I ***** **** owner **************************** is a owner operater truck driver. and is factored bi eCapital Freight Factoring.. On June 5th 2025 I gave 60 day notice in advance that i will not be renewing my contract with eCapital they responded 2 days later that they received the message.The current Factoring Company i was set to sign with reached out to eCapital on several occasions to start the buyout proceedings for any outstanding invoices that i have in my account ...They sent emails starting on august 8 there was no response, then August 11 no response, then Aug13th finally there was a response just 10 min before closing they closed at 4pm ..****** from eCapital responds back in email stating she need permission from me to access my account..mind you, the workday is over and impossible to send a response in time. I sent a email at 4:42am August 14th stating I give permission for the new Factoring Company to access my account information for the buy out. Ecapitol " ******" purposely ignored the buy out process until the final day of my contract...my contract was due to expire on August 14 11:59 pm.. she is stating that all invoices had to be paid prior to my anniversary date so she put a $3000 early termination fee on top of $750 buy out fee..I'm willing to pay the $750 dollar buy out fee..but due to the fact she purposely ignored the Factoring company that was willing to buy out all my outstanding invoices....if there was a problem with confidentiality so she says. why ignor until the last minute she could've responded and said that on aug 8th or the 11th not the aug 13th 10min before ecapitol closed for the day were it's impossible for a response. ..She ignored them just to keep me trapped.. i sent the email at 4:42am before the workday on the aug 14th giving permission for the buyout. Its a shame and bad business for a company to try and make people stay with them. Every years they make it impossible to leave your contract ..what a horrible experienceBusiness Response

Thanks for giving us the opportunity to respond to this issue via the BBB.
After researching our system/database it appears that ***** ***** is tied to an account by the name of ****************** eCapital received an online application on 04.08.22 and a signed contract, signed by ***** ***** on 04/18/22. When the client stopped funding with us we were left with a balance on the account due to some charged back invoices. We would need to be paid in full for that balance. If the client is still needing a copy of their signed contract they may contact ********************************** for assistance. Thanks!

I started a trucking business 1 year ago and purchased a box truck. I set up a new account with ****************** the summer of 2024 to get things going with the business. I submitted my first invoice for factoring on August of 2024 for $450. I then learned that most shipping companies and brokers will not work with new carriers with Motor Carrier numbers under a year old. I was unable to secure loads and had to put the business on hold. I then had to put my father in a nursing home. I was able to purchase another over the road truck and started working again on 6/9/25 just over the 1 year requirement. I submitted an invoice via the eCapital account for $800 on 6/10/25. I attempted to use my eCapital credit card on 6/11/25 only to find out it was on hold. When I spoke to customer service I was informed my entire account was on hold for inactivity. Even after I purposely left my original invoice sitting in the account to keep it active. I had to wait until the next day for a director at eCapital to email me that my account was terminated. It took 2 weeks to set up another factoring company and cost me a lot of time and lost work. If eCapital put my account on hold, why wouldn't they notify me in some way and why did they allow another invoice to be submitted. They made me do many communications with various departments to get only $338 of my invoiced $450. They should have given me the entire amount back for the inconveniences they caused me to go through.Business Response

Thank you for giving us the opportunity to respond to this complaint through the BBB's Platform. As indicated by *** ****** an invoice for $450 was factored on 08/28/2024. As outlined in the terms of *** ***** agreement, we advance 95% upon purchase, and charge a 3.65% factoring fee. However, included in the agreement is a $35.00 minimum invoice fee, which is required to charge if the 3.65% factoring fee does not meet or exceed the $35.00 minimum. Additionally, as outlined in the agreement, a $75.00 documentation fee is charged upon first funding, as well as a $2.00 invoice processing fee.
Since the client's factoring fee of 3.65% does not meet or exceed $35.00 as outlined in the agreement, $35.00 was charged to this invoice, as well as the documentation fee ($75.00) and invoice processing fee ($2.00), leaving the client with $338.00 available to release. Due to a shift in organizational strategy, we decided it would be best to allow *** ***** an opportunity to terminate our agreement without penalty, which occurred on 06/17/25, and the $338.00 was sent via ACH to *** *****.

