On 04/02/2025 BBB wrote to New Way Consulting Corp and asked the business to substantiate or modify their advertising.
The Business website, boiflieservice.com contains language that implies most US businesses must file a Beneficial Ownership Information Report [BOIR].
There are statements such as
1)The Beneficial Ownership Information Report (BOIR) is a new requirement under the Corporate Transparency Act (CTA). It’s designed to increase transparency in business ownership and help combat financial crimes.
2) Who is required to file the FinCEN BOI Report?
Generally, corporations, limited liability companies (LLCs), and similar entities are required to file the BOI report unless they qualify for an exemption.As of March 26, 2025, FinCen has rescinded this requirement for US based businesses. While the Business website displays two disclosures advising the business is not affiliated with the US Government or FinCEN, these disclosures are at the bottom of the main page and are not clearly and conspicuously disclosed as the disclosure cannot be seen unless the user scrolls to the bottom of the page.
BBB Code of Advertising states, "The primary responsibility for truthful and non-deceptive advertising rests with the advertiser, an advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true and misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact."
Additionally, BBB Code of Advertising states where disclosures are required to prevent an advertisement from being misleading, the disclosure must be clear and conspicuous.
The business responded to BBB by sharing that there are upcoming regulation changes, regulations are continuously evolving and any proposed modifications may need to be adjusted in the future.
The company also shared that their website states that only foreign entities are required to file and that FinCen continues to allow domestic companies to file on their website.
As of 4/10/25 the business has not modified their advertising.
