      Early Oct. 2023 my husband called the company and explained the problem with the glass panel in our sliding door. About 1 week later they came out and took measurements to replace our glass panel. He explained could not be repaired as seal was broken, needed to be replaced. Paid down payment of ******. Installed glass on 11/30/2023. On 1/13/2024 we noticed moisture between the glass., indicating the seal was broken again, and had no insulating value. Same problem as our old glass. Called company on 1/15/2024. They came out on 1/21/2024.no moisture was visible at that time however we had taken pictures of it. He said he would contact manufacturer and get back tp us. When he called back he stated he would reseal the glass, even though he told us that was not an option with our old glass. Than he said manufacturer would replace glass but we would have to pay for them to install. We already paid for this service and glass was defective. So we declined. My husband called his bank and filed a dispute for the the cost of the job which was including down payment, ******. Because it was broken down into two payments the bank only noticed the ****** payment but later also filed a dispute for the down payment. The bank decided in our favor, and the down payment is still disputed. Now the company has put a lein on our house. All we wanted was a new double paned glass for our door. If we had recieved what we paid for there would not have been a problem.

      If full payment of original estimate and invoice of 833.25 is made by customer, the lien will be canceled immediately.

      Lightning Glassworks would be happy to continue working with customer. A labor charge of $139.95 will need to be paid in cash for Lightning to again install manufacturer glass, with the ~$700 material being covered by manufacturer. Lightning Glassworks will then have manufacturer make a new double pane glass unit, and install the new glass. Customer will also need to make full payment of original invoice in cash, including added dispute charges and fees. Total amount: ******. Lightning Glassworks will also need another contract signed by customer with the same above terms, namely:  I will not attempt to seek any legal judgement against Lightning Glassworks for any reason. Any dispute I have with Lightning Glassworks & Screens must be exclusively negotiated with Lightning Glassworks & Screens. I further agree that late payments, returned checks or non-payments is subject to additional fees, collection fees, & legal fees, which I am responsible for. 

      The timeline of events is as follows:

      Glass installed 11/30/23. Customer signed off on project including the following contract terms that were also included on initial estimate: My signature above acknowledges that any products & services provided to me by Lightning Glassworks & Screens have been delivered to my satisfaction. Any further alterations will require further payment. Lightning Glassworks & Screens warranties certain products & services against defect or damage. The warranty will be stated on the quote or invoice. Any breakage or defect of any product or service provided by Lightning Glassworks & Screens will not be covered by Lightning Glassworks & Screens unless a warranty is agreed to & stated on the quote or invoice before work begins. I agree to tell the truth in any online review of Lightning Glassworks & Screens. I agree to pay Lightning Glassworks the agreed amount quoted in the estimate or verbally. I further agree that late payments, returned checks or non-payments is subject to additional fees, collection fees, & legal fees, which I am responsible for. Any additional repairs or services added on by me is not free, and I will pay the standard rate for such work. Lightning Glassworks & Screens has left the work area and/or my home clean and free of damage. Lightning Glassworks & Screens will not be held responsible by me for lost or damaged pets, children, furniture or other items or people. I will not attempt to seek any legal judgement against Lightning Glassworks for any reason. Any dispute I have with Lightning Glassworks & Screens must be exclusively negotiated with Lightning Glassworks & Screens.

      Customer called on 1/15/24 for ******************************************* to inspect condensation on glass.

      Lightning Glassworks inspected glass on 1/20/24 and a technician with 30 years of experience determined that the condensation was on the outside of the glass due to extreme cold temperatures and the furnace running excessively. Lightning also determined that sealing the glass TO THE ***** better would be of some help. Lightning did not in any way indicate the seal on the glass was broken, or that Lightning would attempt to reseal the glass. Technician explained that Lightning would warranty the glass (per proposal below) if the condensation was on the inside of the glass and if it returned. Additionally Lightning offered suggestions on how to reduce condensation on the outside of the glass (reduce humidity in home). Customer by phone rudely denied ******************************************* the opportunity to provide solutions and demanded new glass. The full email to the customer on 1/22/24 stated: Hello,  Thank you for contacting us. We have looked at the pictures you sent and inspected the door today. Based upon both of those sources, it seems that the window needs to be sealed to the frame better. This should take care of the issue that you are seeing in those photos.  The double pane unit does have a 5 year warranty on it so if you continue to have an issue after the better sealing takes place, we can address it with the manufacturer at that point.  Let me know if you would like me to schedule for one of our technicians to come out and seal it to the frame again. 

      On 1/23/24 Lightning Glassworks sent a one time proposal to warranty the glass despite not being in initial contract terms. The labor cost to install new glass was $129.95 with the ~$700 material being covered by manufacturer. Customer again rudely denied warranty service and demanded free labor outside of contract terms. As a result, no further work or warranty service could be done per customer denial of proposal(s), and the contract terms. The full email to the customer on 1/23/24 stated: Hello, Upon inspection by glass professional with 30 years of experience, the glass seal is intact. However, client requested new glass. New glass will be covered by manufacturer. This labor charge is to take out old glass and replace with new glass. No warranty on labor. 5 year manufacturer warranty on seal.  

      Customer then proceed to successfully dispute full payment with credit card company. Due to non-payment of invoice, Lightning Glassworks took advantage of ******** law to send a Notice of Intent to Lien. Due to continuing non-payment a lien was filed with El Paso County on customer home. 

      Response to this BBB complaint by Lightning Glasswork does not indicate relief of contract terms, including: Any dispute I have with Lightning Glassworks & Screens must be exclusively negotiated with Lightning Glassworks & Screens.

      The glass company still wants us to pay for installation. Which we already paid with the defective glass. We want a glass that's not defective and installation included. Will gladly pay for that which is what we wanted from the beginning.

      The glass is not defective. Customer signed off on original invoice and estimate, which did not include any warranty. The install was for 1 dual pane piece of glass. An additional install of new glass would require an additional labor charge. Additionally, the customer refused all efforts to provide solutions, and also successfully disputed credit card payment. At this time, no work has been paid for, in violation of attached contract.  Lightning Glassworks will now proceed with a lien foreclosure per ******** Law on the house. Response to this BBB complaint does not indicate revision of the customer signed contract terms including the statement: Any dispute I have with Lightning Glassworks & Screens must be exclusively negotiated with Lightning Glassworks & Screens.
