the next day, Jan 5, and never told us that they took this action. This was a willful and purposeful act to deceive and defraud us.
