    United States Attorney for the Eastern District of Washington vs. Lincare Holdings, Inc.

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On August 10, 2023 Lincare Holdings, Inc., a Florida-based, wholly-owned subsidiary of German multinational chemical corporation Linde plc, entered into a settlement agreement with the United States Attorney for the Eastern District of Washington to resolve allegations that it fraudulently overbilled Medicare and Medicare Advantage Plans for oxygen equipment [Case No: 2:21-cv-151-TOR (E.D. Wash.)]. Per the settlement agreement, Lincare Holdings, Inc. has agreed to pay $29 million and perform extensive corrective actions.

     

    In the settlement, Lincare admitted that it improperly billed Medicare, MA Plans, and beneficiaries for oxygen equipment rental payments and co-payments after it had already received 3 years of payments. Lincare admitted that it lacked adequate controls to ensure that MA Plans and beneficiaries were not improperly billed after 3 years of rental payments had already been received.  Lincare additionally admitted that for traditional Medicare recipients, it had controls in place to prevent improper billing, but that those controls were not always effective.  Finally, Lincare admitted that when Lincare employees raised concerns about Lincare’s billing practices, Lincare officials in its Regional Billing and Collections Office located in Spokane Valley, Washington, and at Lincare’s corporate headquarters in Clearwater, Florida, instructed them that Lincare would continue its billing practices.  The settlement announced today resolved claims that Lincare’s conduct violated the False Claims Act.

     

    As part of the settlement, Lincare entered into a 5-year Corporate Integrity Agreement with the U.S. Department of Health and Human Services, Office of Inspector General (HHS-OIG).  That Agreement requires, among other things, that Lincare implement a robust compliance and reporting program as well as a number of significant billing reforms and practices.  Additionally, the Agreement requires that Lincare retain, at its expense, independent experts to review its claims and billing practices to ensure they are appropriate.

      So I have been using a CPAP machine since December. They are required to replenish supplies within a time frame of 30 days, 60 days, and 90 days and so forth. Last month I was supposed to receive a new water chamber, a new filter, new tubing, new headgear, basically everything it originally comes with minus the machine. Well I find out from preferred homecare that they dont have a prescription to release the supplies. Theyve been on hold since March 15th. I was told it would get escalated and they would get the doctor to fax over everything. Its over a month and a half and nothing. My doctor has handed me two physical copies of the orders he sent over to get the supplies released. I have no idea whats going on at preferred homecare but they need to either do their job or get shut down. They are supposed to be handling equipment for people who are disabled, elderly, people who need oxygen tanks. Yet they are terrible terrible at taking care of things. They need to be shut down. This company needs to get shut down. To make someone wait about two months for new supplies and then the other reviews Ive seen where kids have gone without oxygen cause of this company. I hope the state of ******* does something. This is unacceptable. My doctor even printed out the email showing that preferred homecare received the order of the prescription. Yet its supposedly no where in their system and they never received it or they received it without billing codes. Again shut this place down or investigate the company till they do better. ******* lives are depending on this company and I wonder how many people have died due to the negligence of preferred homecare.

      The man that came to our home to service my wife's oxygen machine was very pleasant. He could not be more kind and interested in pleasing us. He took the time needed to answer all our questions. I was impressed. Most people are in a hurry to get in and get out. He took his time and helped us understand the machine. He is from the ****, ** store. THANKS Lincare for taking care of all our oxygen needs.**********
