Over two years ago, and I waited two years because from the beginning we were advised by this company that it was likely an 18-month to 2-year process. I paid a very high fee for legal representation to exit my timeshare with assurances by this company that my case would be "winnable" based on the timeshare company's sales practices. Only after I emailed this company in September 2023, and again in October 2023 (18 months after this process began) requesting a progress report, I was finally advised that a demand letter had been sent to the timeshare company on *************** April 2024, I requested an update and was advised "At this time ****** has not sent any documents in reference to the release of your contract. The last item we received from Hilton was a letter indicating that at this account is not eligible for release at this time. Should we receive any further information, well advise you immediately." Now I really am feeling scammed, by both Timeshare Compliance and the Carlsbad Law Firm that handles the legal work for them. It's been over two years of almost no communication and absolutely no progress.

      *****,

The lack of communication is unacceptable on our end and we have made changed in the ****** services department to better our communication. Please contact new client services manager **** at *************. We are actively working on your case. Getting out of a contract takes time and we get some clients out within a year and others take much longer depending on the developer. We do as much as we can as well as the lawyers to legally follow all procedures to get you resolution. However, developers use many different tactics to prolong exits because a large part of their profits are the monthly/annual fees from timeshare owners. we know how they work and do get our clients out of their timeshares. Please let us know if there is anything else we can clarify for you.

This is my latest email that I sent them in February that sums up my complaint. I have to receive a response nor have the issue that we're to close on done. Yet, I'm out thousands of dollars for nothing."So, my husband and I started this process April 2022. It is now mid February 2024 and soon will be a full two years. We are paying for a service and each time I get a response, it has been something to the affect that you are waiting on the developer's response. We need some action soon on this matter to close. We reached out to Timeshare Compliance in Nov 2022 to cancel our timeshare. We have been paying around the same amount that we paid for our timeshare. We were told that we would have resolution within 6 to 18 months. Emphasis was that it would likely be the 1st over the latter. We sent a payment of ****** to the lawyer and were told to be patient. After 8 months had gone by, we reached out to the lawyers and Timeshare Compliance to find out what was going on with our case. The timeshare company had been sending delinquency bills when we were told that they were given a cease and desist order. The lawyers told us that they had sent paperwork to be processed for the case several months prior, but not to worry because legal matters take time. We have reached out many times in email due to being unable to reach anyone on the phone asking for a progress report on our case. We were told that they were finalizing on the case, and it was favorable. We never received documentation. We have since reached on an every month basis for several months trying to get closure and documentation for our case. No one will answer, so I and my husband are starting to fear that we are a victim of fraud. We have paid half of the established amount to Timeshare Compliance that we agreed upon, but I am wondering if I need to stop payments due to noncompliance of our contractual agreement.

We have been continuously bounced around with promises that the company would follow through with their services only to then never get a response or the response is a platitude of a promise to respond like this one. I have no guarantee that there will be an actual follow-up, so I don't have any confidence that the statement given will lead to actual fruition of the agreed terms. I want documentation that proceedings are finalized that I can present as legal and binding that I'm not just paying you to remain in the same circumstance I came to you to fix.

Timeshare compliance was contracted to terminate my Capital Vacations timeshare. They took a $1449 deposit, and additional $8,852.36 in fees, along with a $750 retainer to ******** Law LLC. This occurred in May 2021, followed by 24 months of payments. When asked about progress, the responses were routinely that "the termination paperwork has been provided to the developer, and we are awaiting their release documentation, but this is a slow process and can take years".To my knowledge, no documentation has actually been filed with Capital Vacations, who continue to chase me for the arrears on the timeshare.

I entered into an agreement with Timeshare Compliance in March of 2021. They set me up with ********* Legal to get out of my contract with Holiday Inn. I have not received regular updates as promised without calling. I came upon an article a few weeks ago that Timeshare Compliance lost a lawsuit filed by Diamond Resorts stating they were not providing services as promised. They are just telling customers to stop paying for their timeshares and just letting them go through foreclosure without any legal process. I contacted *********, which had changed their name to *********, and requested documented proof of correspondence with Holiday Inn. They could not provide any documentation and returned my retainer fee after I filed a complaint through the BBB. I contacted Timeshare Compliance by phone and requested the same documented proof of service. I gave them 72 hours to which they have not responded. I have paid them over $10000 and they have done nothing but tell me to stop paying for the timeshare. I am now getting foreclosure notices. This is exactly what the lawsuit mentioned was happening and is nothing but fraud, which I will also be filing a complaint with the ************************ if this complaint does not provide any solution.

I am so sorry you are frustrated. We technically lost the lawsuit. However, we were sued for $15 Million and the final judgement was $100,000 so we know we won most of the case. Customer Answer

      Date: 02/26/2024

I am not satisfied because when I contacted *********, they could not provide any proof that they were providing a service. They refunded my money instead, which tells me I was right. Timeshare Compliance was also contacted and I requested documentation that service was being provided other than just letting the developer foreclose on me. The representative told me that there were certain things that couldn't be disclosed. This is incorrect. It is MY case. I can know everything about my case. I am the client and have paid about $10000 for a service that no one can prove they are providing, other than collecting money from me and letting me get foreclosed on. I gave them 72 hours to give me proof and I got nothing, not even a phone call or a status on my case. I don't need anymore run-around. I just need my money back or documented proof that something is being done for me. I want to see documented proof of correspondence with my developer, response from them, and/or any other proof, i.e.- emails, etc. Better yet, just give me my money back and I can get someone else to do it for me.

