On June 29, 2018, United States Attorney Matthew D. Krueger announced that a federal grand jury in the Eastern District of Wisconsin indicted Lisa Hofschulz and Robert Hofschulz for conspiring to distribute oxycodone and methadone outside of a professional medical practice and not for a legitimate medical purpose through their cash-only pain clinic, Clinical Pain Consultants, s.c. (“CPC”). CPC is located in Wauwatosa, Wisconsin.
The indictment against Lisa and Robert Hofschulz charges fourteen counts, alleging that CPC collected over $800,000 in cash from patients in 2015 and over $1,000,000 in cash in 2016 because its prescribers, primarily Lisa Hofschulz, prescribed excessive dosages of controlled substances outside of a professional medical practice and not for a legitimate medical purpose.
According to the indictment, as part of the conspiracy, Lisa and Robert Hofschulz ran Clinical Pain Consultants, S.C. as a cash only business and did not accept any form of insurance. They hired newly graduated nurse practitioners who had minimal experience in pain management and did not provide the proper training, but rather, pressured them into prescribing dosages similar to those being prescribed by Lisa Holfschulz. They also directed an employee, not authorized to prescribe pain medication, to do so. They did not provide any type of written policies for their employees.
Additionally, there was no collaboration by a physician for the medications prescribed, which is a legal requirement for distribution of pain medication, and when a physician discharged or lowered a dosage for their patients, the clinic overruled the physician's decision. Furthermore, Ms Hofschulz would mail prescriptions to favored clients and allow them to be picked up without being seen.
The grand jury further charges Lisa and Robert Hofschulz with fourteen counts of unlawfully dispensing and distributing controlled substances.
Both of these indictments were part of a larger National Healthcare Fraud and Opioid Takedown coordinated by the Department of Justice and the Department of Health and Human Services.
On August 13, 2021 Acting United States Attorney Richard G. Frohling of the Eastern District of Wisconsin announced that Lisa Hofschulz, a licensed nurse practitioner, and Robert Hofschulz, both owners and operators of Clinical Pain Consultants (“CPC”), were convicted of conspiracy to distribute controlled substances and unlawful distribution of controlled substances. Lisa Hofschulz also was convicted of unlawful distribution of controlled substances resulting in death.
On December 10, 2021, Lisa Hofschulz was sentenced to 20 years in federal prison, and Robert Hofschulz was sentenced to three years in federal prison for their involvement in a drug-trafficking conspiracy and “pill mill” operation.
