5 Star Reviews was to market my law firm on ******. They overcharged me - I questioned the performance and the costs. They continued to charge me and tell me that they were providing services. My site was not performing. I kept questioning the lack of business being ***** to my business. I continued to have issues. The told me I had rankings and I did not have the rankings they told me I had. When I pushed cancelling they told me they were going to destroy my rankings. Then they sent me emails stating that they were going to destroy my online presence. They charged my **************** without my permission. She paid us every month for numerous services including:

During this period of paying us for over 4 years she never complained about services not rendered as agreed or not as advertised. (page 1-6)
On 10/9/23 she asked us to provide information on her services and what she was paying us. (Page 7)
In April 2024 she asked us for a proposal to expand her web site and on line presence thru our associate **** ****** of ************ (Page 8-10)

The documents provided prove that **** ****** was provided all services she paid for, used them for over 4 years, never complained about them and is still using them for her practice and not paying us. This is a baseless complaint.

My initial yearly contract expired, and I never signed or agreed to a new contract. I became a month-to-month client, and they falsely charged me a cancellation fee. They started harassing and threatening me via email. They stated they were and did file a complaint against me with the BBB. They advised me that they would file complaints with the State Bar and ***************** They threatened to contact various credit card companies to get my cards canceled. My website never performed, hence why I hired a new marketing agency. My agency has provided me with proof that I never ranked high on ****** searches. They kept preventing me from canceling. 5 Star ***************************** and Mediationcom LLC are all one company it appears. In December 2020 I made an agreement with 5 Star Reviews for the purpose of increasing my ****** Business reviews and my status as a Realtor. In March of 2021 I called them to cancel, but they talked me into continuing but decreased my monthly payment. I also did this in June or July ************************* November 2023. All times they talked me into staying, but reduced the rate. Now, I am retiring, and I really did want this cancelled. So, in April I called to cancel and told them I was retiring. I was immediately charged $417 by ******************** and $897.00 by Mediationcom LLC. 1) I never had two accounts. I only had one. 2) I do not believe I authorized these agreements. As I remember, they were verbal and month to month. The document provided thru my charge card company could have been authorized by any email. They refused to send proof that I authorized these agreements. 3) If I do owe them anything, it should be 3 times my last rate of $49.99, not a total of $1,314.00 Based on previous complaints I see here, I am not the first victim and will undoubtedly not be the last. I specifically asked them to provide me proof that I authorized these agreements and they refused. I negotiate contracts for a living. I highly doubt that I would have missed the in bold cancelation policy and I certainly would not have agreed to it if I had. This is blatant fraud.Business Response

Unfortunately, ***** Fargo neglected several key issues here.
1) I only had one account. See the payments I made. I only made payments to one or the other of their companies every month, not to both.
2) I do believe this is fraud. I do not believe I accepted these agreements. I have asked for proof that I accepted these agreements and they refuse to provide that. This type of agreement could be sent to any email and executed. These do not prove that I accepted them.
3) I was told in a conversation about any rate change and never received any documentation. It just changed on my monthly billing. This is further evidence that they are setting clients up for high cancellation fees by not providing documentation of the account rate change.
3) I do remember calling them as I did not recognize the name on my account statement and was told who they were and that sometimes they put the monthly fee in one company and sometimes the other. Again, I only had one account.
4) My rate at termination was $49.99 per month. Not even close to what they are charging me.
5) The fact that there are numerous complaints here, justify further investigation.
6) If I do owe them a fee, it should be $49.99 times 3. BUT, only if they provide proof that I accepted these agreements.

2) I do believe this is fraud. I do not believe I accepted these agreements. I have asked for proof that I accepted these agreements and they refuse to provide that. Any legitimate contract acceptance program provides a document that shows what email it went to and who signed with the date and time.
3) I) was told in a conversation when we discussed and agreed upon a rate changes and never received any documentation. The rate just changed on my monthly billing on my ***** Fargo Statement. This is further evidence that they are setting clients up for high cancellation fees by not providing documentation of the account rate change, AND on the first rate change is when they issued a document from their other company - that I never signed!! They never created these documents on future rate changes..Future documents had they been created would have ended up at $49.99 per month.
4) My rate at termination was $49.99 per month. Not even close to what they are charging me.
5) The fact that there are numerous complaints here, justify further investigation.

Thank you for your response. In my original complaint, I uploaded the letters received from ***** Fargo that also included the agreements. While these agreements are from different companies, I only had one account. There are two major things here. ***** Fargo states that this shows I accepted the agreements. These agreements are not your standard docusign agreements and ***** Fargo did not require proof that these agreements went to MY email and were accepted by me. I am asking for that proof.
Also, if you look at the payment history, you will see I only had ONE account, not two and that they randomly processed payments to which ever company they wanted to funds to go to. My last agreed monthly payment was $49.99. I do not believe I ever signed or accepted any agreement with either of these companies. It was just a month to month agreement. I am uploading the documents again here for you.

In September, 2023, I terminated my service agreement with this company which I had paid for helping "clean up" a negative review on my law firm's website. *************************** signed up for our service on 11/27/20. He is correct that he cancelled the service and was told he was billed for the final $99 monthly payment. I enclose a copy of that receipt. He also was sent a receipt on 3/17/24 detailing the termination fee he authorized and agreed to when he signed up on 11/27/20. That is also enclosed. I have attached the original agreement submitted by **************** that discloses the termination fee he agreed to pay "upon termination". You can see in the documents he clicked to accept the fee, he was sent a confirm of the submission and he received a welcome letter that stated thanks for signing up which he could not receive without submitting the form and accepting the fee. It is time stamped and dated. The fact is **************** is trying to play semantics by saying he paid a final payment when he knows that was the final monthly payment but he still owed the termination fee he authorized on 11/27/20. Our documents prove he just doesn't want to pay what he owes.

