I am deeply concerned about the sharing of my nonpublic information with credit bureaus and the resulting inaccuracies on my credit report. This situation has caused significant financial and emotional distress.Under 15 USC **** Section 602, I have the right to financial privacy, and I expect my information to remain confidential.Furthermore, 15 USC **** Section 604(a)(2) states that a consumer reporting agency cannot furnish account information without my written instructions, which I have not provided.I have identified inaccuracies on my credit report from ACHIEVEPL, impacting my financial well-being. Thank you for the opportunity to respond to ******************** BBB complaint. Upon completion of this review, the member agreed to the terms of the Achieve personal loan opened on July 22, 2021. ******************* satisfied the August and September 2021 ******** as agreed. The submitted October 22, 2021 payment draft was unsuccessful and remained unsatisfied until December 2, 2021 at which time a payoff payment was submitted. It was due to the unsatisfied October billing extending beyond 30 days delinquent which caused the impact to ******************* credit profile. Achieve is required to report the loans activity to the credit agencies accurately. Currently no additional action is required to resolve this concern. I made monthly payments to achieve for my credit debt. I made 6 payments on time for the ****** and I was told I can refinance. When I told them I lost one of my job I couldnt afford the amount anymore. The company told me they cant assist me I still have to make the payment. Im experiencing a hardship right now my mortage went up. I loss income and now I have to have the heat on. I thought Achieve was supposed to help me. They never my returned phone but they right there to take my money.Business Response

Thank you for the opportunity to respond to ************* BBB complaint. Upon completion of this review the member was unable to obtain approval for the internal refinance option. On December 6, 2023 ***************** was assisted in which a request for a temporary hardship modification review was submitted. The allowable time for a response from the modification team is 72 business hours once a request is submitted. We have attempted to reach the member to review the available assistance options but have not been able to make contact. They didnt offer me a solution. ******** from achieve told me she will have me not make a payment for the month of November & December andI can start make payments back in January. I was not satisfied with that solution. Now that Im behind in my payments it going to take more than one month to catch up.

I am deeply concerned about the unauthorized sharing of my nonpublic information with credit bureaus, resulting in inaccuracies on my credit report. This breach of privacy has caused immense financial and emotional distress. According to 15 USC **** Section 602, I have the unequivocal right to privacy regarding my personal information.Furthermore, 15 USC **** Section 604 A Section 2 explicitly prohibits consumer reporting agencies from furnishing any account without my explicit written instructions. It's imperative that you adhere to these regulations to safeguard consumer rights.Additionally, under 15 USC **** B, creditors are prohibited from treating any payment on a credit card account as late for any purpose. I refinanced a personal loan with Achieve on 11/10, however, they failed to release the funds to my creditors within the ***** business days. My current loan is past due and Im accumulating interest and possibly a penalty fee will be assessed. I called on 11/22/2023 and spoke with ******* who said the funds will be released by 11/27, however, I received an email today advised the funds will be released in ***** business days. I spoke with ******* today 11/28/2023 and requested to escalate however they are refusing to process faster. I shouldnt be liable for the delay the company make me go through.Business Response

I received a letter dated 11/10/2023 from APL denying a loan request. I've never applied for a loan with this company nor did I give permission to run a credit check. I'd like this to be revoked.Business Response

Upon completion of this review, Achieve works with certain marketing partners to connect potential borrowers with the opportunity to apply for an Achieve Personal Loan. Consumers shopping for loans will contact the marketing partner (e.g., Credit Karma,Lending Tree), provide information about themselves, and agree to permit that partner to conduct a soft pull of the consumers credit (which has no impact on the consumers credit score). After reviewing this information, the lender may decide to invite the consumer to apply for a loan. If a decision is made not to invite a consumer to apply for a Achieve Personal loan, an adverse action notice is sent. Achieve received an inquiry on behalf of ************************************* on 10/16/2023. Since only a soft pull was conducted, there is no hard inquiry to show on the consumers credit. Thank you for the opportunity to respond to *********************** BBB complaint. Upon review of the account, the member signed a loan agreement with us and our original name of Freedom Plus on December 4, 2017. The member made their contractual payments on the loan until July 30, 2021, but due to the delinquent status of the loan, it was sold to CKS Financial in January of 2022. We changed our name to Achieve on December 2, 2022. Notifications of the name change were sent to active members on November 30, 2022. The loan no longer belonged to Achieve at the time of the name change and therefore no notifications were sent to the member. A fraud review was completed on November 30, 2023, and the loan was confirmed non-fraud. We encourage ****************** to reach out to member services with any further questions.Initial Complaint

They gave me a loan but I still have been unable to access my online account to see any statements or other financial information. I have called 3 times on this as well as contacted them through their chat feature and they have yet to rectify the issue. I have not heard any follow up from them after any of these beyond "we will get this fixed". They're very nice on the phone and appear to be helpful but ultimately do nothing, very shady for a company to deny access to statements when finances are involved.Customer Answer

The resolution makes it sound as if the issues in accessing the account were my fault and I suddenly figured it out. I would like the company to acknowledge that they failed miserably with customer service until I filed this complaint. I can now finally access the account since they finally fixed the issue after this complaint. Sent 2 letters dated Oct 13, 2023 and another Oct 20 that stated I applied thru CREDIT KARMA which I never did and have since delete the spam credit karmas account so now they will spam me more...I will *** them... also this company Achieve Personal loans ...I have never heard of them and am worried they will spam my credit ...they have multiple address and PO Box #'s so you knw there SPAM... I NEVER APPLIED and would never to a scum company...I use local banks....if I need loans. After review it was determined that this is a repeat request by a member claiming fraud on loans App-******* and App-******** both of which have been determined to be non-fraud. It has been determined that we cannot substantiate members claims. Achieve has responded, with validation, on previous occasions that both loans have been found to be non-fraud. Contracts from both accounts have been mailed to member address on file. It was determined that loans are valid and reported correctly. I filed bankruptcy on 6/2/23 (bk case 23-00689) and received my chapter 7 discharge on 9/6/23. I have been trying to have my credit reports updated to reflect the Achieve Personal Unsecured Loan as Discharged through Bankruptcy Chapter 7. I notified Experian via a dispute on 9/3/23, 9/8/23 and 9/20/23 which has still failed to be updated correctly. I have also called the creditor numerous times and they are still failing to report correctly. Achieve stated they never received notification of the bankruptcy. Once they had the information I was informed back in September my report would be updated. It has now updated on 10/13/23 and the loan still reports as open with a balance due. Per my attorney even though I was only a co-signer and this loan was unsecured and discharged it should no longer be reporting as opened with a balanced owed on my reports. This is a violation of my discharge. I want this updated immediately. This loan was NEVER reaffirmed.Business Response