I am rejecting this response because: eCapital put my account on hold without any prior notification. If eCapital had an "organizational shift" and wanted to cancel my account, they should have notified me in advance, so that I could setup another company and not have to close my business for the transition. eCapital had a hold on my UCC so as to prevent me from changing factoring companies without their prior approval. I understand the fee structure, but given the major inconvenience they put my company through, I feel that they should refund the entirety of the invoice as compensation for the lost business my company suffered. The amount requested is a very small amount to the lost time and invoices on hold (an invoice was submitted to eCapital for factoring and had to be re-submitted to another company over a week later delaying payments, after being allowed to be submitted to eCapital). Again, I only learned the account was on hold after having to call in to find out why the credit card associated with account was rejected.

I am rejecting this response because:
It is a clear fabrication of the truth. E capital attempted to illegally force me in to renegotiation of a written contract. E capital used predatory tactics such as threats of withholding funding to achieve this goal. I refused to enter Renegotiation and It is clearly laid out in the emails. E capital is very much aware of me not being assigned to a new lender. I had no interest in forming a new relationship with a new lender. I was put into a compromising position and my business suffered financially due to the forced need for a lender. In retaliation to me, refusing a second demand for renegotiation of the written agreement e capital sent notification of termination of the business relationship. They gave me 10 days to find a new lender. This was over Memorial Day weekend. I was unable to do the proper research on the lenders that serve as factoring companies. Due to the short window, I was forced to seek out a new lender. I was not assigned a new lender. The process was not that simple. E capital is using word play to down play the severity of the situation. My business suffered greatly. I was unable to secure freight due to the fear of expenses associated with freight and not being funded. I was also unable to provide income for an employee due to the funding issue with E capital. I am currently still recovering financially. I have much more documentation if needed. Also, there are recorded phone calls of my dealings with E capital about this matter.

Prior to contracting with eCapital, we had several options for factoring. However, after speaking with a sales *** who asked what we were looking for and what we liked about our last factoring company, he assured us that we would have a seamless transition--we'd have immediate access to fuel advances primarily.Sadly, after signing the contract, we were told we do not have access to fuel advances and our cutoff time for submitting ppwk was now 10am.More disappointing is the amount of time it takes for eCapital to process invoices.Customer Service ***s appear to be overworked and underpaid, while management hide, duck and dodge customers constantly.After being misled by the Sales **** he also went into hiding. He refuses to return calls; hes also blocked our company, so thay all calls are sent to vm.After weeks of missed payments and nearly having our insurance terminated due to delays in processing, we asked to leave, but eCapital wants a ridiculous amount of money for doing so.Your retention rate reflects the contentment of your clientele. Thank you for giving us the opportunity to respond to this complaint on the BBB's platform. To begin, we have reviewed all phone calls between D and D Transport and our Sales & Onboarding Team. At no point during the sales or onboarding process was D and D ever informed they would be eligible for our Fuel Advance Program. As stated under the "Fuel Advance Program" section of the attached Factoring Agreement between D and D Transport and eCapital,
Fuel Advance Program Fuel Advances may be made to Seller at Purchasers sole discretion subject to the following requirements and limitations: (i) maximum Fuel Advance amount of the lower of fifty percent (50%) of the Face Value of the future Account or three thousand dollars ($3,000); (ii) goods to be delivered associated with the future Account must be loaded on to the Sellers truck but not yet delivered; (iii) the Account Debtor on the future Account has been credit approved by Purchaser; (iv) a late penalty of one tenth of a percent (.1%) per diem shall accrue on the Face Value of the entire future Account for which a proof of delivery sufficient to evidence an Eligible Account has not been provided by Seller to Purchaser within ten (10) days of the provision of the Fuel Advance by Purchaser to Seller; (v) no other advance may be taken by Seller from any other party on a future Account for which Purchaser has made or will make a Fuel Advance; (vi) any checks or payments of any kind received by Seller on a future Account for which Purchaser has made a Fuel Advance must be forwarded to Purchaser without first being deposited or otherwise uncashed; (vii) Sellers eligibility to receive Fuel Advances may be revoked at the sole discretion of Purchaser at any time; (viii) the maximum number of Fuel Advances the Seller may receive in any given time period under the Fuel Advance Program is determined at the sole discretion of Purchaser and may be changed by Purchaser at any time; (ix) Seller shall pay an Fuel Advance Fee to Purchaser on each future Account for which Purchaser makes a Fuel Advance in addition to, at the discretion of Purchaser, expenses (both out-of-pocket expenses and allocated internal costs) incurred by Purchaser in connection with the transfer of the Fuel Advance to Seller.
Additionally, regarding the termination of account, as per section 13.4 of the terms and conditions that govern the agreement attached;
Seller may give notice to terminate this agreement without incurring an Early Termination Fee provided such notice is given 60 days prior to the end of the then-current term. If no such notice is given, this Agreement shall be automatically extended for a Subsequent Term or further Subsequent Term. It is agreed that during and after any notice this Agreement shall continue to be in full force and effect until Purchaser releases its lien in accordance with paragraph 16 hereof.
This agreement was executed on 01/21/2025, with a 12 month contract term. All information regarding fees associated with an early termination were also provided by our Retention Team to D and D Transport on 03/24/2025.

