Back in August or September of ********************************************************************* the process of starting an academy at my place of employment. I was told I was able to keep the membership on hold for up to two months. I started reaching out to the front desk, both in person and by phone to have the hold removed; each time I was told that the club manager is the only person able to remove the hold and that she would be in later that day and or unavailable. This went on for at least three weeks. Fed up with the poor service, I finally waited for an hour or two for "the manager" to become available. He then "assisted" me and told me my plan is now active and that he saved me $10 per month. Immediately thereafter, my account began showing cancelled. Each time that I would show up at the gym different staff members would tell me that my membership was cancelled. I knew that was incorrect as I proof of my recurring payments. Yesterday, I visited the Plantation location and was again told that my membership was cancelled. I explained to the representative the issue that I was having at the ************** location. She returned to the counter and told me that my membership was restricted to the Pines location only. I was very shocked to hear that as I did not make any change(s) to my membership. There is no way I would have chosen to restrict myself to the ************** location with my home address being ***** mins away. I have reached out to the club manager on multiple occasions both by telephone and email, she has not returned any of my calls and or email.Business Response

I had a regular monthly membership with the gym and once used the personal training program in beginning of 2022. I cancelled this training in March 2022 and in September 2022 they charged me $643 and change without any authorization. I cancelled this training via phone. I made multiple attempts to reach out and request refund to be issued. I received no response. I made several more attempts later but at this point i involved my bank in an unauthorized charge. I have been going back and forth since September trying to get my money back. I spoke with the director ************** who confirmed that refund was issued on 11/7/2022 but i spoke with my bank several times and they said that no refund actually processed or attempt was made to process refund. To this day i can't get my money back. This is the worst experience i have with such a gym. I would like to file this claim in hopes of getting my money back in a check form. In the case that this is not resolved within the next couple of weeks i intend to file a law suit against the gym. But before i proceed in this direction, i would like to first go through BBB. A manager, UFC Gym Kakaako, HI, has continuously been calling and texting me from September until now, saying that my gym membership will be and has been expired on September 30, 2022. My gym contract is 3 years from March 31, 2021 to March 31,****. Today she showed me at gym a paper that my membership is ended on September 30,2022 with the signature which is not mine. I asked her to look at the contract in the computer but she even listened to me and she didnt check the status of my contract. So I showed her the screenshot of the contract on my cell phone. She said, Your membership will be expired on March 31, **** So what she is saying was totally wrong. Her attitude was very arrogant and condescending - No respect. She didnt even apologize me. I explained to ***** an associate at UFC Gym Waikele, my membership was canceled, unconsented and without my knowledge until I went to check in to start working out one morning during the beginning of summer. Mind you they did not give me a membership card and requested I use an app. The app did not always work and I had to check in with my name and sometimes wait **** minutes until they could retrieve my name. I was in full preparation for a meet that was coming up. It was a REAL inconvenience trying to find another gym to go to since I was denied entrance and access. I repeatedly called to speak to *****, the general manager of this branch. I left several messages via phone and went into the gym in person and was told she would get back to me. She never did. ***** told me during my conversation with her on July 2, 2022 that she will waive my fees on my account and take care of the balance. Since this conversation with *****, another associate, ****, repeatedly calls me about my membership. I explained to her the above incident and she refuses to help and put me in touch with the ** and continues to harass me about my membership. Currently, the gym has sent my balance of $617.07 to a collections agency in which they told me was going to be taken care of from July 2, 2022. May I please get assistance in resolving this issue as this business is not conducting fair practices and being very shady.Initial Complaint

I purchase a gym membership at ufc gym in ********. At that time it was buy 2 years get 1 year for free for about 500 dollars. At the end of the year I was told I had to pay an annual fee. When I purchase the membership I was not informed of such fee. I also havent been to the gym since Covid happen which is roughy 2 years and Im still being charged a fee. I now have active and fit program with work with local gym. Today I went in but they are unable to sign me up because if this balance on my account. I dont feel it was right since I was never informed about it and I didnt go to the gym for 2 years. UFC Gym has been collecting monthly membership fee of $29/mo from me (and $34/mo for my wife) since 09/30/2020 until 10/28/2022 without prior notice or email notification of the deductions from our bank accounts. Our membership had been frozen on 03/21/2020 due to the pandemic but we called UFC to cancel both our membership on 10/2020 when they tried to unfreeze our account. Since it was the peak of the pandemic, we could not go to the gym to use their equipment, and have never been back to this gym since March of 2020 bec of COVID restrictions.On 10/28/2022, I got a call from UFC gym representative saying that I have an overdue account and tried to charge us and collect money, well in fact we have never used any of their equipment or services since we CANCELED our membership since 10/2020. We were told by rep ****** that there was no record of the cancellation. I was also told that the only way to cancel and resolve the issue is to come in and see their manager in person who is only available on a certain day and time. I am a healthcare worker working at the hospital on dayshift and cannot meet up with the manager on her working hours. **UFC Gym Manager: ********************************* Phone number: ***************. I was also told that she is the only person who can accept cancellations in person.If this happened to us, they could also have been collecting tons of money from other unsuspecting members who don't have time to check their bank accounts. UFC Gym also does not send notification when they are reactivating accounts or deducting from their members' accounts. The only time you hear from them is when your bank account has insufficient funds or an overdue amount. But never check on their members who have not shown up for a certain period of time (over a year). If they care and look after their members, it should also be a part of their customer service to check if it's legitimate for them to be collecting money while services are not being used.Initial Complaint

