    Pattern of Complaint:

    On January 5, 2023 a pattern of complaints was detected for Exact Sciences. These complaints involved consumers stating that they have received Cologuard test kits without being ordered by themselves or their physicians, or stating that they were being billed for these test kits when they believed they were covered by their health insurance. 

     

    On January 18, 2023, BBB received a response for this detected complaint pattern. In this response, Exact Sciences has stated that it is a very small percentage of their transactions (.00076%) that actually result in a BBB complaint.

     

    For the complaints that are filed because the consumer had received a bill, Exact Sciences states that more than 94% of patients have zero out of pocket costs for Cologuard. They state that for those patients that do receive a bill, they do everything in their power to assist them, through their patient appeal program and patient financial assistance program. 

     

    As for the complaints that are filed because the consumer states that neither they nor their physician had ordered a Cologuard kit, Exact Sciences states that as Cologuard is a laboratory test, a health care provider places the order for a patient. They believe the complaints arise when a health system or insurance company initiates the screening and has tests ordered for those that may be overdue for a screening, and the consumer misses the communication that a test has been ordered for them. Exact Sciences also states that they notify patients by telephone and letter when a Cologuard order has been placed for them, and that they have additional, ongoing strategies designed to improve their patient/provider experiences during the screening initiatives. 

     

    In closing, Exact Sciences believes that most of the complaints that are generated could be favorably resolved by the patient contacting their customer service center, which is available for inquiries 24 hours a day, 7 days a week.     On 7/28/23, an additional letter was sent to Exact Sciences, as there was a continued pattern of complaints and customer reviews - pertaining to consumers being mailed Cologuard kits without any knowledge that they had been ordered.

      

     

    On 8/11/23, BBB received a response from Exact Sciences. This response stated that the recent increase in complaints likely relates to a number of preventive care initiatives undertaken by health insurance companies, health systems, or other providers with a pre-existing relationship with the consumer. Exact Sciences states that they are working with these entities to improve the communication and bring awareness to those for whom a Cologuard order has been placed as part of the screening initiatives and programs since the authorized prescriber is not always the primary care provider. Exact Sciences also states that these screening initiatives and programs are not a promotion, and they do not send a test kit without a valid order from an authorized prescriber. If consumers receive a Cologuard kit and do not wish to complete the test, they can return the box by using the pre-paid return shipping label. Alternately, they can simply dispose of the box. No charges or bills are submitted until a test is completed, and results are provided.

     

     

    Exact Sciences has also stated that they have created a dedicated team to review and resolve the recent communication gaps with the screening programs, and are exploring several potential avenues to improve their current processes.  Given that 60 million Americans are unscreened and colorectal cancer is the second leading cause of death and also the most preventable, Exact Sciences is committed to supporting these screening programs and ensuring that patients have a positive experience with Cologuard.

      Since my physician DID NOT put the prescription in for this test(Verified through message to physician). I want to know who wrote and authorized this prescription plus I would like the company to set up an email so that we can contact them with our issues. Not just a 24/7 telephone number to call because not all of us have the option of talking on the phone.

      On Thursday 25 Apr 2024 I received an email with a tracking number from Cologuard. The email was address to my father, who has passed away a year ago. Today the package was received at his address. I called Cologuard to inquire what prompt them to send this to my deceased father? And how did they get my email address and why did they send it? And no answer could be provided. Them doing this caused a traumatic experience of grief again. They had no right pushing this product out when clearly there was no need. I want ********* to provide any answer to 1) how did they get my email to send my deceased father notification that they sent a Cologuard test 2) why and how did Cologuard send my deceased father a test to his address.

      I received several letters from Exact Sciences asking me to sign to have them negotiate on my behalf for payment of lab testing with my insurance company for a cancer screening test that I knew nothing about. I was never contacted by anyone to get my approval to have any lab test taken. I was SHOCKED when I received a call from Exact Sciences to let me know that I owed them $1400 for two lab tests that I did not approve. I just received a bill and was even more SHOCKED that the two lab test cost near $10K. My insurance paid the $6K and there was an adjustment. I do not feel this was right and I do not feel I owe them anything! I did not approve these - I was NEVER given an estimate of charges because if I were given these I would heve DECLINED having these tests. They need to CREDIT the entire remaining balance and shame on them for overcharging cancer patients!

      I have received a letter and several texts from Cologuard stating that they are sending me a test kit. They say my insurance company United Healthcare ordered it. I DID NOT order it, nor have I spoken to United Healthcare about ordering a test kit. I read online that people have filed complaints about being incorrectly charged by this rogue company. I called the Cologuard company now and told them to NOT sent me a test kit that I NEVER ordered. The person taking the call demanded I give my home address. They already have this in their computer since they have sent me letters and texts. I don't want to be providing additional information to a company that is receiving numerous complaints for their unscrupulous business practices, so they can collect money from United Healthcare for sending out a kit that the person NEVER requested. I asked to speak with a supervisor and that never happened. This is some kind of criminal scheme that this company is undertaking. I did not order the test kit, nor did I speak to anyone at United Healthcare about ordering this kit. Cologuard tells the BBB that the customer can send the kit back, having to take their time to return a kit that was never requested by the customer. Read all the complaints that the BBB has on file for this crooked company, and their weak and phony answers they give to the customers who have received kits they never ordered. I will contact my state ************************* if they send me a kit that I never ordered, as well as my local TV consumer protections TV shows that investigate crooked outfits like this. Look at all the bad reviews for this company on Trustpilot as well.