eCapital has breached their contract multiple times by failure to perform, resulting in many additional man-hours of work by ***************************. The eCapital Contracts Team has failed to address these breaches of contact. We proposed early termination with no fees between either party due to eCapitals repeated breaches and believe that is still the best option for all ********** name a few of the breaches since weve been with eCapital, they have denied invoices for reasons outside of our contract; these invoices are not funded within the agreed period, and their portal has regular issues, impacting our ability to access our account properly. Most recently they denied invoices for reasons outside of our original contract and as a result, declaring we were in default. The default they are claiming, (g) Seller suspends or discontinues its business as conducted on the date hereof for any reason, or at any **** ****** has not submitted Accounts to Purchaser for purchase for a period of ninety (90) days, did not occur. According to eCapitals records, on 12/9/2024 an invoice was submitted and then the next was submitted on 3/4/2025; a period of 85 days.With less than 90 days left in our contract, eCapital is demanding $2,500.00 for an Early Termination Fee, a $750 termination processing fee and threatening other fees as well. Our Available cash balance funds are being held hostage with ******** refusing to release those funds currently. We propose early termination with no fees between either party, immediate release of funds due to *************************** and the letter of release due to eCapitals repeated breaches of contract.Business Response

I am rejecting this response because I've reviewed the response given by eCapital here as presented and it does not align with the facts presented.
After the reply from eCapital was made here, an email was sent to *************************** by with a General Release request stating they were willing to provide a General Release and waive any necessary termination fees and release all funds in our cash reserves upon signature of the release, to us in order for both of our companies to move on. Given the nature and verbiage of the General Release received, we will have our council will review it once they are available as they are currently out of town. Available Funds are still being held at this time despite *************************** not being in "default" or "dormant" with eCapital. We hope to work out a resolution with eCapital soon.