I came in with my fianc to ******** UFC gym on August 13th, 2022. We both made it very clear we were ONLY interested in the free trial as stated on the *** website because we were going to sign up as a deal through insurance Active Fit. ****, one of the sales associates, repeatedly denied us a chance at the free trial and ******* us for an hour telling us that we need to join that day. We told him that we need to join online to get the insurance deal (which is significantly better priced). He told me that we were wrong and had to sign up through him and send the receipt of the membership purchase to insurance for our reimbursement. I was very doubtful and asked **** if he promised that he knew 100% that we could get reimbursed if we did not sign up online. He gave me his word that I would get a reimbursement and if not, he guaranteed me a refund. After spending $524 on me and my fiancs gym membership, the next day my insurance informed me that I was REQUIRED to sign up online via active fit and that they have never heard of being reimbursed through a receipt. So August 14th, the next day, my fianc went in to cancel our membership and get the refund and we were given a cancellation receipt and told to wait **** business days. 2 weeks later after no refund, I call ********************. I speak to an employee who tells me that because of Covid Its taking longer and now I need to wait 7 more days. Here we are a month and a half later and I have yet to receive my refund. *** reached out to the general manager but the only progress *** reached with him is getting a free trial. I appreciate that but I really want my $524 back. Its taken way too long and Im starting to believe Im never ever going to receive it.Business Response

Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution would NOT be satisfactory to me. UFC GYM has told me multiple times on email and through phone that they will give me a refund. This is*** will be resolved once the $524 from 4 different payments of $173, $173, $89, $89 is officially back in my bank account. Also, I filed a claim through my bank (***** Fargo) and UFC GYM denied my claim. Finally, this morning (10/4/22) I spoke to *****************************, the manager of UFC GYM ********, and she said she will send it to corporate and I told her that multiple people have told me that and nothings happened for 2 months. I then proceeded to tell her that I will need to speak with a lawyer and she told me to *** them. Therefore, they are not giving me my money back. Please help.

It's been over three months since the Torrance UFC GYM has tried to resolve my issue with my membership fee, but recently they said that I would have to seek a resolution from the corporate office. The number they provided ************, nobody answers.This is the second time they raised my membership fee. The last time they did, it took several months for them to review my contract and change it back to the original monthly charge of $9 a month. There is nothing in my contract that says they can raise my membership fee. I would like a refund for the amount I'm being overcharged and I would like them to return the monthly fee back to $9 a month. They have a copy of my contract in their system. They raised it to $11 a month, but the point is they keep trying to overcharge me.Business Response

Location ******** ****** in Kaka'ako (club#*****). Contract for personal training (agreement#*****07446) was completed for 2 term invoices as detailed in the term agreement. Payment was withdrawn from my account on May 3rd, 2022 and July 11th, 2022 with a period within on pause due to contracting COVID-19. I informed my trainer that I would not be continuing service on July 29th, 2022.On August 4th, 2022 UFC Gym attempted to withdraw $836 from my account for a third term of personal training which was declined. I did not authorize this transaction. I was subsequently charged a failed transaction fee by UFC Gym. My previous trainer was notified that an attempt was made to charge my account and I reaffirmed that I would not be continuing my training for a 3rd term.On September 3rd, 2022 UFC Gym successfully withdrew $836 from my account for a third term of personal training which was not authorized and no agreement existed. I called the gym and was informed by the front desk that I needed to speak with my trainer. I spoke with my trainer and she was not aware of what was going on. She spoke with her manager and replied to me at a later time.Her manager insisted that "normally" agreements for personal training were 3 months and so I am required to pay for 3 months. However, this was NOT in accordance with the signed agreement referenced above. The UFC Gym manager refused to reimburse the fraudulent transaction and failed to address previous fees for failed transactions for August 4th, 2022.This is definition fraudulent behavior and needs to be addressed immediately.Business Response

Thank you for bringing the concern to our attention. ***** has a personal training agreement at the ******** location. Per the agreement in section 2.0 it states, "Term Agreements must be in effect for at least three (3) months. Following the minimum three (3) month term, recurring agreements may be canceled on ten (10) days written notice to the club." The most recent payment, ***** is referencing is the third of the minimum of three months. The sessions are available for ***** to book and train at this time. The two months he is speaking about refers to the time given to use the sessions.

The *** is claiming that "term" is equivalent to "month", which it is not. "Term" is defined within the document as being 8 sessions and specifies that the agreement will be in place for a period of 2 terms. "Month" is not defined within the agreement and therefore understand to be calendar month. I have a membership as well as my 16y.o. daughter at UFC Gym ********. Since my daughter didn't feel comfortable going to the gym when the corona virus infections were high, I cancelled her membership on Feb 28, 2022. However UFC ******** still kept charging my credit card for my daughter's cancelled membership. I called UFC ******** back in June when I realized that I was still being charged for my daughter's cancelled membership. I was told by the person from UFC that they will send it to their corporate office so I can get reimbursed and that I should not be charged anymore for my daughter's cancelled membership. A week later I followed up and called UFC and asked about the status of my reimbursement request. I was told it was still being reviewed. It's now ending of August and I still see on my credit card statement that I was still being charged for my daughter's cancelled membership. I called last week August 24, 2022 and asked why my card was still being charged when I cancelled the membership and that I was told that UFC ******** wasn't going to charge my card anymore. The lady I've spoken to at UFC ********, *****, told me that she's just hearing about my situation for the first time and again I was told they were going to send the request to their corporate office and that someone was going to call me on August 26, 2022 to let me know the status. Again no one called me back. It's now August 31, 2022 and I just spoke with ***** from UFC ******** and she told me that my reimbursement request is still being reviewed and that someone will call me back this Friday, September 2, 2022.Business Response
