    Real estate agent ******************* AND broker ********************* refused to terninate my listing or to withdraw the listing from the *** at my request. I entered into the listing contract with ****** on or about Jan. 15, 2024. I have neither a hard or electronic copy of this contract. ****** was regularly unresponsive to both email and text messages and did a completely unsatisfactory job trying to sell my house which is presently a distressed property. ****** and his broker Hollow, denied my requests to remove the *** listing after I decided that I did not want to do business with these people. Their intention is to take advantage of the fact that the property in question is under foreclosure. I do not have time to waste with their efforts to tie up the property after my reconsideration of the listing contract with ReMax Realty Team of **********. Before I decided that I wanted to terminate the contract, I had misgivings about ****** as he advised me to list the property way below its value while agreeing to a 5% total comission to be split between himself, his broker and a potential buyer's realtor. We had a verbal agreement that the contract was open to myself bringing the buyer but ****** offered me only 1% if that were to happen, not the higher commission which would go to a buyer's realtor thus awarding him 4% if I brought the buyer. ****** used my description of the property and placed only 6 of my pictures of the property on the listing. He was given access to 70 of my photos but didn't use them and never suggested any professional photography. He said photos don't bring buyers and discouraged the idea of open houses. He never showed the property one time. The efforts he made for his commission were limited to him having me sign a contract, listing the property on the *** at his low sale price for three days until I realized how underpriced it was, changing the listing price and sending me notifications via text or phone calls about around ten or less scheduled showings. After a month, I had the solid impression that this realtor was interested only in his profit for the least amont of effort. On Friday, February ***************************************************** this arrangement and requested that he terminate the contract and withdraw the listing from the ***. He said that he would work with his broker to terminate the listing. On Monday, I found that the listing was still active so I called ****** on the phone asking what the problem was. He sited that this action must be done by the broker ******* HOLLOW and that she was not in the office all day on Friday and that now, February 19th was a holiday. When I expressed my dissatisfaction with this delay he accused me of wanting to list with another agent and told me he would not terminate the contract. That afternoon, 2/19/2024 I spoke with ********************* on the phone and she made it a point to make me firmly aware that she was the boss and owner of the company. I told her that I was no longer interested in keeping my property listed with her company but she said "SORRY, YOU WILL HAVE TO USE ONE OF MY OTHER AGENTS". I confirmed that I was not interested and also uncomfortable with my knowledge of real estate law. She said she was willing to have one of her powerful attornies explain to me or a friend of mine, her reasoning for not abiding my wishes and I nervously got off the call. It took days of my insistence and numerous requests to get the listing withdrawn on Thursday 2/22. They refuse to terminate the contract and since I am in foreclosure it is unefthical to bind up my property from any potential sale.

    *********************** called me on December 26th 2023. He stated that a neighbor had suggested that I might be able to help him sell his home before his lender could schedule an online auction date. I meet him at his house that afternoon and he signed a listing contract. He furnished a description of the home and furnished pictures of the home for the **** It was listed that same day for the suggested price of $699,000.


    **************** from Century 21 Sunbelt showed the home on December 29th 2023 and her buyer made a full priced offer. This was presented to *********************** on December 31st 2023. **** decided to not respond to the offer at that time because buyers knocked on the door and he thought that they may also make an offer, which did not happen.


    **** stated on January 3rd that he wanted to raise the price to $749,000 so he would have enough money for his next move. The price was raised on that date. Several showings took place over the next month without receiving any offers. 


    About a week went by without any showings scheduled. **** called me on Friday February 16th ********************************* to speak to my broker and ask to have the listing contract cancelled. He stated that another agent that was a friend of his had changed brokerages and he would now like to list the property with her. He called me Monday morning February 19 and asked if I had spoken to my broker. I stated that I had not had the chance yet and that I did not think that another agent should have been speaking to him about listing the property while it was under contract. 


    This started **** on a path of texting threats and excuses as to why he should not have to honor the listing contract he signed. An agent from ***************************** asked to show the home on February 21st when I sent a text to **** to confirm the showing he stated that the property was no longer for sale. He asked that the listing be withdrawn from the *** which was done on February 22nd 2024.


    I offered **** three options.
    1. To reassign the listing to any of the agents in our office, my broker would schedule an in-person meeting so that he may interview the agent, 2. Transfer the listing to his friend and 3. The broker personally would handle the listing.

    I am rejecting this response because:
    There are so many lies and inaccuracies in the response that this man will obviously not face how him and his evil broker treated me or do anything to resolve it. His dates and statements are not even close to correct. I had to file a complaint with the ******* ********************** (FREC) over the ethics of their performance and they have not even made him give me a copy of the contract which I never received from him, let alone terminate it. They won't release my property. This man AND his broker Ms. HOLLOW are the most inept, unethical people I could even imagine doing business with. They only care about taking as much money as they can for doing as little as possible. They are what gives the realtors a bad image.
