On April 06, 2023, the Attorney General by the Federal Trade Commission filed its Complaint for Permanent Injunction, Civil Penalties, Monetary Relief, and Other Relief. Plaintiff and Defendants stipulate to the entry of this Stipulated Order for Permanent Injunction and Monetary and Civil Penalty Judgment (“Order”) to resolve all matters in dispute in this action between them.
Findings:
1. This Court has jurisdiction over this matter.
2. The Complaint charges that Defendants participated in deceptive and unfair acts or
practices in violation of Section 5 of the FTC Act, 15 U.S.C. § 45 and the Funeral Rule in
connection with the advertising, marketing, distribution, offering for sale, or sale of Funeral Goods
and Services.
3. Defendants neither admit nor deny any of the allegations in the Complaint, except
as specifically stated in this Order. Only for purposes of this action, Defendants admit the facts
necessary to establish jurisdiction. However, the facts alleged in the Complaint will be taken as
true, without further proof, in any subsequent civil litigation by or on behalf of the Commission to
enforce its rights under this Order, including its rights to any payment or monetary judgment
pursuant to this Order.
4. The facts alleged in the Complaint establish all elements necessary to sustain an
action by the Commission pursuant to Section 523(a)(2)(A) of the Bankruptcy Code, 11 U.S.C.
§ 523(a)(2)(A), and this Order will have collateral estoppel effect for such purposes.
5. Defendants waive any claim that they may have under the Equal Access to Justice
Act, 28 U.S.C. § 2412, concerning the prosecution of this action through the date of this Order, and
agree to bear their own costs and attorney fees.
6. Defendants and Plaintiff waive all rights to appeal or otherwise challenge or contest
the validity of this Order.

On April 22, 2022, the Department of Justice on behalf of the Federal Trade Commission filed a complaint for permanent injunction on Section 5 of the FTC Act and the Funeral Rule in United States District Court Southern District of Florida. Charges filed allege the business is in violation of Section 5(a) of the FTC Act, 15 U.S.C. § 45(a), and
the Funeral Rule in connection with the marketing and sale of funeral goods and services law prohibiting the illegal threatening and failing to return cremated remains to consumers and failing to provide disclosures required by the Funeral Rule.
