I was scammed into submitting 2 BOIR to ************************** and paying $349 for each.****** previously required all companies registered in the **** to file beneficial ownership information reports (BOIR). The deadline for submitting these was amended several times.Feb 27, FinCEN (***************************************************************************************************************) and Mar 2, **** Treasury (****************************************************) said for domestic companies they will no longer enforce penalties for doing this and will remove the requirement. On Mar 21, 2025 I was looking up the deadline and found ************************** which said domestic companies must file (= lie # 1) and deadline [is] March 21, 2025. Companies must comply by this date or face severe penalties, including fines of $592 per day, up to two years in prison, and a $10,000 fine for willful failure to file. (= lie # 2).You can see it on this snapshot from Mar 22 - ************************ - in which they then also said deadline was Mar 22, showing they changed the deadline to the current date to scam costumers into urgently filing a BOIR with them, under fear of prison and fines. They do say (at the bottom of the site!) that they are not a gov't agency, BUT the site is skillfully designed to look like that of a gov't agency and the $349 fee was presented to create the impression it was the official gov't fee for this filing -- whereas filing BOIR with FinCEN is actually free.I was scammed by all of the above into believing that domestic companies must file (a lie) and that deadline [is] March 21, 2025. Companies must comply by this date or face severe penalties, including fines of $592 per day, up to two years in prison, and a $10,000 fine for willful failure to file. (also a lie) and submitted BOIR for 2 companies to this website. When I found out and write to them to point out the scam, they agreed to refund one of the charges, but not the other.

    Dear ******,

Thank you for reaching out and sharing your concerns. We are genuinely sorry to hear about the frustration youve experienced with your recent filings and payment.
We want to clarify that our company aims to provide transparent and legitimate document preparation services for clients navigating the filing of Beneficial Ownership Information Reports (BOIR). Our role is solely to assist clients in preparing the necessary documents and ensuring they comply with the applicable rules and requirements.

We understand that when you filed, you did so on the last day as required by the instructions and deadlines provided at the time, and we appreciate your diligence in meeting that timeline. Its important to note that while many services are available for free, some individuals choose to pay for services like ours to ensure that their filings are done correctly, on time, and without risk of error. We understand that paying for a service to ensure accuracy and peace of mind is a decision made by many businesses, especially when they are navigating complex regulatory requirements. However, we also acknowledge the situation youve described regarding the website **************************, and we want to emphasize that we strongly discourage using services that mislead clients by presenting themselves as government agencies or creating a false sense of urgency through misleading claims about penalties and deadlines.

It is important to clarify that ***************** Crimes Enforcement Network) does not charge a fee for filing the ***** and the deadline you mentioned for domestic companies to file is not accurate, as you correctly pointed out. We strive to stay updated on the official regulations and deadlines for our clients, and we take situations like this seriously.

Regarding the refund for the charge you mentioned, we have processed one refund as a gesture of goodwill. Unfortunately, our policy is to offer refunds only when there is a valid issue with our service or the work provided. If you feel that there was a mistake or misunderstanding on our end in assisting with your BOIR filings, please dont hesitate to contact us directly so we can address the matter further.

Again, we apologize for any confusion or frustration this may have caused and appreciate your feedback. We value your business and are committed to ensuring that we provide high-quality service.

Please feel free to reach out to us directly at ********************************** if you have further questions or concerns.

    Sincerely,

    **** **********

In addition, we want to clarify that when you initiated the process with our service, you were required to review and authorize the charges by checking a box that confirmed your understanding of the nature of the transaction. This step was clearly outlined in the authorization form you reviewed before proceeding. By checking the box, you provided explicit consent for the charges, ensuring that you understood the services being provided and the associated costs. For your reference, our Terms of Service clearly outlines our refund policy. Specifically, Section 7 states that "Refunds are available if requested before services are rendered. Services are considered rendered once the FinCEN Identification Number and Beneficial Ownership Information (BOI) Report have been secured and completed. Please note that once the FinCEN Identification Number and BOI Report have been processed and delivered, refunds are no longer available." Additionally, we noticed that when you tried to contact us, it was well past our regular hours of operation, and your inquiry was sent well into the early hours after midnight. Our support team is available during business hours, and we encourage clients to reach out within that timeframe for prompt assistance.

Dear BBB, please note that the response provided by the business is so absurd as to constitute an abuse of the mediation process you are running. It is borderline nonsensical and is not provided in good faith.

    Complaint: 23158070

I am rejecting this response because it is truly bizarre and absurd -- my guess is that it was either generated by an LLM with a really bad prompt, or more likely, that it is purposefully nonsensical to frustrate me into not knowing what to even say:

RE "Our role is solely to assist clients in preparing the necessary documents and ensuring they comply with the applicable rules and requirements. ... some individuals choose to pay for services like ours to ensure that their filings are done correctly, on time, and without risk of error." -- No, you provide exactly ZERO added value compared to filing directly with FinCEN, which is free.  No sane person would chose to file via your "service" if they knew that they can file with FinCEN for free, whereas you would have them fill in the same fields with and charge $349.

RE "We understand that when you filed, you did so on the last day as required by the instructions and deadlines provided at the time, and we appreciate your diligence in meeting that timeline." -- No, I did NOT file "on the last day" -- you lied brutally about the deadline -- as you acknowledge later in your response.

