      02/09- Today i picked up car that was repossessed on Wednesday 02/07. I paid $2043 to my bank and that covered the towing fees as well. Upon picking up my car, items were stolen and damaged, front fog light was broken and my bumper was bent and my interior was damaged.I want to be 100% reimbursed $$$ or i want all the damages fixed and replace, i want it to be replaced correctly by the ***** dealership.I have a ***** Civic and i take care of things i own, so to see it back after 2 days in worst condition is not okay. The man who drove the car out to me did take pictures of the damage. If this will not get handled then I will be looking to *** the ************ Specialized Towing Location. Attached are the interior damages, someone took the exterior pictures. Happened today 02/09 around 09:30am.

      Unfortunately for Ms. ***** we take an insane amount of interior and exterior pictures of the vehicle as soon as the vehicle is recovered. We have attached a picture of the right front corner of the vehicle which, if zoomed in, shows the cracked pre-existing damage to the fog light lens. I also attached the picture of the same fog light taken by our lot personnel when the vehicle was redeemed. These claims are typical of someone who just wants to lash out at the recovery agency that repossessed her car. We are willing to provide additional pictures of any other area she claims was damaged. Everything she is claiming was pre-existing damage.

      I am rejecting this response because, I actually have pictures of my car since I had a bday celebration and it shows what my car looked like before the week. My bumper was never cracked and my light was never busted. I have 4 people who saw car before and after and even know that my car was not Managed well at all.

      I am providing those now. Also I have a picture of my phone holder, tang is broken.

      I am writing to file a formal complaint against Specialized Towing regarding the recent repossession am writing to file a formal complaint against the recent repossession of my ************************************************************************************************* the United States Code (U.S.C) Title 15, Section 6802(a), Section 6802(B), and Section 6802(C), governing consumer privacy rights and proper notification.United States Code Title 15, Section 6802(a) safeguards consumer privacy rights by limiting the disclosure of nonpublic personal information by financial institutions, ensuring the confidentiality of consumer data.Furthermore, Section 6802(B) and Section 6802(C) of Title 15 under the United States Code emphasize the necessity of providing consumers with adequate notice before undertaking disclosure of their personal information. In addition to potential violations of federal statutes, the repossession conducted by Specialized Towing seemingly breached the peace. They entered into a closed area/private property to retrieve my vehicle. Provided to the tow truck driver non-public personal information without notifying me. I was never given the opportunity that my personal information not be disclosed to the tow truck driver. I was never given the opportunity to exercise my non-disclosure option. Trafficking my personal information, they took copies of identification without permission when I was picking up my personal belongings.The actions of Specialized Towing have caused me significant damages, including but not limited to financial losses, inconvenience, emotional distress.As a resolution, I demand the following:Immediate return of my 2021 ****** Corolla to my possession within 5 business days from the receipt of this complaint.Compensation for damages incurred due to the illegal repossession, including travel cost, lost of wages, lost of car insurance.

      The consumer is misunderstanding or misrepresenting the previously mentioned federal consumer protection laws. As a direct vendor of the bank/lender these laws allow them to provide us with limited information on the debtor in order to help locate the collateral. Also ******* statute 493 requires ** to notify the consumer by mail to advise that we are in possession of their personal items left in the repossessed vehicle. Also ******* statute 493 allows ** to enter a closed/private area to recover the collateral as long as we do not breach the peace nor cut or break a lock. A breach of peace can only be claimed prior to us being in care, custody, and control of the collateral. This recovery was completed without making any contact with anyone and without incident. Proof of ownership and identification is required when redeeming collateral in order to insure a proper chain of custody transfer. That information is kept in our password protected system of record with 2-step authentication and never disclosed nor shared with anyone.

This principle, known as the Supremacy Clause in the Constitution, establishes that federal law is the supreme law of the land. Specialized Towing violated the following federal laws: 

      15 U.S. Code 1692f 1)
      The collection of any amount (including any interest, fee, charge, or expense incidental to the principal obligation) unless such amount is expressly authorized by the agreement creating the debt or permitted by law.
      15 U.S. Code 1692d (3)
      The publication of a list of consumers who allegedly refuse to pay debts, except to a consumerreporting agency or to persons meeting the requirements of section 1681a(f) or 1681b(3)?[1] of this title.