      [This is their standard response to complaints, if you read the many complaints against them on BBB. The use the same HIPAA language over and over in their canned responeds.  They had to pay $13.75 million to settle a class action lawsuit in ******* in 2023, "without admitting any wrongdoing".  Sounds pretty sleazy to me.  They sent me letters and texts telling me they were mailing me their Cologuard kits, even though no doctor had prescribed one to me currently.  Their letter said it was already on the way to me.  I called them and told them to cease sending it to me, or I would contact my state's attorney general's office, as well as my local TV community investigative reporters.  I also contacted my ******** provider and told them I never ordered this Cologuard, and advised them about the multiple complaints against this unscrupulous company.  Consumers need to be aware of the criminal actions of this money making scheme.  I hope the *** will investigate the massive rip offs this company is doing by billing ******** and other insurers with this scheme.]

      I have been receiving unsolicited texts from Exact Sciences regarding their Cologuard test. I've been ignoring them. Today (4/19/2024) I received a Cologuard test kit in the mail that I did not order. My doctor has not ordered it. In fact, we haven't even discussed it. I feel that my privacy has been violated as all of my neighbors have now seen the box very clearly labelled "Cologuard" on my front step.I never asked for this, and I'm not footing the bill to send it back to them. They can come get it, or it goes in the garbage.

      Their reply states that the test can only be sent if a prescription from a physician is supplied.  My physician has NOT supplied a prescription.  The test was just blindly sent to me because they had me on their customer list from 3 years ago.  I don't even have the same doctor I had 3 years ago.  I switched doctors over a year ago, and we have never discussed a colonoscopy or the Cologuard test.

      I received a letter from Colonguard stating that I would receive a colon screening detection kit in the mail. It said my Dr ordered it. I called my Dr and he didn't order it. **** don't use Colonguard. My healthcare provider even said it wasn't ordered by my dr **** have also been calling and harassing me non stop. **** were trying to ask for my personal information. I have finally blocked their number. I have seen online that they have been doing this to a lot of people. I want it to stop! I told them I didn't want the kit and they said they are sending it anyways. **** have also been texting me. I blocked that too.

      Exact Sciences has been billing me since 10/23 for a cologard test kit they sent me and I completed on March 13 2023. I had Blue Shield HMO insurance at the time and this was ordered by a Teladoc arranged by Exact Sciences online, and I was told it was covered by Blue Shield. However, in October I received a bill for $680.On 8/28/23 I spoke with ******* at Exact Sciences and was told on a conference call with ******* from Blue Shield they would be submitting the claim to my ************** On 10/31/23 I recieved another bill this time I spoke with **** at Exact Sciences and was told that they have never submitted the claim to my ************* like they said he apologized for the mistake and said they would submit the bill through my ********** services with Blue Shield and to wait until I hear from either Blue Shield or Exact Sciences for a decision. In March of 2024 I received another bill from Exact Sciences for $680. This time I called my insurance. On 3/22/2024 ******* at Blue Shield spoke with Exact Sciences on my behalf and was told that again that they never submitted the claim, but now they would be submitting the authorization request through my previous medical group Optum that I was with at the time. If the ************* denied it they would then submit it to Blue Shield under my ******* benefits. I received another bill today for the amount, and when I called my ************* Optum Medical they said a claim has still never been submitted by Exact Sciences to them. Per Blue Shield to date they have not submitted a claim under ******* services to them for payment either. I am in limbo now because I cannot appeal something that they have never received a claim for. The problem I have is Exact Sciences refuses to do what they have told me they were going to do for 8 months. They keep telling me they were going to take care of this and they are lying. They are just billing me directly. I have attached the audio from Blue Shield.

      How am I able to request my insurance to cover something that the Exact Sciences doctor ordered? They have a system that gives the patient a telehealth appointment and then they never submit the claim to the ************* so the patient is unable to appeal any decision. The ************* never ordered this their own ****************** that they use did. Therefore the patient is stuck with the bill. Then over a year later they claim it was submitted on 3/24/24 over a year later to my *************. When my wife called on the 16th to ask why the claim was submitted so late she was told she couldn't and wouldn't tell her it was not her information to have.  However my ************* still claims they have never received a claim.  So here I am in limbo unable to appeal a claim that was never submitted correctly. When my wife told her that that is not legal to bill an HMO patient for services they never properly obtained an authorization for, and she proceeded to berate her. They are a scam. I would encourage them to pull the audio file of my wife's conversation on the 16th where she told  ***** to "stop talking" when she was just asking why the claim was submitted so late.

In accordance with the **************** Portability and Accountability Act of 1996 (HIPAA), we will need a signed HIPAA Authorization to discuss this matter further.  The HIPAA authorization form on the BBB website does not transfer to Exact Sciences.

Although we cannot disclose any patient information pursuant to the **************** Portability and Accountability Act of 1996 and its implementing regulations (HIPAA), we can offer general information to resolve the matter.  

      Currently, the test can only be ordered for individuals with a prescription from a physician.  Understanding the importance of preventive care, many payers have screening initiatives. Therefore, it is not uncommon for a provider within the payers network to facilitate ordering. There should be zero cost to the patient as a health plan member benefit. Please note that if there is no interest in using the test, a test kit can be recycled at no cost to the individual and a claim will not be sent to the insurer.