I am rejecting this response because:I made numerous attempts to cancel the "service," but the company would not allow me to do so without speaking directly to ****************, their Sales Manager. I had a telephone conference scheduled with him for that purpose on June 15, 2023, but it was cancelled. It took several months to reschedule, and we finally did agree to terminate the arrangement in September, 2023. Therefore, I paid them for July, August and September, after I tried to cancel in June, so they've already been paid for their three month "termination fee." Their obstacles to terminating the arrangement were nearly insurmountable.
As you can see from the attachments to their Response, the monthly amount I paid was reduced from $139 to $99.99 in 2022, so if I did owe this "termination fee," it should have been $299.97, rather than $417.00. You can also see that the attachment dated September 13, 2023 stated "No further payments will be processed." This language constituted a waiver of the so-called "termination fee."
Finally, the company representatives are rude and disrespectful. In an email exchange with *****************************, he referred to me as "a jerk" and he threatened to report me to credit rating agencies and the ********************* because I dared to challenge this disputed charge. Mr. ***** was also very disrespectful to me when we finally spoke in September of 2023 to cancel their "service." This company did almost nothing for me despite receiving in excess of $4,000.00 from my credit card.
Based upon the above, I believe they have been overpaid and they ought to issue me a refund.

**************** is mixing the facts. First of all the form says it's a termination fee based on the stated amount in the form which was $139 per month X3 is $417 the amount he was charged. Second he can cancel at any time the form says it's a month to month agreement. The bottom line is **************** clicked to accept the fee in the agreement which could have not been submitted if he didn't not check the box to accept the fee. The forms speak for themselves.

I am rejecting this response because:As I stated in my previous response to their initial response, due to the lengthy delay in accommodating a "telephone appointment" to cancel the "service," delaying the appointment for 3+ months, should have satisfied their 3 month "termination fee." If it takes that long to simply tell them I wanted to cancel the "service," then, it is unconscionable to send an email stating "No further charges will be made to your credit card," and then, almost 6 months later, suddenly charging my credit card. When their agent agreed to lower the monthly fee from $139 to $99.99, they should not be able to renege on that agreement and revert to the $139 amount.

2/16/24 I bought a lifetime listing from this company approximately six years ago. For a few years after ********************************* would call and ask if I wanted to join the listings on mediation dot com. I reminded her I had a lifetime membership which she then supposedly confirmed.They then began calling about ****** Business page promotions. At first I declined but decided to go forward based on info in *******'s email on approx 3 Oct 2023. I contacted them 5 weeks into the process to say there needed to be changes--that the "products" were not accurately listed * OCt 2023. No response. I was going to cancel in January when i got a call from ******* assuring me that the tech ****** would be in touch. Three weeks later nothing...*** called and demanded payment for Feb on 3 Feb. I told him on 5 Feb (first work day) that I was cancelling the services because they had not been provided. See description of what was supposed to happen if my numbers did not go up (which they have not resulted in any more calls than prior to this promotion that went on for FOUR months. See 4 Oct 2023 email bold faced type)*** then used obscenities directed toward me and told me I owed him money and he was taking my life time listing down. He insists there is a termination fee. lifetime listing is not mentioned AT ALL in this contract and they have
failed to give you *******'s email that I sent to you in which she laid out
the fees (not ***** but 99 for example) NO MENTION OF A CANCELLATION FEE.
And as noted the services are charged at the beginning of the month for the
month. I cancelled at the beginning of Feb and owe THEM NOTHING>
I want my lifetime listing reinstated; the upgrades to my business google
page reinstated.
And if I will be contacting an interagency fraud unit which includes the
*** to investigate this company if you cannot help me resolve this issue.

These people are total ripoffs and it would be good if their business was

It was very difficult to cancel with this business. When I attempted to cancel in December 2023, nothing happened and I was billed in January. When I called after I saw I was billed the person I spoke with had a terrible attitude after I said I wanted to cancel. He misrepresented who he was, saying he was the answering service when he was not, and I when I objected after he told me he would refer me to the "cancellation department", he called me a "f cking a sh ole". I complained to my credit card company and filed a dispute over the January charge. The next day I saw I was double charged over $700.00 to cancel (additional 3 months of monthly charges) . I am disputing these cancellation charges as well. The so-called agreements with notice of these charges they say I agreed to by checking a box are fraudulent. I never agreed to these cancellation charges nor did they ever tell me about them. STAY AWAY FROM THIS BUSINESS. She asked to see the agreements and she was sent the agreements which I also attach and clearly show she was disclosed the termination fee when she signed up and she clicked to adccept the terms and conditions. Please note the confirm of the submissions are time stamped and dated. The code also contain a UUID. After she received tha agreements she then complained we did "nothing" That was another lie by *****************************. The facts are and were provided to her as follows:
1. We did a mailing to the client list she provided us on 12/3/22 We sent her an email confirming that mailing. We have the ****** report showing opens, replies and actions provingthe mailing was done
2.We added posts to her ****** Business page on 10/14/23 and have a ****** report showing increases in your calls from your page, calls for directions, web site clicks and views.
3. Your ****** rating went from 4.2 to 4.6 since we built your 5 Star page and started adding reviews.
We provided her with value and benefits to her practice and after she terminated we have to remove our propritary links and content and have to pay a 3rd party to do so so there is a termination fee, She is not *********** any refunds.