      15 U.S. Code 1692d (4)
      The advertisement for sale of any debt to coerce payment of the debt.

      federal laws where broken when my non public personal information was given to specialized towing without my permission making the repossession illegal. Its against federal  laws to auction my vehicle or advertise the sale of my vehicle to force payment. Also against federal laws to create extra fees or debt by charging towing fees. Please kindly ask specialized Towing to stop violating federal laws and return my vehicle immediately. Its

      I am rejecting this response because: I am expressing my extreme dissatisfaction and concern regarding the recent repossession of my vehicle. As per the regulations outlined in Section 1985(3) of the Civil Rights Act of ****, I am deeply troubled by the possibility that my constitutional rights might have been violated during this process.
      While I acknowledge the legality of vehicle repossession under certain circumstances, I am deeply concerned that my rights or privileges secured by the Constitution or federal laws may have been disregarded or violated during the repossession of my vehicle. It is imperative to note that any infringement upon these rights during such a process is unacceptable and a direct violation of the law. It is my strong belief that the repossession of my vehicle might have been conducted unlawfully or in a manner that breaches my constitutional rights. I demand an immediate return of my vehicle without delay. Failure to comply will result in me seeking legal counsel and exploring all available legal options to rectify this situation.       My car was towed from **************** on 10/30 due to repossession. In the commission of the car being towed, the car was damaged to the point of not turning on (no, it is not a battery issue) the car was dragged from the rear causing damage to the undercarriage of the front vehicle to the point where wires are hanging from the car (we have photos and video proof) however when calling and asking to speak with someone in charge I was hung up on. Tried to retrieve the car 11/03 only to be told it was taken to an auction yard in *****************(after paying what was owed to the loan company) okay no problem, waited til Monday 11/06 to get the car only to try and start the car and the car is not coming on. I have an appointment to retrieve the belongings of the car 11/09 @ 12pm and was told I can speak to a manager then. The car was working fine on 10/30 and between this company and the company that transported my vehicle from **************** to their tow yard which was then transported on 11/02 to *****************. I need answers because someone is responsible for the damage.

      My vehicle was picked up for repossession. I called the towing **mpany to schedule an appointment for pickup of my personal belongings and had a difficult time getting someone to help. One employee answered the phone and transferred me multiple times to a line that no one would answer leaving me to call the same number back and ask for help when I was told he would transfer me again or hang up on me. After no resolve with that employee I looked online and found that I **uld book my appointment there and did so for 5 days out from pickup date. I called the lender of my cars financial institute and let them know I was **ncerned for my belongings given the large gap in time between the repo and date avail for pickup of my possessions. I was assured by the financial institute that the tow ** is required by law to take photos of everything in the vehicle and bed of the truck. To my dismay this morning when I arrived to pick up my belongings items were missing. Most importantly 4 of 7 fishing poles were missing. These were prized possessions of my sons and one of the few things he had left of his fathers who passed away March of 2022. When I spoke with ********* and advised him that these ****** were missing he became defensive and told me his drivers are paid well and wouldnt steal from anyone. I asked him if he would check the photos once more and the video he claims they have because I know for a fact they were in the truck up until the truck was picked up by one of his drivers. Her then stated it would take hours and didnt have time to get to it today. I called my financial lender and informed them of the situation. I would like for these exact items to be returned. They have sentimental value to my 17 year old son who lost his father. I would also like to add that while we were there another customer came in to retrieve his items, most importantly his grandfathers ashes, which were not there not ac**unted for on his pick up order by the tow **mpany. **************

      See attached pictures of the items that were removed from the bed of this debtor's pick up truck prior to doing the inventory. All items were bagged tagged and returned to the debtor. As per ******* law we are obligated to inventory store personal property items for 45 days before disposing. We regularly disposed of car seats, umbrellas, fishing rods, cell phones, car jacks, and various other common items on a weekly basis. Our employees have no need to steal random fishing rods found in the bed of an overloaded pick up truck that was parked for months prior to being repossessed. Not sure what happened to this debtor's crappy fishing rods but they definitely didn't go missing while under our care, custody, and control.

      I am rejecting this response because: the vehicle was picked up at 10:00 PM and the photos were taken during daylight. There was a long enough time gap for someone at the tow company to take anything they wanted. Photos show fishing equipment, unfortunately theyre not clear as to how many poles (which Im sure was the intent of a photo not directly above the items missing). Photos are just as vague as their descriptions on their pick up lists. 

      The fishing poles could have ranged anywhere from $1-$10,000 the face of the matter isnt monetary but sentimental. I clearly expressed to everyone in the office that the poles belonged to my husband who passed and were now my sons. 

      This company has numerous complaints against them for being liars and thieves. As you can tell with their response they do not care about the consumer.

      I have filed a formal complaint with the lender and if necessary will file a civil suit.

      All that were asking is for the 4 poles that were taken be returned.

      This is a perfect example of the typical BBB repossession complaint. Full of criminal allegations but no facts to back it up. A company who steals a car does not report it to law enforcement. However, we reported the repossession to law enforcement the minute this vehicle was impounded. We got an order to repossess from ****************** who currently have a ***************** to service all US Auto loans. The consumer can make an appointment with our office to retrieve her personal items if she so wishes.

