On June 30, 2022 I signed 3 contracts for "Percussion Recovery" at $700.40 each (total $2,101.20) covering 24 sessions with an employee of *** I had approved because of his skill in relieving my skeletal problems / pain. 14 of the 24 sessions had been used when the employee advised us he had quit *** Gym. On June 30th I did receve copies of the 3 payment receipts by email and had signed various places on a small etablet and was told verbally only that I would be responsible (not *** Gym) for any injuries I may incur. I never received printed copies of the contracts at the time of signing nor did *** Gym ever request confirmation of my receipt of any of the contracts by email.Due to the resignation of the employee with whom's services I was completely satisfied I requested from *** Gym a refund for the 10 unused sessions. This matter was refered to the *** Gym Point Loma Operations Manager ********************************** who replied by email:"We are just following up on your refund request. ******* submitted a refund request for your Percussion Sessions to our billing department and they are not eligible for a refund. The agreement was purchased over 60 days ago and personal training/recovery sessions are not coach specific.. We have many different coaches with different fitness backgrounds. Let us know when you would like to schedule to use your remaining session. I can have our ****************** pair you with the right match".I have discussed this matter with ******************* as to why I feel making us have to select another person who may or may not be qualified when it is a fact 1) it is their employee who quit and 2) they did not provide printed copies of the contracts nor did they confirm in some manner my receipt of the contracts by email that this should entitle us to a refund of the 10 unused sessions in the amount of $875.50.
