    MA AG Office v Maxim Healthcare Staffing Services, Inc

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.On 01/19/2024, Attorney General Andrea Joy Campbell of Massachusetts Attorney General Office, announced settlements with three temporary nurse staffing agencies to resolve allegations that they failed to comply with regulations and charged for temporary nurse staffing at long-term care facilities at rates above the maximum rates allowed by the Executive Office of Health and Human Services (EOHHS). 

    A settlement was reached with Maryland-based Maxim Healthcare Staffing Services, Inc., which will pay approximately $1,500 back to affected long-term care facilities and $55,000 in penalties to resolve similar allegations. Under the terms of the settlements, all three agencies have agreed to measures that will ensure their future compliance with rate regulations.

    Nursing on Demand will also maintain a corporate compliance program, which includes compliance training for employees, a code of conduct that will ensure compliance with EOHHS rate regulations, and periodic auditing, testing, and monitoring.This settlement is part of AG Campbell’s broader effort to ensure compliance with EOHHS rate requirements for temporary nurse staffing agencies. In March 2023, AG Campbell issued an advisory in response to allegations received by the AG’s Office that some temporary nurse staffing agencies have been attempting to overcharge, demand additional fees, or enter misleading arrangements with long-term care facilities.

    The AG has authority to investigate and prosecute noncompliance with EOHHS regulations governing temporary nurse staffing agencies. Concerns or complaints regarding temporary nurse staffing at Massachusetts long-term care facilities can be made to the Attorney General’s Medicaid Fraud Division at 617-963-2360, or the Massachusetts Department of Public Health (DPH) Division of Health Care Facility Licensure and Certification at 617-753-8150.

      I have a special needs infant that came home from the NICU at 4 months old on 4/15/22. Maxim was the first company able to find me a day nurse. She started 5/3/22 and has been absolutely fantastic. She has become part of our family and goes above and beyond her duties to help me out. I am disabled and cannot care for my baby on my own. At the end of her shift on Fri 9/2/22 right before a holiday weekend, Maxim fired my nurse for a "legal matter." My nurse had already told me this was a complaint from a previous patient's mother that my nurse had only been with for 4 days. She's been with me and my son for 4 months and I have had no complaints and only have given her the highest of praise. Maxim said they can set up meet and greets for a new day nurse, but I would go without coverage for at least 2 days. This is unacceptable. They knew they were going to fire my nurse and did not have a replacement ready. Maxim never disclosed this "legal matter" with me prior to my nurse starting in May, only after they fired her. If she was such a safety concern, why did they assign her to a case with a 4-month-old, and why did they never tell me anything? I also had requested a night nurse in July to use the rest of the insurance hours. We had a night nurse 2 days a week for 2 weeks. This one was terrible. She didn't give medications or feedings on time, though her notes said she did. She falsified a lot of her notes. She was incapable of soothing the baby to the point I had to get up to help her. She would only change his diaper 2 times during the night; however, I know from my nights with him he would regularly be changed 5-6 times during the night, so she would let him sit in dirty diapers. This nurse was fired from our case after 2 weeks, and Maxim has not been able to find a replacement. It's been 2 months. Maxim has left me, a disabled mom, home alone with a special needs 8 month old who I cannot care for on my own. All they could say was "I'm sorry, it's out of our hands."

      Idk how they have been in business this long. Denver. They take on clients that they have no coverage for. Uncaring mngmt, clients are just a money sign. Everywhere always keeps the crappy cnas and gets rid of the good ones. Does not properly train, then threatens to take you off schedule if you don't shape up. Please TAKE ME OFF. Gives clients 30 day notice to terminate contract when it takes 90 days to find other homecare providers, because Maxim cannot accommodate their staffing needs. :(