Imagine booking a load Monday morning, drive for 3 days east, arrive Thursday at the shipper, hustle for them to unload, get all pertinent paperwork ready, signed BOL, scanned properly, photos of trailer and submit all of it that same night. Go to bed planning that next day youll be funded by ECapital only to wake up to $0 in your cash account. You calm yourself down and call to see whats the reason for non purchase. After waiting in hold for a good 10 minutes, you get hold of Funding Assistance **** her or she puts you on hold for another 15 minutes, then comes back with a response like this load is going through the verification process, it should clear in the next 20 minutes and itll get purchase, dont worry about it an hour past, no funding, again, you call back, only this time you ask to speak to your account manager. Straight to voice mail, no call back! You keep trying and trying, go through Funding Assistance again, same answer! Before you know it, you get the famous recording youve reached ECapital after normal working hoursYour whole world comes crumbling, youre 2500 miles away from home, cash strapped, fuel bill to pay, if not paid, theyll deactivate your fuel card. Probably you have insurance bill due or mortgage..Now, imagine this story keeps happening every week, with every load and instead of one truck, you have 6 or 7. Drivers are expecting their pay, banks their monthly payments, fuel company their weekly invoiceThis is ECapital in a nutshell! eCapital Freight Factoring and I ( ******************* ) entered into invoice factoring agreement for one year on December 8th, 2023. Having gone into the factoring work, I observed some unexplained charges and other fraudulent deductions like Escrow that were never paid back to my company to date. In an attempt to know how my escrow balances and how I can get it, no reasonable explanation was ******** November 2023 prior to my contract expiration, I requested to terminate my contract which they refused to do. After the contract expiration date, I continued to request contract cancellation but all fell on deaf ears. Instead, they informed me that my contract has been automatically RENEWED. I further challenged them that I did not approve a renewal on grounds that they levied unexplained charges which is otherwise considered as fraudulent business practice. At this point, I am looking to cancel the agreement with no penalty as they did not seek my consent before renewing the contract. A contract should always be an agreement between two parties and not a decision of one party for the other. I was forced into another year agreement without my consent which is unacceptable. Finally, I need the contract cancellation without the $2,500 penalty and issue my Release Letter.Business Response

We would like to thank the BBB for the opportunity to respond to Mr. ***** complaint on this platform. As mentioned in the complaint, Mr. *** entered a factoring agreement with eCapital on December 8, 2023. I have attached a copy of the agreement executed by Mr. *** for reference. As outlined in section 13.4 of our agreement, "Seller may give notice to terminate this agreement without incurring an Early Termination Fee provided such notice is given 60 days prior to the end of the then-current term. If no such notice is given, this agreement shall be automatically extended for a Subsequent Term or further Subsequent Term. It is agreed that during and after any notice this Agreement shall continue to be in full force and effect until Purchaser releases its lien in accordance with paragraph 16 hereof." As ****** has mentioned, we received notice of termination on November 22 2024, which does not satisfy the 60 day notice prior to the end of his current term. Therefore our agreement extended for a subsequent term.
With regards to claims of suspicious fees, and unpaid escrow reserves, a member of our **************** team will be reaching out to Mr. *** shortly for further clarification regarding these claims.

The customer service is horrible, they switched customer service **** continually. We followed all the procedures to cancel the one year contract with them and now they say we owe $750 to $5000.00 to cancel the contract. They will not give me a letter of cancellation so I can move forward. THey say I am still in a contract with them. It has been a horrible experience and I would not recommend this company to anyone.Business Response

Good Afternoon,
I reviewed your account and see your account was never terminated. You sent in notice to terminate in September, we reached out with no response, however all steps were not completed as per section 13 of the terms and conditions.
Your contract (attached) renews annually on 12/19, this means you are currently within contract term.
The following requirements need to be met to terminate, as per section 13 of the terms and conditions;
RECEIVED - Written notice to terminate sent to ********************************************************** or mailed in 60 days prior to the renewal date
Continue factoring and have all obligations paid out prior to the renewal date
The $750.00 termination processing fee paid and received prior to the renewal date
Should you wish to terminate within contract term, meaning prior to 12/19/2025, then the early termination fee of $5,000.00 would also apply.(5% of your account limit of $100,000.00)

I did terminate my contract. I will just talk with the Better Business Bureau and they will help get this resolved.

The termination requirements were met and every time you tried to call someone there to talk about the issues the **** answering the phone always said they were not allowed to transfer you to a management or person in accounting or they would get in trouble. ************ is horrible!!Customer Answer

I am rejecting this response because: I am not willing to sign anymore paperwork that they give to me to sign, however I do need a letter of cancellation from them immediately and they will not let me talk to anyone in contracts to get this resolved. Just a simple letter of cancellation from them and they can even send it to the other factoring company that we are trying to do business with.