      Business Response

      Date: 02/28/2024

      *****,

This complaint is incorrect in many facts. In your contract, which you signed, section 4.2 (1.) - we clearly state that "foreclosure" is absolutely a possible outcome and is a positive result as it releases you from your contract and you no longer have to pay anything to your developer. Developers "foreclose" on timeshares when they have no other options. A foreclosure isn't good for developers since they will no longer be getting money from you. Our work helped achieve this resolution. Developers use words like "foreclosure" but they can't actually foreclose on a property you don't own. We have worked diligently to identify the misrepresentations in your case. Saying our lawsuit is "fraud" is defamation and untrue. You wanted us to get you out of your timeshare contract and we have provided that service. You are now free of that burden.

      Customer Answer

      Date: 03/01/2024

You say your work has gotten me out of my timeshare. I am not out of it yet. And neither your company nor the attorney you set me up with could provide me with any proof that you have done anything other than forward my original statement to the developer. I have seen no proof of any correspondance between your company and Holiday Inn to come to any resolution other than telling me to stop payment to them. Yes the contract mentions that foreclosure is an option but it also misleads us to believe other options are possible and that you will try those other options too. I have requested documentation to show me what you have tried, and have not received any. When I asked the attorney that your company set me up with, for proof that they were communicating with the developer, they chose to end my representation and return my retainer because they had no proof. You have shown me no proof either. I suspect because you have none and have done nothing other than tell me to stop payment to them and ignore the letters I received from them. SHOW ME THE ***** that proves I am wrong and I will drop my complaint.

November 2023 called to cancel contract, I have contacted them several times on the few occasions we were able to get through to someone, we get told we need to talk to a supervisor. We are continually told the have a large number of calls but do not hear anything further. So it appears there is a large group of people waiting for calls to cancel their contract. Truly this has the appearance of a scam. This company gets another company to take your case and you have to pay the next company money to take the case so why am I paying large sums of money to this company. We placed a down payment with them and they set up additional financing to cover the fees. Then when passed off to an attorney there are more fees. After 5 months of inactivity we called to cancel for lack of following through on this issue. Today February **** we finally get a call from a supervisor and are told we are in breach of contract and they will not refund our money even though they have provided no services. Talk about breach. Meanwhile my credit is taking the hit because Im not paying the creditor that is paying the contractor timeshare compliance. If this doesnt look sketchy I dont know what does!

The original complaint reply was requested of my predecessor.

Dec 2023 called to cancel contract, I have called every week for 4 weeks waiting to hear from a supervisor. They said they had a lot of calls this week. So I am one of many waiting for calls to cancel their contract? This all looks like a pyramid scam. This company gets another company to take your case and you have to pay the next company money to take the case so why am I paying 10k to this company? I have already paid 2k and they said I have to pay another company 950. That is fishy. I stopped the payments of the 10k waiting to cancel my contract, but cant get a call back in a month. Meanwhile my credit is taking the hit because Im not paying the creditor that is paying the contractor timeshare compliance. If this doesnt look sketchy.

We started to work with Timeshare Compliance (***************************************************************************************) on April 6th, 2023. We were initially assigned to a law firm to work on our case on April 25th, 2023. But once we paid the attorney fee of $950 to the law firm, it then became very difficult for us to reach out to the law firm for any updates of our case. More than five months later, on September 25, 2023, we were informed through email by Timeshare Compliance that the law firm was unable to proceed our case anymore. In the email, it stated that We want to assure you that there is no cause for concern, as we have established partnerships with multiple exceptional, high-performing, and experienced law firm. The Timeshare Compliance further told us in the email that they had reassigned our case to another law firm. It further stated in the email that in the event that you have already made a payment to original law firm, we are committed to issuing a refund, which you can then allocate towards the payment to the new law firm. We then made numerous contacts asking for the refund of our $950 so we can pay the fee to the newly assigned law firm. As of the writing of this complaint (December 25th, 2023, three months have passed), we have not received our refund yet and the new firm will not work on our case without receiving the attorney fee. Timeshare compliance is not doing what they have promised in the email. They prey on the customers who are wanting to get out their timeshares and manipulate you into signing up with them and paying them money. They are lying and taking peoples money.

Beginning of May we signed up with Timeshare Compliance after reading reviews that they were initially cheaper than ********************** but just as good. We are now in Dec with nothing to show from them working on us getting out of our Timeshare! It has been nothing but crickets with getting anything resolved they can't even keep a lawyer on our case and have switched us to another lawyer now! So no cease & desist letter have been sent to ******* at all and our credit has plummeted to the high 700s down to a 619 now! This company is a joke and they have already been paid with nothing to show for it, stay away from this company for the love of GOD!! We are now in a worse situation than we were before when at least we had a timeshare only but now we still have a timeshare on top of a company that was SUPPOSED to be working for us to relieve some of our financial stress but all they did was take our money and run! These businesses shouldn't be allowed to do business along with Timeshare companies!!!!!!!

I don't have the notices due to then being thrown away because Timeshare was not doing anything with the paperwork we had sent them and have no lawyer representing anymore due to ******** Lawyers sending our retainer back and not knowing if we paid this "new" supposed lawyer, if THEY would do what they were supposed to do.  We gave these lawyers their money the same time that Timeshare Compliance got paid and a cease and desist letter was never sent so how do we know if these new lawyers of Timeshare Compliance is going to do the job!?  We have already been sent to a ************************** now as they called 2 days ago letting us know that we have been sent to the collection agency on behalf of ******* so we are out MORE money and bad credit when our credit was almost at the 800's and now it's down to a 619!  I am NOT satisfied with the  Timeshare Compliance company and they have done nothing to accept my gratitude for taking my money and not doing anything just like ******* vacation!
