      The company is not replying about an issue that was sent to them by postal mail which they are required to by the fair credit Reporting act. In September 2023 Achieve Personal Loans was sent a letter notifying them the contract is voidable by the debtor to lack of capacity to consent. The debtor is exercising their right to void it. Achieve Personal Loans Is required to remove it from the credit reporting system or produce a reason as to why they will not as it is causing considerable credit damage to disabled vulnerable party who would like the contract voided due to the circumstances and removed from the reporting system asap.

      Thank you for the opportunity to respond to ****************************** BBB complaint. After review of the account and phone calls, it has been determined that there is no evidence to validate the members claims. The letter we reviewed did not appear to come from an attorney and due to the status of the account with the cease and desist we could not reach out to the member to discuss the account. The loan agreement was signed,and the member made contractual payments up until June of 2022. No payments have been received since June of 2022 which caused the account to be reported negatively. There was no error identified on Achieves end, and the reporting is accurate. We encourage **************** to reach out to member services for any further questions.

      After several attempts at mailing the business, I filed a Better Business Bureau complaint, because the business would not respond, even though my name was on the letterhead. 

      The business fails also understand that someone CustomerService does not understand contractual law, enough to understand what avoidable contract is, if the person suffers from an exacerbated mental impairment, and doesnt understand the contract term.

       

      The purpose of writing the letter to the business so that they would send the appropriate address for their legal counsel to discuss how to deal with it and thats what Im asking for as the customer if they want evidence to evaluate legally then they can give me the address to the legal department to review, but having their customer service that is untrained in the law is not going to be sufficient or satisfactory and probably damages the businesses liability if it were to go to court  

      Busines has the opportunity to reach out and give me the address so they can review the documents or the business can go to court with me at their expense to determine that the contract is void   

      Im on Social Security disability and Im not collectible  

       

      I have been trying to work this out with the business, but the business has not written back or cooperated, because they understand that a confidential settlement letter is not the same as a cease-and-desist letter. I never sent a cease-and-desist letter. I sent communication for them to communicate back which they failed to do.

       

      so if busines can, please provide the address to the attorney that can review the information then maybe we can settle this somehow without a costing more money for the business otherwise, my only other option is to take the business to court in the business and I dont really think that that method is very or cost-effective to either Party

      i am not liable for this debt with Achieve Personal Loans. i do not have a contract with them or sign any paper work with Them . they also did not provide me with a original contract as requested.

      Thank you for the opportunity to respond to *************** BBB complaint. Upon completion of this review, it has been determined that the member reviewed, signed and agreed to the loan terms on November 4, 2021.  The member submitted 1 successful monthly payment on December 6, 2021. After which, the account became delinquent and all communication efforts towards the member were unsuccessful. The account defaulted due to non-payment and has been reported accurately to the credit agencies. In response to this complaint a copy of the members contract has been mailed to the address on file, as there is no record of the member requesting a verification of debt.

      The loan was approved under Freedom Debt Relief when I applied, however the bank changed its name and I was not notified via e-mail or postal mail. My authorization for automatic payments was given to Freedom. Due to the fact that I did not recognize the transactions on my statement, I stopped the transaction immediately.Achieve representatives informed me that the name has changed.As a result, the company has made a negative report to my credit, which has had a significant impact on my credit score. My account is always paid on time, so I believe this is an unfair practice.

      Thank you for the opportunity to respond to *************************** BBB complaint. Upon review, it was found that the member signed their loan agreement on December 6, 2022, which included on the front page FreedomPlus is rebranding to Achieve Personal Loans. This won't affect your loan contract or terms in any way. It'll be the same great solution and service, just with a new look. The member was also advised on phone calls that they were speaking with Achieve Personal Loans. The member made all contractual payments up until June 3, 2023, when a payment was returned and then made again on August 18, 2023,which caused the members account to be past due. We found no error; the member was advised of the name change and the reporting is accurate.

      I rec'd a letter of denial for a loan through Even Financial for Achieve Personal Loans. I did not apply with either firm. My credit is frozen due to fraud activity. I looked at Experian, which the denial letter was based, and neither firm was listed as pulling an inquiry. I believe this letter is a scam. Take me off of your list. Ensure my personal data is not with your firm. Thank you, *********************

Achieve works with certain marketing partners to connect potential borrowers with the opportunity to apply for a Achieve Personal loan. Consumers shopping for loans will contact the marketing partner (e.g. Lending Tree, Experian), provide information about themselves, and agree to permit that partner to conduct a soft pull of the consumers credit (which has no impact on the consumers credit score). After reviewing this information, the lender may decide to invite the consumer to apply for a loan.If a decision is made not to invite a consumer to apply for a Achieve Personal Loan, an adverse action notice is sent.

      I was checking my loan pre-approvals at Upstart. It gave me an option to see if I qualify for Achieve personal loan with no impact on my credit. I was looking around and there was hard enquiry on my credit report. On 09/16/2023 morning, I received a call from one of the Achieve representative *************) that they want to discuss my loan options with me. I asked them twice that I don't want a hard enquiry on my report. I did not authorized any hard pull on my credit. The representative lied that there is already a hard pull on my report. I disagreed. When I disconnected the call, I get an email from Experian that a hard enquiry has been placed on my account. I called that number again but got call back *************) and told him what happened. He refused to help me. So, I asked his manager's number which is ************. No response from the manager.