      My vehicle was repossessed without my knowledge. My personal items along with medical supplies for work are in the vehicle which are needed for patient care.       It is typical for consumers to reject our response when their desired outcome is not achieved. It is provable that you are not being forthcoming about this being a medical emergency. The items you're referring to are dental implants not actual medication. (attached) Cosmetic items do not constitute a medical emergency. Unfortunately our ***** location is working at their peak capability with appointments having to be set every 15 minutes due to the high volume. Our staff is working at full capacity and unfortunately we cannot disrupt the current appointments for a person who is being dishonest about a medical emergency.       I got a flat tire on the side of the road on A-1 a in ********* in ******** in Casino. I was able to take it to the pilot shell gas station, which is also just as corrupt and despicable. No one had a tire for me anywhere even close so I drove to Naples and back with two tires on wheels. When I got back, the pilot Shell station had my trailer towed with my truck and the trailer as well as many more belongings. That was within their right on private property. At that time the a****** that I spoke with at specialized towing said it was too late to pick up my vehicle, I would have to wait till tomorrow, which is against ************* statute rule *****. That rule states they have one hour to release my vehicle and property to me. That was not even an option with them so I went back the next day which I was told from 12 PM to 5 PM. I could regain my property as I was told, I called them at 3:15 PM and they said that there was an additional charge after 4:17 PM which all of these timelines are really s*** And all of these peoples acts are despicable. I will have my day in court with their *****. I am not going to standby and let them tell me with Miami **************************** in front of me and next to me that my ultimate pay bill is $972 for one day of a toll. These people that specialize towing are straight a** crocs. I hope that anyone that has any dealings with these people will get the ball rolling to have their license revoked to have their state and county towing agreement revoked, which I am going to make my life mission, they are not for the common people, or in the common peoples interest . When I was at their supposed illegal stash house, it was well beyond 20 miles there. Despicable acts have made me open a can of. Im not taking this on them. Do not let some shady disrespectful underhanded company bully you into anything in *****. I am not from *****. I come from a respectable place not a bunch of scumbags , trying to review and steal your stuff.

      My daughter had her truck repossessed because she just had a baby and was behind on ************* was towed. She paid her financing company & received a clearance but the tow company refused to release the vehicle for unknown reasons she was told to return Monday and asked for her keys because they couldnt gain access to the truck interior. Upon arrival this morning, they stated they got new keys made and entered the vehicle. She received a bucket of items one of which was an empty wallet of my sons (all of his credit cards were removed), there were several items missing such as a gold necklace belonging to my 4 year old grandson, mechanical tools & other valuable items. They refused to talk to us concerning the missing items, in fact I was hung up on by **** when I tried to call to discuss the matter. I will be heading to the courthouse to file a civil complaint/suit today while its still fresh if I cannot get an answer from them directly.

      ******'s vehicle was recovered on 02/25/2023. ****** made an appointment to pick up personal property on 03/02/23 at 11 am. This is evidence that the debtor had knowledge that an appointment was necessary. The appointment was scheduled for personal property redemption which takes time to prepare for. For some unknown reason the debtor chose not to redeem the personal property on that day and refused to leave the keys. ****** stated their preference of redeeming the personal property along with the vehicle at a later date. At this time we did not have a redemption release from the lender for their vehicle.

      Debtor then showed up on Friday 03/10/2023 with intentions to redeem the personal property and vehicle without making an appointment. Company policy is all redemptions must be scheduled by the home office after verification of having received the required documents. The branch manager then called the home office scheduling team and scheduled a vehicle and property redemption for Monday 03/13/2023 at 9 am.

      About the key: On 03/03/2023 the lender approved a key to one cut for this vehicle. A third party vendor was used to cut the key. When our staff used tried to use the key on the door lock it did not open the door. We had to ask the debtor for their key in order to gain access to the vehicle. Our staff then verified that the new key did indeed work on the ignition.

      About the personal property: ******* statute 493 requires recovery agents to conduct a full inventory of all personal property contained in the vehicle including glove box and trunk. It also requires that all personal property be stored for 45 days. It is our policy to conduct a full inventory within ***** hours of the recovery. The property is then bagged, tagged, and placed on racks in a secured locked room with CCTV. All inventoried items were returned to the debtor on 03/13/2023. Not sure what number was called but we do not employ anyone named ****.

      ******************** vehicle was repossessed. ******* law requires a full inventory of all personal items in the repossessed vehicle. **************** redeemed her personal items on 12/27/2022. At the time of redemption **************** did not make any claim about missing items to our staff. Also, on 12/27/2022 **************** signed a release listing all of the personal items on the inventory list. I cannot upload the aforementioned release document because it contains personal information and federal privacy laws prevent me doing so.
