    I am filing this complaint on behalf of my son (**** ******) . Ryan lived at metro properties management apartments from August 2020 till August 2022 in Morgantown WV. During this time he lived in 2 separate apartments . The first was a 2 bedroom apartment from august 2020 till august 2021. Then he stayed on the property and moved to a 1 bedroom from august 2021 till august 2022. After moving out in August 20222 he moved to a new location in the area but not under the same company. In the last ten days I received a notice that he owed 1055.78 for additional damages from the 2021-2022 year. The security deposit was taken and this amount is what he they are claiming was needed for damages. I contacted ***** property management regarding the charges and was informed he also owed another 700 dollars for the apartment he leased from 2021-2022 and once again the security deposit was keep metro properties . These charges range from cleaning carpets to painting the entire apartment to taking out trash bags . I have researched this company and the reviews I have read are very similar to my sons. It is my belief they are trying to make tenants pay for regular wear and tear on these apartments such as carpet cleaning and painting. Ryan was charged for painting that included all walls, trim, and ceilings. They have keep all security deposits which I believe are $400 and are trying to charge Ryan for regular upkeep. They sent an email with pictures of various rooms and walls which do not indicate the need for a complete painting of the apartment due to the renter . I requested time stamped pictures but the pictures I received were not time stamped and no before and after pictures were provided for the apartments. I was in the apartments when visiting on weekends and they were average condition at best with older furniture

    Dear BBB:
    I have been asked to follow up regarding the complaint of ***** ****** on
    behalf of **** ****** submitted to your office. It is my understanding that the
    landlord responded on November 3,2022. I have reviewed the file with the
    management of the company. As such, the landlord denies the claim. Our
    investigation has confirmed that the posture the landlord has taken on this
    claim under the leasing agreement is appropriate. The claim that the deductions
    for conditions are inappropriate must be denied as the conditions found on the
    move-out inspection were obviously not simply "normal wear and tear".
    During the2 year time the tenant lived with Metro his move out charges exceeded
    his security deposit. Per the lease agreement page 5 section 12 informs every
    tenant of their move out obligations. Due to this reason Mr. **** has been
    turned into collections. The company believes that this dispute lacks all merit,
    and we respectfully request this complaint simply be closed.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.



    [Provide details of why you are not satisfied with this resolution.  I reject this response based on past history of Metro property management and the charges they apply to tenants after leaving location. I received a bill from metro properties for additional charges after my son (**** ****** ) had moved out this location . After speaking with metro properties I requested an email with pictures which I received . These pictures are included in previous claim against these charges I filed with the BBB. They charged for painting the apartment and the ceilings and the trim . The pictures I received had small smudges and normal wear and tear of occupying an apartment . They also billed him for the previous year an additional charges for cleaning that was never received until following up on the 2021-2002 year. When I asked they replied they couldn’t contact him although he was still living  on the property at another apartment . Metro property has a history of these additional charges on tenants that can be reviewed with online complaints of past tenants. The issue became so prevalent the Attorney General became involved and filed lawsuit in January 2017 against metro property management for this exact type of claims against tenants .  For the year of 2020-2021 this was a two bedroom apartment which Ryan’s deposit wasn’t returned and I was not advised if the prior roommates deposit was retained as well. I offered on the initial call a compromise for the amounts i was advised were due and there was no reply from the accounts payable department . I never received before and after picture of these apartments which I am to assume are Ryan’s previous apartments, which there is no way for me to know really which  apartment these pictures were taken from . I question the ethics of these charges based on past history with metro property management and the opportunity for them to bill tenants to maintain there buildings