      Thank you for the opportunity to respond to ********************************* BBB complaint.  Achieve Personal Loans (Achieve) receives referred applications for personal loans through third party advertising sites.  Member completed application with third party marketing site Upstart that was referred to Achieve to see if qualified for personal loan.  In application member gave approval for both soft and hard inquiry.  After review ************** did not qualify for loan and was advised that approval for hard inquiry was done when submitted application. As a courtesy we have submitted a removal of the hard inquiry. We encourage ************** to reach out in future to Achieve for future personal loans.

      Starting around February 2023, I have been attempting to communicate with Achieve through both phone calls and emails in order to rectify issues with my account. Unfortunately, I continue to encounter problems accessing my account to view statements to complete a financial audit. What's more concerning is that up until August 14, 2023, they were associating someone else's debt (belonging to an individual residing in *****) with my social security number. This distressing situation has not only taken an emotional toll on me but has also resulted in rental denials on multiple occasions due to an inaccurate debt-to-income ratio.On August 14, 2023, during a conversation with a representative, I expressed my desire for compensation due to the challenges I've endured over the past 7-8 months. The representative informed me that her manager was currently unavailable and promised to get back to me on Monday morning. However, it has now been 11 days since that conversation, and I have received no responses to my emails or returned phone calls. This lack of communication and responsiveness from Achieve is extremely disappointing. Achieve is not prioritizing its customers' concerns and is failing to take appropriate steps/ accountability to address the issues.To make matters worse, during our conversation on August 14, the representative mentioned that she could offer me a $50 Amazon gift card. This offer was particularly frustrating considering the extensive challenges, headaches, and disruptions I have encountered due to their inability to rectify their system problems.

      I received a hard inquiry on my account when it shouldve been a soft inquiry. On the same day both a soft and hard inquiry was done to my credit file which is incorrect. I shouldve never been given a hard inquiry and alsoI never received an approval or denial letter so it makes no sense a hard inquiry shows up under my name and this business. I am requesting they remove the hard inquiry with the credit bureaus. I have uploaded prood showing two inquiries in my account and I spoke to a representative from ACHIEVE who assured me I was only given a soft inquiry, however I have proof that is a lie. I am requesting for this to be amended. Thank you.

Upon completion of the review, the prospective member received a call from ** on July 15, 2023 in regards to an application they submitted through Lending Tree, which is a 3rd party marketing partner we utilize to receive prospective members. ***************************** was provided the disclosure which authorized us to do a hard inquiry on their credit to see what offers were available to them. The member acknowledged and agreed to this hard inquiry. We did not find an error. An adverse action notice has been sent to the member on August 11, 2023 to the address listed on the application.

      I have been paying for a loan and service that they havent followed through on. One of my debts is still reporting to the credit bureau as delinquent after reaching the settlement. This company has/will not take care of the resolution with Aspire Credit card. Consolidation Plus paid the debt, but didnt review with Aspire to clear my account as Paid Settlement. Consolidation Plus is tell me that I need to send the letters to them. I pay Consolidation Plus to take care of this, to look out for my debt, they didnt finish the job. I want Consolidation Plus to lower my interest rate to 10% for falsely representing themselves as a *********************** Because of them, my credit has dropped over the past 2 months because they didnt close out business with Aspire Credit

Upon completion of this review, it was found that on April 12,2023 the member spoke to a loan consultant and was informed of our loan terms before agreeing to our contract. The member agreed to enroll creditor TBOM RETAIL- Aspire MC/ATLANTICUS, into our consolidation plus program. After the member agreed to sign the contract of our Freedom Debt Relief program it was then settled for the members debt, upon agreement, for the amount of $1,592.00. After the settlement was made we provided the member documentation for proof of payment, sent on May 30, 2023 to confirm the settlement was completed upon agreement. Once all settlements are completed we have no control on how the creditor reports. We encourage Mr. ********************* to reach out to member solutions with further questions or concerns at **************.

      while this communication has happened. Conversations from July 27, Aug **** have happened where the business stated they would contact Aspire to correct this issue.  Instead, the business told me to send the letters to Aspire, when they should of been acting on my behalf.

      Once the document reflecting the settled account is reflecting delinquent to the credit reporting agencies, a representative of Achieve can contact the creditor, provide settlement documentation and advise that a settlement was agreed upon and paid within the allotted timeframe.  We cannot require the creditor to change reporting of the account.  If the creditor does not update the reporting, it is suggested that **************** dispute the reporting directly to the credit reporting agencies and provide the settlement agreement as well as the proof of payment.

      I noticed I had late payments from ACHIEVE PERSONAL LOANS on my credit report. During these months I did not receive anything stating I was late. As you can see, majority of my payments have been on time so I am requesting the removal of these late payments from my account. I am trying to increase my score to purchase a home and would greatly appreciate if you guys can submit a request to the credit reporting agencies to remove the late payments.

      Thank you for the opportunity to respond to ************ BBB complaint. Upon completion of this review, it was found that the members account was opened on September 20, 2018 and payments were made up until April 15, 2020.   The loan was sold on October 30, 2020 due to the delinquency status of the loan to CKS Financial.  Member contacted Achieve on April 16, 2021 claiming fraud but after review member was advised on April 20, 2021 it was found to be not fraudulent.  Contract is available on request but will have to be mailed as is policy.
