My former contractor (Trust Building Services (TBS)/Jerzy G********) filed a lien for $40,953 in June. TBS was terminated in February for refusing to do work, refusing to do work in a workman-like manner and billing issues (and appearing to stop work when these issues were raised). After refusing to mitigate quality issues despite numerous requests (the most proximate to the termination were the (standard) washer and dryer not fitting into the washer and dryer closet and a (standard) toilet not fitting into a bathroom)); billing issues (amounts under the contract were being invoiced under change work orders and invoices such that I was getting double/triple charged); and stopping work and threatening to damage when quality and billing issues were communicated; TBS was terminated on February 20, 2022. TBS lawyer acknowledged the termination on February 21, 2022. At such time, approximately (or likely less than) 50% of the original contract was complete and TBS had been paid for 50% under the original contract (and more under change work orders and invoices). TBS had been paid for unworkman-like work; work that was problematic (e.g., electrical); work that was double and triple charged; and work that wasnt just done. Since the termination, TBS has wanted to get paid for 80% of the contract price plus two invoices disputed immediately upon my receipt of such invoices. However, TBS has generally refused to provide any reason as to why the work is 80% done. I have sent extensive evidence showing that 50% or less of the work has been completed, including an architect/consultants report. My costs to mitigate have been extensive. I have paid the replacement contractor approximately 70k - and there are other damages that Ive outlined to TBS and TBS lawyer. A high-level estimate of my total damages is approximately 68k.I can provide additional documentation.
