In August 2020 (during COVID), the studio began live streaming classes, so I purchased a kickboxing bag to use at home and continued paying the monthly rate of $132.94. I have since asked staff on multiple occasions whether the studio offers a virtual only option since I workout at home. When I inquired in August 2020, I was told they didn't offer virtual only because the "monthly rent is too high" and they couldn't offer memberships at a lower rate. In February 2021, the studio sent an email (attached) stating that classes are available on demand via the "unlimited membership OR virtual membership". I inquired whether virtual only was now an option and again was told it was not (see attached). I have since been paying the monthly fee of $132.94 and have been doing virtual classes. Last week I reached out to the studio regarding an Amazon gift card that I never received for a referral, and asked again about the virtual classes since I still do not go to the studio. I was surprised to hear that it is an option for $79.99 per month. Per the attached email, staff informed me that the virtual only classes have been an option for a "few years now". I asked why this was not communicated to members - no phone calls, no emails, or any social media posts and I have not received an answer. I then requested to be reimbursed for overpaying approximately $50 per month, ($132-$79) and was denied the request. I then reached out to the owner of the studio, Vic Cutrone, who also refused to honor my reimbursement request. (see attached emails). Also, when I asked Mr. Cutrone how long virtual has been an option, his response was "sometime in 2020 due to covid but don't know exact date". He also referenced provisions of the contract which are inapplicable here. Specifically, "we reserve the right to sell memberships at different rates". I responded that here, the business was deceptive and withheld material information from members.
