    On August 20, 2022 I ordered delivery from Arriba Mexican Grill in ******* via Ubereats Order #0A018. The order was for a flautas plate and a pint of spicy bean dip. When the order arrived I put the beans on a plate with the salsa and ships provided with the order. After about the 2nd or 3rd bit into the beans I bit into a nail which broke two of my back right teeth. I contacted Arriba immediately to file a complaint. I spoke to the manager ****** that night and per her request sent an email with pictures of the food, and the plate with the ************ I did not immediately go to see the dentist although I had tooth pain, because I wanted to hear first from Arriba's insurance company about how to proceed. I messaged ****** on Monday 8/22 to follow up. ****** then confirmed on 8/22 that she had forwarded the information to her corporate office that day since they were not in the office over the weekend. Then on 8/23 I received a call from ***************************** from **************************** requesting a statement, which I provided that same day on the call. She gave me the claim #******* and asked me to complete some documents and return them. She said that they would not pay the dental cost upfront as they needed to investigate to determine liability. So I would have to go through my own insurance. I scheduled an appointment and went to the dentist on 8/24. It was determined that I would need two crowns and they started the work that day. I received the invoice for a total of $1,572 and sent ******** a copy. I returned to finish the treatment today and the crowns were placed 8/31. Then ******** called to tell me that their insured Arriba denied the claim. They would not be paying my dental bill. They said something about the fact that the food was delivered by a third party. However, many people have food delivered via 3rd party services, this does not excuse them from liability. The food was closed up and secured. The bag was not tampered with prior to me opening it.
