I am writing to file a formal complaint against ABILITY RECOVERY SERVICES, LLC, a collection agency, for violating Texas state licensing requirements. According to the Texas Secretary of State's Debt Collector Search, accessible at **********************************************************, ABILITY RECOVERY SERVICES, LLC does not possess a surety bond and has not filed a copy of such a bond with the ************ of the Secretary of State.This failure to comply with the bonding requirements outlined by Texas law constitutes a significant violation of state regulations governing debt collection practices. Ability Recovery Services is a nationally licensed third party collection agency. The above account was placed with us for collections by the current creditor. Ability Recovery Services has both a contract to collect for the current creditor accounts and an ******************* Agreement that permits our company to collect under HIPAA and federal and state collection laws. A required Regulation F validation letter was mailed to the consumer on March 29, 2024 which explained in detail what is listed above. Further, under separate letter, Ability Recovery Services is mailing directly to ************ an itemized bill showing the amount owed and letting ************ know that both settlement offers and payment plans are available for the medical bill issue.

Involving a debt collector , this account is a debt buyer. The debt that you guys are trying to collect dont belong to me. On March 5, 2024 a random collections account appeared on my credit report from Ability Recovery Services. Which I do not recognize, nor have I ever spoken with or received care from. I do not owe this company any money, as to which they attempted to use scare tactics to receive payment. This place is a joke Im including proof where I asked for the original contract theyre claiming They claim over $900, yet I have and have had health insurance with no copays as I am a military dependent with tricare I have never been to any *********************** in my life and I have never paid a bill late. This is from 2017 they claim, why didnt they send me proof before adding to my credit? Then, when they did I sent this letter certified in which they signed for it as you see and ignored me. Im on a military post now and have Jag willing to help as we cant have debt of any kind. It causes stress and undo anxiety for everyone My credit is perfect as you see minus this scam They legally had to contact me before adding this, they didnt. This is my last attempt here before *** has agreed to help me. Im not being bullied into paying something that isnt mine. I live in ********** then which Im including proof of. We move from state to state every three years usually. We are constantly reassigned and it is disgraceful to try and scam military families. If this isnt corrected or if Im not sent proof where I can get this proven it isnt me, Im done trying. Please see all attached proof of where I was then, as well as where they signed for this and I was completely covered by Tricare If it was really mine, wouldnt I have other collections from 2017?? I am not liable for the debt associated with the Ability Recovery Services LLC account reported on my credit report. I have no contract with Ability Recovery Services LLC, and despite my requests, they have failed to provide the original contract. This absence of documentation is critical, and as outlined under the Fair Credit Reporting Act (FCRA), my rights and their duties concerning the reinvestigation, documentation, and accuracy of the information are clearly defined in several sections: FCRA Section 611 (15 U.S.C. 1681i) mandates a detailed investigation into disputed information. FCRA Section 609 (15 U.S.C. 1681g) requires them to furnish me with all documents in their files that pertain to this disputed entry. Furthermore, FCRA Section 618 (15 U.S.C. 1681p) specifies the statute of limitations within which I can initiate this dispute following my discovery of the error. FCRA Section 620 (15 U.S.C. 1681r) stresses the requirement for credit reporting agencies to promptly correct or delete inaccurate data to maintain the integrity of the information they report. Additionally, FCRA Section 621 (15 U.S.C. 1681s) provides for regulatory oversight and enforcement, highlighting the seriousness with which these matters are regarded under federal law. In the context of Virginia law, Virginia Code 59.1-443.2 is particularly relevant if there's a potential element of identity theft or mistaken identity involved in the reporting of this charge-off.