RE "However, we also acknowledge the situation youve described regarding the website **************************, and we want to emphasize that we strongly discourage using services that mislead clients by presenting themselves as government agencies or creating a false sense of urgency through misleading claims about penalties and deadlines." -- But ************************** is your website, it is (or was, at least as of Mar 21 and 22), very skillfully designed to be maximally misleading to look as a gov't site while saying in the small print at the bottom that it is not, including prominently featuring 2 outright lies, whose purpose was exactly to create a false sense of urgency through misleading claims about penalties and deadlines.

RE "It is important to clarify that ****** (Financial Crimes Enforcement Network) does not charge a fee for filing the ***** and the deadline you mentioned for domestic companies to file is not accurate, as you correctly pointed out." -- Yes, you lied about it, and about domestic companies having to file or else being about to face fines and prison.

RE "Unfortunately, our policy is to offer refunds only when there is a valid issue with our service or the work provided." -- But there IS a valid issue:  You lied brutally on your website to fraudulently make me think I must file a report the same day that I was absolutely NOT required to file (ever) and to pay you $349 for it.

    Sincerely,
    ****** *******

    Business Response

    Date: 04/05/2025

    Dear ******,

Thank you for reaching out. We want to begin by acknowledging your frustration and sincerely apologize for any confusion or feelings of being misled. Your experience is important to us, and we're committed to addressing each of your concerns to ensure clarity and understanding.

    1. The Value of Our Service:

We understand your point that filing directly with FinCEN is free, and you're rightmany people choose to file directly to avoid paying any fees. The reason some clients come to us is for peace of mind; we help ensure everything is filled out correctly, on time, and in full compliance with the rules. We also recognize that some individuals may not feel comfortable filing, especially when it comes to legal documentation for the federal government. Many people opt to pay for professional assistance, and we have thousands, if not tens of thousands, of satisfied clients who appreciate our third-party service. If they weren't aware of our terms of service and fell within our refund policy, we provide refunds promptly.

    2. The Filing Deadline Confusion:

We sincerely apologize for any confusion regarding the filing deadline. If the information we provided led you to believe there was a more urgent deadline than necessary, that was not our intention. We strive to be clear and accurate in all our communications, and we regret that we missed the mark here. After careful review of the site we have made many changes once the deadline was no longer enforced.

    3. The Website Issue:

We understand your concerns about the website and how it may have seemed misleading. The last thing we want is for our clients to feel rushed or pressured. If the design or wording on the site gave you that impression, we acknowledge your perspective. However, throughout our website, we clearly identify that we are not the federal government. We'll review the site to ensure it's clear and transparent. Our goal is never to mislead you in any way.

    4. Regarding the Refund:

We understand you feel strongly that there's a valid reason for a refund, and we want to address this properly. While our general policy is to offer refunds when there's a clear issue with the service provided, we recognize that this situation is unique. We'll be happy to review your case again and see if we can reach a fair resolution.
We value each of our clients, and your feedback is important to us. We'd appreciate the opportunity to discuss this further if you're open to it, so we can work toward a solution that feels right. Again, we're sorry for any stress this has caused, and we truly appreciate you bringing these concerns to our attention.

    Best regards,

RE "If they weren't aware of our terms of service and fell within our refund policy, we provide refunds promptly." -- Yes, I was not aware of our terms of service because you rushed me to fie through your service by falsely claiming that domestic companies must file and that the deadline was the same day.

RE "We'd appreciate the opportunity to discuss this further if you're open to it, so we can work toward a solution that feels right. Again, we're sorry for any stress this has caused, and we truly appreciate you bringing these concerns to our attention." -- Great, please provide full refund now.

RE "you were required to review and authorize the charges by checking a box

proceeding. By checking the box, you provided explicit consent for the

    the associated costs."

Some of this is true but overall it is so misleading as to be a lie:  Yes, of course I had to check a box that said you would charge me -- but your site goes to great length to present the charge (called "filing fee" if I recall) as the official gov't fee required to by FinCEN to file this form with them -- and after the first page (which again is designed to fraudulently pressure people into quickly filing a form with you by telling them 2 very clear lies), there is no reference to this being a private company that files with ****** on your behalf (instead of being the only way to file BOIR with FinCen).

So, no the website not only does not do any kind of "ensuring that you understood the services being provided" -- it goes out of its way to obfuscate that.

As indicated in message Sent: 4/7/2025 2:50:27 AM by me:

I am happy to accept an offer of a full refund of the outstanding $349.

The message to which I responded, did not offer that, which is why I rejected it.

    Customer Answer

    Date: 04/09/2025

    Dear BBB,

Could you please explain why the system now tells me that the complaint has been closed as "resolved"? -- My complaint is very much unresolved, as you can see from the messages.

Also, I just noticed that the business (New Way Consulting Corp) has now removed the fraudulent website (**************************) from their BBB profile at ********************************************************************************************************************************

Is this the way it is supposed to work -- a business runs a scam website and when a consumer complains they can simply edit their BBB profile so the website is no longer associated with them?

    Business Response

    Date: 04/10/2025

    Dear ******,

    Thank you for your response.
After careful review and considerationbased on the facts of your case and our Terms of Servicewe would like to clarify that our previous message did not include an offer of an additional or outstanding refund of $349. As such, your interpretation of the message was incorrect, and we are unable to provide another refund at this time.
We have already issued all appropriate refunds in accordance with our policies and the specifics of your case. We understand that this may not be the resolution you were hoping for, but we consider this matter closed on our end.
    Thank you for your understanding.
